This was resolved quite a while go, in fact before his building was delivered?

I am rejecting this response because: The Barnyard has merely passed the blame on to their subcontractor (i.e., their agent). However, since their subcontractor was acting as an agent of the Barnyard the Barnyard is responsible for the acts of their agents (See the law of agency). Furthermore, the Barnyard has also passed the blame onto the cable company because "any utility line is typically laid deeper than that". The Barynard cites to no code of the state of Connecticut to back their position. The reason for this is that there is most likely no code for cable companies to bury their lines. This is why using "[redacted]" is crucial. More specifically, "[redacted]" is the law for "Anyone using power or mechanized equipment who disturbs the earth on or below the surface" because utilities are not always at specific depths due to frost, heaving and other acts of nature. Since the Barnyard has refused to take responsibility and merely passed the buck, I reject their response.

Review: I contracted with The Barn Yard Enterprises, Inc. ("The Barn Yard") for a 10 x 16 shed and a stone pad so that I could create space in our current garage for this winter. On 10/2/2014, The Barn Yard's crew started work on the stone pad. As part of the installation of the stone pad, The Barn Yard's crew used excavating machinery and tore up our cable line that runs to our house.

I immediately notified my contact at The Barn Yard that our line was dug up and I was assured that The Barn Yard would take responsibility. However, after a few days I realized nothing was being done. For example, on 10/8/2014 I was called by [redacted] at The Barn Yard for a status of the pad. When I spoke to her, she had no knowledge of the damage caused by her company. On the same day, after having made multiple calls to [redacted] since 10/2, a technician arrived at our home to inspect the dug up line. I was told that most likely a new trench and new line would have to be installed and they would try and schedule the new trench prior to the winter. However, if they can't schedule the new line and trench by winter, we would have to wait until the ground thaws.

The resolution of the problem has fallen on me causing me to take time from work to fix The Barn Yard's violation of state law. The Barn Yard violated CT state law by failing to contact [redacted] prior to the installation of our stone pad. Furthermore, The Barn Yard violated CT state law by failing to notify our cable company, [redacted], that they had dug up our cable line. I did contact the State of Connecticut who is also involved and I was assured that I would not have to pay for the damages caused by their failure to contact [redacted].

Moreover, it appears that since The Barn Yard has not stepped up, I have had to spend my time to get this problem resolved and there is a good chance I will not have my shed by winter due to The Barnyard's failure to simply follow the law.Desired Settlement: I would like The Barn Yard to take charge of this problem (instead of me), get everything resolved before the winter, and I want to be compensated for my time to handle their violation of CT law.

The Barnyard Enterprises, Inc. prides itself on exceptional customer service and we are disappointed to see a complaint filed against us.

Although we empathize with Mr. [redacted] frustration we feel that we have stepped up to resolve the problem; however there are circumstances that prevent us from performing as Mr. [redacted] believes that we should have.

The Barnyard employees its own delivery team, but sub-contracts a few highly trusted landscape companies to prepare the stone pads for shed placement. It was our sub-contractor that was on Mr. [redacted] property on October 2, 2014. Although we were not made aware immediately and agree that we should have been of any problems we did find out by our standard courtesy call from our delivery coordinator that they hit the conduit for the cable line – not the line itself. Mr. [redacted] cable service has not been interrupted. [redacted] has been notified by both Mr. [redacted] and by us and the repair service has been scheduled on November 19th. Although Mr. [redacted] insists that we should be able to either fix the conduit ourselves or should be able to find a contractor who can do so, we have been told from [redacted] that under no circumstances are we allowed to touch their cabling or conduit. Also, it is not recommended that we place a shed on top of the conduit; it needs to be re-routed and will be done so by [redacted] on November 19th. This should have been done regardless of the damage done to the conduit.

In response to the “[redacted]” Violation. The stone-pads are only dug out to 6” and any utility line is typically laid deeper than that. The Cable line was unusually only 2” below the surface. Regardless, it was the sub-contractor’s responsibility to schedule the service and they are in violation, have been fined, and have to take a [redacted] training course.

We apologize that it took so long to respond. [redacted] is no longer with us and we just updated the contact information for Revdex.com.

Review: At 6:30 AM your crew began work at the house across the street. Their is a town ordinance that states no construction work can occur before 8 AM. I walked across the street and informed them of this law to which their response was stop bhing and moaning. I called [redacted] Police to put it on record and if it occurs again I will be calling and having them come out and stop them.Desired Settlement: They no longer start before the stated legal time

purchased shed from Barnyard 2 years ago, then ordered (prepaid) accessories , approx $400. Was told 2/3 weeks to come in. My issue with these folks is that they have no real interest in satisfying customers after sale... Called multiple times and got the "lip service" never a return call, always made to feel like I was a nuisance! I'd never get away with such poor post sale service in my industry!!
