In response to complaint from [redacted] ***, previous resident at [redacted] ***, my name is [redacted] - Property Manager for [redacted] , managing for The Barry Co, LLC Lease started Lease expired Closed out No notice was turned in for vacating property, therefore she was charged for no notice $and the reletting fee of $(which is 85% of one month rent), she was also charged $for cleaning, as no cleaning was done to any of her unit, and she was also charge no returning of keys ($for gate key, $for apt key and $for mailbox key) She was also charge for rent for August of $and utilities of $39.03, as we were not aware of her moving out status We closed her out and charged accordingly and proceeded to send to collection Please call or email if you have further questions or if I can be of any assistance Thanks [redacted]

They never answer the phone there management team at the apartment are slumlord and fix anything

For your reference, details of the offer I reviewed appear below.I vacated the property on July 14th, My new lease began July Majority of my personal items were removed from the premises the weekend prior to July I was not in the property as of the 14thElectricity was disconnected as of the 15th of July with ***My landlord verified my rental history with *** in Early to mid June with no issues from managementThey were notified in writing that the property would be vacant as of the 15th of July which was included in the full payment of July rentIt is not my fault that they waited so long to close out their filesThis is unacceptable.

I lived at of the Barry Companies properties by the name if Smoketree Townhomes in Houston, TXI stayed for whole year and moved out according to contract in January My wife went and turned in the keys and filled out the forms with our new address and was told it takes no longer then month to receive your depositI waited patiently until it hit Feb22, and still had not received no letter nor deposit from themI call the office and the women states oh we have no new mailing address for you and I tell her okay well we filled out the form she said yes I remember I am sorry we may have misplaced itSo I give her the address AGAIN! I wait 2-weeks and still no letter or deposit backI call the office again and ask the status and she states WE HAVE NO MAILING ADDRESS I said are you kidding me? I just called weeks ago and gave someone the address for the 2nd time and then fed up I asked for corporate # and she gave it to meI have called and left about 2-messages

No notice was turned in for vacating property, therefore she was charged for no notice $549.00 and the reletting fee of $466.65 (which is 85% of one month rent), she was also charged $80.00 for cleaning, as no cleaning was done to any of her unit, and she was also charge no returning of keys ($50.00 for gate key, $10.00 for apt key and $5.00 for mailbox key).  She was also charge for rent for August of $389.61 and utilities of $39.03, as we were not aware of her moving out status.
We closed her out and charged accordingly 8.22.14 and proceeded to send to collection.

I do not show any notice to vacate in [redacted] file and I do not have any forms where we have been contacted regarding her rental here at [redacted].  I would like to help [redacted] in any possible manner....If there was a 30 day notice to vacate turned in, we would have signed off on it, dated it and made her a copy and the original would be in her file.  If [redacted] has any of the following information, I would be glad to assist.

To Whom It May Concern, Please be advised that I am responding to the complaint I received on 1-20-2014.  The resident complaining signed our community policies that specifically, in detail, explain the rules of parking cars on our property, furthermore, we have a photo of her car with the tag...

on it.  She clearly was in violation of current registration and flat tire.  We have proof from our Tow Company Service, and signed Community Rules from the resident.  There will be no compensation from us regarding this matter.  If you need any further information, please feel free to contact our rental office at 480-968-8697. Sincerely, [redacted]

We have the signed Community Policies and Procedures here in the office, as well as a photo of her tagged vehicle prior to towing.  We will email a copy of both to you no later than February 7th, 2014, as our day is filled today with a property inspection.Sincerely,

I have reviewed the response made by the business in reference to complaint ID[redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the They'll have to send the picture with the tag on my car since when I saw it on Wednesday January 15, 2014 There was nothing , absolutely nothing on it. Furthermore, I have no copy of whatever item they claim my signature is on with my lease copy. Please have them send this to you , thank you. Having a flat tire is till no excuse for towing it. Many people don't have a registration sticker on their car when they don't use it. You can stick it on when you do.
