Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me
Sincerely,
*** ***

In response to the complaint as stated by Mr***:The Basement Finishers, LLC entered into a written contract with Mr*** on May 20th, for the finishing of a basement in his homeDuring the work per Contract, this owner failed to make payments to The Basement Finishers, LLC in a timely
manner and according to the Payment Schedule in the ContractAdditionally, the work was stopped and started by Mr*** many times due to his continual changes and modifications throughout the basement finishing processThe Contract clearly states when payments are due and payable after certain work is completedMr*** failed to make these payments according to this Payment Schedule and is currently in arrears on his final payment dueLate fees per the Contract terms have been added for this reason of not being paid in a timely manner and per agreement. Regarding his complaint about a HDMI cable, this cable was installed by The Basement Finishers, LLC per Mr*** request as an OptionOne end of the cable was installed where his TV was to be placed, then continued and terminated at the A/V shelving where his cable TV box is locatedHe approved this installation prior to drywall and this cable was installed to code requirements and passed all inspections accordinglyBefore The Basement Finishers, LLC were able to complete this work, Mr*** cut holes in his drywall to move this cable and installed the cable to his cable boxWhen The Basement Finishers desired to complete the "trim plate" work, Mr*** did not allow our Project Manager or electrician to install the finish plateThe HDMI cable was operational when the work was completed and to our knowledge, is currently operational. All work performed by The Basement Finishers, LLC was to current code requirements, passed all final inspections and was to the Contract terms and specificationsUnfortunately, due to Mr*** failure to pay his final invoice due, legal action will be needed for resolutionThe Basement Finishers, LLC

This customer is totally wrong in his allegations and The Basement Finishers will provide witnesses and documentation to support in County CourtThe HDMI cable was installed per code, inspected by the Building Deptit is operational and customer has not been paid for this work. Further, the other claim will be the late fees assessed for non or slow payments to our company over the course of the basement finish projectThe Basement Finishers, LLC

document was ever sent to our office on this matter from the Revdex.com. In the event of disputes, we inform all clients that we are prepared to litigate any issues in County or District Court for resolutionHowever, our Contracts also state that the party that predominately prevails in this court action, would have all of its legal fees, court costs, attorney fees and service fees paid by the remaining, non-prevailing partyWe are prepared with all documentation and necessary witnesses for such litigation if MrYegge so desires. The complaint from this client is filled with so many statements and inaccuracies that it is difficult to start with a proper response
To start with, The Basement Finishers, LLC had provided labor and materials on good faith for this client for many weeks, when he then informed that he
did not have the funds to pay for the labor and materials per Contract termsHis failure to pay invoices is just one of the delays that he caused on this project
In addition, when asked about paying his invoices, this client then lied about mailing checks that never arrived, lied about paying the invoices on time and disregarded the delays he caused for the additional items he requestedAll of these are what has delayed the completion of his basementNothing on the part of The Basement Finishers LLC has caused any delays whatsoever
The Basement Finishers started his project on August 6th, not July as he has again lied in his complaintThe projected completion was weeks from that date, not weeks as he has stated in another lieThis week schedule standard and was subject to any changes, modifications or special order items the Client should requestThis is our standard timeframe on most basement projects
Within days after work started in August, this client began making numerous changes ....including wall framing changes, adding over $in changes to the electrical items, he then added tile in the Bath and added more tile on the floor areas of the bar, then changed from a bar formica countertop per Contract, to a granite countertop, which resulted in special fabrication and installationHe requested these items because he liked our workmanship, and he understood the delays when he requested themThese changes alone took 4-weeks to properly prepare, order and execute
Then, after all of these changes were made, this client informed us that he did not have the funds to pay our invoices after work was already performed in good faith by our work staffPrior to telling us he did not have the funds, he first told us he mailed checks that were mysteriously lost in the US mail system and then never arrivedThey never arrived because he never sent them to us in the first place, he lied about mailing them to keep us working on his basementThis is an actionable offense in a court of law, if TBF so elect to pursue
Once TBF realized he had lied about his payments, work had to stop until all payments were made currentIt took many weeks for this client to eventually pay his invoices current, which cause considerable delays in the completion of the work
After over weeks of delays that this client caused for changes, additions and failure to pay invoices, he has now filed a complaint filled with lies to try and damage TBF reputationIf required, TBF will pursue legal action against the client for defamationTBF would certainly welcome a court action to prove our case beyond any claims this client has made to the Revdex.com or anyone else, we have the documentation and witnesses
After many weeks of waiting for his decisions and invoice payments, we were finally paid current and work proceeded accordinglyAll of the delays on this project are directly related to the changes, additions and failure to pay invoices by this client, not The Basement Finishers, LLC
Further, in his complaint, this client has named persons with titles because he evidently does not comprehend the business definition of a Limited Liability CompanyTBF is registered with the Secretary of State and the Internal Revenue Service as an LLC, not a self-propriety business
The Basement Finishers, LLC has performed 100% to the Contract terms and specifications as agreedTo prove this, we challenge this client to take this matter before a Douglas County Court and determine who is at fault with the issues at handIf he truly believes we have breached the Contract, why doesn't he file the action as threatenedTHB would welcome our day in court and after TBF prevails, this client would be required to pay our legal fees and costsWe will easily prove, with documentation and witnesses, that The Basement Finishers, LLC performed to contract terms and did not breach in any way whatsoeverHowever, we will be able to prove that this client failed to pay invoices per Contract terms, and made numerous changes to the plans and specifications from the original Contract
As of today, Dec28th, 2015, we are continuing to work in this client's basement to complete the work within a short timeFinally, just days ago, (Dec26th) this client finally paid his invoices current, including his late fees for failure to pay his invoices per termsNo other action is required as that The Basement Finishers has complied with each and every term of the Contract and will continue to do so
While we feel strongly about the response as stated herein, we are also hopeful this client withdraws his inaccurate complaint and allows for a positive end to our business relationship and completion to a beautiful basement project

Dear Revdex.com,      The complaint from this client is not only invalid, it is missing pertinent information as to why their project was delayed on many, many occasions.   The Contract with this client and all of our clients clearly states that any changes, modifications,...

special order items, etc, will cause delays in the project completion. This client began making many changes and additions within 1 week after the initial work commenced in May, including adding substantial electrical items, adding custom tile decos and pieces in the Bath, fully custom Bar countertops, additional finishes in storage areas, custom shelving units and much more. In addition, this client asked us to stop work for over 2 months while they engaged [redacted] to install a custom wood flooring substrate and wood flooring throughout their basement area. This caused considerable delays for all trades that were working on this project. All of these trades had to find other jobs to fill the VOID that this client caused by this added flooring by [redacted].  In addition, this client went on several vacations and out-of-town trips that caused the work to stop until they returned. They failed to include these delays in their complaint because they wanted our company to be viewed as the cause of these delays. The workmanship on this basement is outstanding and all inspections passed many weeks ago. This client requested a special order wood cabinet filler piece that was not part of our Contract. This special order piece had not yet arrived to Denver and would take less than 5 minutes to install. The Basement Finishers, LLC denies all of this clients claims as to causing any delays whatsoever on their project, and The Basement Finishers, LLC has all of the documentation, emails, texts and voice mails to prove its position.

Complaint: 11387267
I am rejecting this response because:Even last Friday (4/22), I got an email from the Project Manager (employed by The Basement Finishers) asking for a convenient date to install the HDMI the right way. Why would they do that if it was done right in the first place? It was never installed inside a box and so I have not paid for it. I am willing to pay for it even now, once it is installed according to the initial request. I sent an email request to The Basement Finishers to come and look at it, but they have not replied. They never came and looked that issue even once.
Sincerely,
[redacted]
