Review: After vacating my apartment [redacted] on 9/1/2014 per the terms of my lease, [redacted] tried to keep my security deposit citing a lack of notice per a letter received 9/26/2014. I had told them verbally 5/16/2014 when I lost my job, and gave them written notice on 5/23/2014 in person that I was opting-out a lease end/per 90-day addendum until I found new employment. When I called to discuss on 9/26/2014, the manager told me they had my letter of notice in his hand, it was an error, and assured me that I was a great tenant and he would resolve the issue ASAP considering all the issues I had experience in my 4-year run there. I thanked him, but mistakenly also let him know that I had moved over an hour away and that all my paperwork was in a storage bin near the [redacted] complex and would be hard to find. Well…he called me back a few days later and let me know my notice had “disappeared” and told me that I would need to bring a copy of the letter advising them I was leaving the apt. even though my lease was up on 9/1, and I haven’t signed any contract in 3 years. At the time of my vacancy I had open issues with drain flies in my apt., dead flies in the laundry room, a range where 2/4 burners would catch fire if used, heating & AC failures (heating they would fix when it broke about 2 times a month, the AC never worked consistently). All of these were ignored both before, and especially after I gave my notice. My at the time 5-year old daughter was also injured as a result of a hole in the deck that was damaged during Hurricane Sandy. This injury occurred in the spring of 2013, and I had asked for repairs, citing my daughter could be injured, in October of 2012. All requests were denied until after my daughter was hurt. I was also literally flooded out of a previous apt., 29 G and was never returned the security deposit for that unit as well. Furthermore, they immediately re-rented my old apartment which makes me certain they received, then destroyed.Desired Settlement: I was planning on renting there again in January despite all the problems because of my strong friendships I built there in the community. I'd like my deposit back, I am a single father who was unemployed from 5/16 until 10/6. If no refund, I would like to know why they would use a loophole to keep a deposit (again manager [redacted] told me 9/26 that he had the notice in his hand) from a loyal customer who was flooded out of one apt., and then lived in anther one without consistent working heat & AC, whose daughter was also injured at as result of their negligence, etc.

Mr. [redacted] original apartment at [redacted] was [redacted] which he transferred from into [redacted] along with his security deposit of $925.00, which he

acknowledges in his letter of January 26, 2013.

Because of maintenance issues during his tenancy, Mr. [redacted] rent was reduced from $945.00 to $915.00 monthly.

After giving proper notice on several occasions, which he rescinded and allowed his lease to reinstate. Mr. [redacted] vacated, without notice on August 31, 2014. The apartment was re-rented on October 1, 2014. We are entitled to rent loss for month of September at $925.00. A refuhd of $26.95 was returned to him.
