[redacted] ** [redacted] [redacted] [redacted] I am in receipt of your complaint, dated 7/13/ Upon research of this complaint, I have found the following things; Mr [redacted] purchased his home on October 30, When Homeowners purchase a home in our sub-division, they are enrolled in the 2-Home Buyers Warranty program At that time they are given an instruction manual and a list of what is covered and how to request serviceThey are also told at that time that they can call 2-HBW if they feel that the service that they are receiving from the builder is less then what they expect or if they are having issues getting something repairedOur company was contacted by Mr [redacted] via email on June 7th@4:pm He explained in his email that his air conditioner was not working and that he hired another company to come and fix the unit He also requested at that time that we reimburse him for the original cost of the unit We had not received any notification prior to that point, that he had issues with the unit or that he was requesting service He did not contact Trane or [redacted] to complain about the unit, who the warranty for his equipment is withWe forwarded Mr [redacted] ’s email the next day to [redacted] ***, the HVAC Contractor who installed the unit and serviced the unit the prior year [redacted] did reach out to Mr [redacted] on June 8th, and asked if they could send someone out to look at the unit- but he refused their request for service He also had the unit repaired by another company, and had not given [redacted] or Trane a chance to make any necessary repairs or to inspect the unit prior to the repair Mr [redacted] stated in his complaint that he was beyond his one year warranty At the time [redacted] contacted him he still had the following warranty available to him from Trane: · year coil warranty · year furnace warranty · year AC warranty And the following warranties from 2-Home Warranty · year Mechanical Warranty until 10-31-· year Structural Warranty until 10/30/ We did send Mr [redacted] a letter after he contacted us again that according to his 2-Warranty he failed to give prompt and proper notice to 2-HBW and the builder of any defectHe should have given the builder the option to repair, or replaceBy his repairing the unit without giving us the ability to inspect the unit, and make reasonable repairs he violated his warranty agreement with the builder and 2-HBWWe also explained to him that he can fill out the “Notice of Complaint Form” with 2-Warranty, which is located at the back of the 2-Warranty book he was given at closing We also supplied the phone number for the Warranty Service Department for 2-WarrantyMr [redacted] did not follow any of the afore mentioned guidelines that he was given at closing to get his HVAC system repairedUpon choosing to contact another HVAC company to repair the unit he thus violated his warranty with 2-HBW, Regal Builders, [redacted] as well as Trane Please feel free to contact me should you have any questions or require any further information Thank you; [redacted] Service Administrator Regal Builders, LLC

- Regal Builders and ** *** an opportunity to repair the air conditioner in June of 2016. - In June of the SAME issue arose again. - Regal Builders who we purchased the unit from did NOT contact us for three weeks. - We could not afford to be without A/C for an extended period of time during the summer. - We could NOT afford to turn the A/C on for the first time in and have it not work again. - This house was purchased as a brand new house and to have to put up with the same issue in two consecutive years is appalling. - The pictures above demonstrate the poor workmanship of ** ***. - The letter that Regal Builders sent us after three weeks, absolved ** *** of any responsibility. This was NOT within their purview to do

  Mr. [redacted] purchased his home on October 30, 2015. When Homeowners purchase a home in our sub-division, they are enrolled in the 2-10 Home Buyers Warranty program.  At that time they are given an instruction manual and a list of what is covered and how to request service. They are also told at that time that they can call 2-10 HBW if they feel that the service that they are receiving from the builder is less then what they expect or if they are having issues getting something repaired. Our company was contacted by Mr. [redacted] via email on June 7th@4:25 pm.  He explained in his email that his air conditioner was not working and that he hired another company to come and fix the unit.  He also requested at that time that we reimburse him for the original cost of the unit.  We had not received any notification prior to that point, that he had issues with the unit or that he was requesting service.  He did not contact Trane or [redacted] to complain about the unit, who the warranty for his equipment is with.         [redacted]             [redacted] I am in receipt of your complaint dated August 9, 2017. As I stated in my previous response, Mr. [redacted] was out of our limited 1 year warranty.  He still had warranty available to him through Trane, and 2-10 Home Buyer’s Warranty.  He never notified Regal Builders, [redacted] 2-10 Home Warranty or Trane that there was an issue till after he had repairs made.In his initial complaint that he filed with you, he stated that the unit broke on May 15th but he had another HVAC contractor come and repair it on June 6th, and then notified Regal Builders on June 7th.  Regal Builders notified [redacted]’s who reached out to him on June 8th and he refused service.Mr. [redacted] further stated that Regal Builders didn’t contact him for three weeks.  [redacted] the company that provided the equipment, installed the equipment, serviced the equipment and warrantied the equipment contacted him immediately upon notification by Regal Builders on June 8th, and offered to come out and look at the unit – and were refused.Mr. [redacted] was given the 2-10 Home Buyers Warranty information at his closing.  He could have contacted 2-10 warranty at any time to report the broken unit, but he did not.  As per Section III Paragraph A of your 2-10 New Home Buyers Workmanship, Systems and Structural Warranty book; o   The Builder should have the option to repair, replace or pay you the reasonable cost of repair of any defect.  The design and the method and manner of such repair shall be within the sole discretion of the Builder as applicable.  As per section VIII Paragraph 7: Any loss or damage that is caused or made worse by any of the following causes, whether acting alone or in sequence or concurrence with any other cause or causes whatsoever, including without limitation:o   Negligence, improper maintenance, defective material or work supplied by, or improper operation by, anyone other than your builder or its employee’s agents or subcontractors, including failure to comply with the warranty requirements of the manufactures of appliances, equipment or fixtures.o   Your failure to give prompt and proper notice to 2-10 HBW and your builder of any defect We also explained to Mr. [redacted] that he can fill out the “Notice of Complaint Form” with 2-10 Warranty, which is located at the back of the 2-10 Warranty book he was given at closing.  We also supplied the phone number for the Warranty Service Department for 2-10 Warranty.In reference to the pictures – we cannot verify the origin of said pictures, and since we were not given an opportunity to inspect the unit prior to the repair, we cannot comment on the pictures.Mr. [redacted] did not follow any of the afore mentioned guidelines that he was given at closing to get his HVAC system repaired.
