February 21, 2017RE: [redacted] To Whom It May Concern:Below you will find the details surrounding the complaint filed by [redacted] .During a period between October 19, to January 4, I (Tim K***) have had both verbal and written correspondence with the ComplaintantDuring this period I reviewed the application for residency, lease, guaranty agreement, and all email correspondence regarding this issueMy findings (below) were relayed to the Complaintant.The email chain between Melissa R [redacted] (Leasing Consultant) and the Complaintant was tracked through our management softwareI have been able to review the email chain and I can find no such email requesting termination of the lease to validate the email that the complaintant scanned to me previously.I also reviewed the lease that was electronically sent on 5/2/and signed on 5/9/for the 2017-lease yearAttached you will find a fully executed lease, including the Guarantor Agreement (page 19).The electronic signature utilized on both the application and the lease eliminates the need for a notary making both the application and lease, legally binding.To ensure the authenticity, applicants create their own login using infoto complete the application, lease, & guaranty lease agreementThe IP Address registerd for both of the applications & lease agreements which were completed & signed over a time span of days is identical for both the Guarantor & ResidentThe IP Address is not registered to McKinney Properties or ULofts ApartmentsHowever, the IP Address is registered to [redacted] .With the facts at hand, the signed lease needs to be honored.Should we be able to re-rent the apartment space prior to the end of the lease term we will adjust the balance due accordingly.Should you have any questions, please do not hesitate to contact me.Tim K***, CAMRegional ManagerMcKinney Properties, Inc

ULOFTS/McKinney Properties does not have the required documents needed for an approved co-signer and is fully aware they do not have these and has not provided these ULOFTS/McKinney Properties are aware that they do not have a copy of my DL or SS along with my correct DL number as they never received these items from me to co-sign for the lease.? I did not go through with the remainder of the co-signer steps since [redacted] was not going to stay in Lubbock for the upcoming semester.? With the two required documents on the guarantor form being a copy of my valid DL and SS, they never received these as I did not move forward with co-signingThey have a "lease"- again without the correct DL # on it, or a copy of my valid DL or SS to prove I was the person who was approving to co-sign.? ULOFTS/McKinney has no records of my personal information as I did not go through with so-signingThis is a large business trying to take advantage of the consumer.? They do not have the required documents needed or completed, as they did not receive the required/final documents from me to co-sign for the leaseWithout a copy of my DL, SS with the guarantor form or a complete lease, they do not have the required documentation to hold my responsible for a co-signerAgain, I did not give the required documents as [redacted] was not moving in and we were ahead of this in advance.? Good afternoon ***,*For anyone to co-sign for an apartment with ULOFTS, they must have the completed Lease Guaranty form signed and notorized providing proof that this person is who they say they are and they approved co-signing ULOFTS does not have any of this documentation from me as I did not complete these forms or give this approvalNor did ULOFTS receive a copy of my DL or SS as required with this form.*In addition, the lease that ULOFTS has provided has a lease that lists a Drivers License number that is not mine. Please see the two attachments labeled A & B Attachment A shows the email from Melissa with ULOFTS with the Lease Guaranty form that was never notorized and completed by me Attachment B shows the DL numnber on the lease and that is not my DL number.With these two items not being completed and not with my DL information, ULOFTS can not hold me accountable as a co-signer Just because ULOFTS would like to attach this lease to me, does not mean they have the required documents to do so Without any of these items completed by me or with my required information, I can not be held responsible for this lease.Please let me know if you need any further information or if you would like to see a copy of my DL to show that the number is indeed not mine.ULOFTS may address the lease itself with ***, but I can not be held accountable as a co-signer without the required documentation.Thank you,*** ***

As stated in previous response, McKinney properties sent me a document stating that a notorized signature was required for all guarantors and a photo copy of the guarantors DL & SS card was requiredThis documentation is in previous documents that I sent inMcKinney properties does not have these required documentation. McKinney properties is now "saying" the on line lease document being completed is "enough" - however that is not in the signed documents in print anywhere verifying this statementMcKinney properties is verbally twisting the policies to try and hold someone accountable that did not complete the required documents to co-sign for the apartmentThe on-line lease was not completed by me, the info on the lease is not my information and they still have not provided proof that I did because they do not have proof or any of the back up documentationFor McKinney properties to accept any online agreement, they would still need to have a notorized signed copy of the persons signature and identity to verify that the person signing the guarantor lease is indeed to the person thay say they areThe on-line lease was not completed by me, the info on the lease is not my information and they still have not provided proof that I did as they do not have proof or any of the back up documentation

RE: Response to Complaint ID [redacted]To whom it may concern:This letter shall serve as a formal written response to Mr. [redacted]'...

concerns regarding his repair on his 2005 BMW X3. Upon inspection of Mr. [redacted]' X3, there is no evidence of an issue with this component. The owneralleges there was noise in the differential but he did not bring the vehicle us to have it evaluated. He did not call and advise that there was an issue (no Contact to the Service Advisor or myself) but instead chose to investigate the issue on his own. He claims he drained the fluid out of the unit and found it be "less than half full of fluid," however:o We have the verbiage documented on the initial work order that we "replaced the diff AND TOPPED FLUID."We have no way of verifying how he removed the fluid which opens question about the measurement of fluid. I understand that he presented fluid that he claims is from the differential, but the reality is we have no way to know where this sample came from.o We serviced the differential during this examination to be 100% sure that it was properly filled (to the correctlevel and with the correct fluid). I have a video of the service that can be provided but the file is too large to Send Wia email.We did not advise the owner to "drive it 'til it fails or goes out of warranty." My offer to the customer, which was made purely out of an effort to extended goodwill, stated that I would extended the BMW warranty on the repairs for an ADDITIONAL two years for a total of four years of no cost replacement coverage. I also stated I would have the differential Serviced for preventative maintenance and to re-evaluate the condition of the unit....again, at no cost to the Customer. See attachment for documentation.In short Summary, this is not of a case dismissing the customer. We have made multiple, fair and reasonable efforts, to address Mr. [redacted]' concerns. The reply was untrue. I was told the car was still mine if I wanted it but not at the price we agreed at. I went ahead and purchased another BMW elsewhere. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me (wish someone would have called, customer sevice is a thing of the past).
