We feel bad for the situation, however, the dress was signed off by the purchaser as fine when it left the store We cannot be responsible for what happens to the dress once it leaves here We do not clean dresses at our store as we don't have the means to do so It clearly states on the sales statement that dress cleaning is the responsibility of the new owner Sample dresses are sold as is and are inspected by the owner before they leave the store The manufacturer of the dress may be able to help Without bringing the dress to our store, we cannot know how to help with the situation We simply cannot refund monies to customers who call us to tell us there is a problem with their dress a year later.Tell us why here

Unfortunately, I did not collect the monies so cannot provide a refund [redacted] owned the company at the time and she can take up the matter I do have a copy of her old sales statement that clearly states the items left for more than thirty days become the property of the company It is very unfortunate, however, I did not collect the monies so have no monies to return I [redacted] am on record for establishing a new business and Tax ID beginning March I would suggest taking up the matter with the previous owner Very sorry for the situationTell us why here

I am rejecting this response because: The is more than the issue of the dress changing color. The fact is she LIED d to us regarding the design being discontinued which resulted in misleading us into buying her dress. I have witnesses regarding her statements that the dress design was discontinued indicating that wedding dress designs have a very short shelf life to ensure brides get as unique a dress as possible. She is not a reliable retailer and she should have told us the truth that we could have ordered the dress new if not from her then someone else. Bottom line is she wanted the sale.

I am rejecting this response because: As a consumer, I don't believe the business changing ownership should affect me. The store still operates under the same name and is in the same location. I am in possession of all of my original paperwork and nowhere on the paperwork does it state that merchandise not claimed and picked up within days becomes the property of the company. In fact, when I purchased the dress, my wedding date was over a year out. I specifically asked the shop if I needed to pick up the dress and bring it back for alterations when my wedding date got closer, and they told me that they would hold onto the dress, as was their usual practice. When my wedding got called off, I notified the shop of my circumstances. I again asked if I needed to pick up the dress within a certain time period. They assured me that there was no specific time period and that they would hold onto it until I came to pick it up at a time that was convenient to me. When I did make an appointment to pick it up and the shop was closed on the date and time that they had told me to come in, at that time nobody informed me that I had to pick up that dress within any set time period. The shop knew that I had paid for that dress and they made no effort to contact me to tell me that I would lose it if I didn't come in to get it. Had they done so, I would have went and immediately picked it up. I have no idea what they even did with that dress or if any effort has been made to locate the dress. I believe I'm entitled to a refund since I paid for merchandise and never received it. I would also be happy to go pick out another dress for the same price

While we do feel bad about her situation, the dress was purchased from the previous owner.  The is a new business with a new tax ID number and the only thing that is the same is that Name of the company.  I spoke with the previous owner, and she had made arrangements to take the dress to...

her, but that never worked out.  The dress was at the shop for two and a half years.  The sales statement that she signed clearly states that any merchandise not claimed and picked up within 30 days becomes the property of The Company.  My new company did not receive monies from the customer so therefore cannot offer her a refund.  Perhaps she needs to pursue the previous company/owner.
