November 10, In reference to: [redacted] ***Complaint: [redacted] is not being truthfulOn 11/05/went to [redacted] job in VA, to look at her vehicleThe rear of the vehicle was smashed pretty badI said to her, I would call later in the day with a priceAfter the estimate was done I did call quoted $2,(I knew a job that large cost much more than $2,000) She was a friend of another customerI told her if she get a paint job all over, that would be $moreAnd once take the vehicle a part it could be more moneyShe said ok [redacted] dropped her vehicle off November 06,told her then there was 50% due at that timeI dropped her off at [redacted] RentalI started on the vehicle that day 11/06/there was damage I called for a supplement [redacted] insCame out 12/02/they found more damage left a check for $903,At this time [redacted] stiff have not paid the 50% that she should have paid up front, December 05, vehicle is complete and ready for pickThat's when the excuses startedwas told she had loan morley to her friend, she didn't have the moneyShe stop answering the telephone, then [redacted] Rental was calling me looking for the rental, or had I spoken to her [redacted] said they was going to report the rental stolen, she didn't turn it in [redacted] finally called said she was in the hospital, after that call no responseIt started again trying to contact her with no luck, I did the legal thing, I contacted [redacted] They came out started the paper work the bank was trying to get the vehicle, because of due paymentsOnly after [redacted] got involve, did [redacted] call trying to work out somethingNot one time did she say will bring you some money, or come and pick up her vehicleBy that time it was out of my hands, she was told to cali [redacted] ***She don't understand she owe for repairs, storage and lien feesHer calling and texting after the lien recovery took over, I did honor the price I gave her, she didn't pay there was storage fees, lien feesThe recorded conversation and witness that’s the police officer, who call my shop three to four times then he came to the shop in the police car with her in the police carThe officer stood there and talked with me for minutes, then said she [redacted] is over there in the carThe officer drove the car with [redacted] inside the gate that's when the officer illegal recorded the conversation that's a Scam

** *** a check for $3,Only after I completed the vehicle, ** *** started to give me the run aroundShe's been sick, She loan her money out, She had bills to payI just need you to bring my money and pick up your vehicleShe wanted me to take her to work and pick her up, work out a payment planThe bottom line, she had me to repair her vehicle.Then spent the insurance money and left me holding the vehicleI then put a lien on the car** *** only tried to contact me after *** *** notified her about the lienOnce Lien & Recovery file their paper work, there is a fee for the amount of Lien for repair and storage and their fee.Milton H

I am rejecting this response because:  Mr. H[redacted]on statement is false.  I have my phone records and text messages showing that I contacted Mr. H[redacted]on several times and he would not return my call.  I also have a recorded conversation and the police officer who was a witness at the time I went to the shop to speak to Mr. H[redacted]on about getting my car and he admitted that he did see me calling him and texting him.  Mr. H[redacted]on's response was, yes I saw you call and the text messages, I didn't call you back because you was a headache.  I attempted several time to get my vehicle from Mr. H[redacted]on but every time he would increase the price of what I owed to him.  Mr. H[redacted]on felt that he should have received more money due to me going through the insurance company.  When the insurance company sent me a check I had the option to take my car to get it repaired of my choice.  This does not mean that what they paid me is what he is entitled to.  Mr. H[redacted]on provided me a price and that what he must honor.  I also have the altered document that he forged to obtain the lien on the vehicle as well.  I have documents, recorded conversation and a witness that I can prove that Mr. H[redacted]on's statement is far away from the truth. I was contacting Mr. H[redacted]on prior to [redacted] contacting me about the lien on the car.  Again I have saved text messages and a phone log that will prove it and him admitting on the recording and in front of the police officer that he purposely ignored my calls and text messages, even though he did receive them.  I can send you the recording, a notarized letter from the police officer, and the altered document if I need to.

Review: The owner (Mr. H[redacted]) came to my job and gave me a price of $2,000.00 to repair my body damage on the vehicle and an additional $700.00 to repaint the entire car. This was a text message Mr.H[redacted] sent to me once he got the junk yard to see if he was able to find the parts need to repair the vehicle. I dropped my vehicle off to Mr. H[redacted] for repairs, he called me the two days later to let me know that there was some additional damage once he removed the bumper. I gave Mr. H[redacted] the contact information for my claim and insurance company and told him for now just do the back damage on the vehicle, that I will wait until another time to get the car repainted. The adjustor came out and quoted an additional $900.00 worth of damage. He proceeded to do the repairs, he called me about two weeks later to let me know the car was ready for pick up. I had the $2000.00 he original quoted me and the insurance company was sending the $900.00 directly to him. When he called me he told me I owed $2,700.00, I explained to him that I asked for him not to repaint the entire vehicle. Mr. H[redacted] told me he did not repaint the vehicle, this was my new charges and I asked why is this, Mr. H[redacted] told me the $2,000.00 was before he found out I was going through an insurance company. I told Mr. H[redacted] that [redacted] did an appraisal on my vehicle and cut me a check to go to any body shop to get the work done, that this agreement was not arranged between him and [redacted], that the agreement was between him and I. Mr. H[redacted] explained to me that the appraiser who came out told him that [redacted] cut me a check for about $3,200.00 and plus the additional $900.00, how does it look I only get $2,000.00 and I get to keep the remaining balance. I explained that he will be getting $2,700.00 total, which was $1,800.00 from me and the $900.00 from the insurance company. He said no I had to pay him $2,700.00 to get the car back. I wasn't going to continue to argue with Mr. H[redacted], because we where not getting anywhere and I need my car. I agreed to give him the $700.00 and my plans was to out a legal matter against the business to get my $700.00 back, because the insurance company had already process for him to get the $900.00. I told Mr. H[redacted] right now all I had was the $1,800.00 he told me that I need to come up with the full amount. I asked Mr. H[redacted] to give me about a week to come up with the additional $700.00. I called Mr. H[redacted] a week later and now he has issued me a balance owed $2,900.00 he had added an additional $200.00 for storage. I was really upset with what he was doing at this point so I contact the police to see if he had the right to do this, they told me this was a matter that they could not get involved with I would have to take him to court. I was scheduled to go into surgery within two days and I knew I was going to down for about a month. I text and called Mr. H[redacted] for several weeks from the point the day of my surgery following up to a month later. Mr. H[redacted] would not return any of my calls or text messages. A month to the date my car was completed I recieved a call from [redacted] (lien holder) about what was going on with the car. I told them what happen and that I have unsuccessfully contacted Mr. H[redacted] for 3 weeks with not reply back. [redacted] told me that Mr. H[redacted] said that I owed him a little over $5,100.00 and for repairs that he completed on my vehicle, and Mr. H[redacted] had placed a lien on the vehicle. This was untrue that I only owed him $1,800.00, because I had confirmed with [redacted] that they had sent him the $900.00. They told me I had until 4 days to go get the car or Mr. H[redacted] had the right to sell the car. I contact a **C police officer and asked him to go to the business to go get my car. Officer Carter called Mr. H[redacted] for me, because again he was still not answering my calls or text messages and Officer Carter told Mr. H[redacted] that he needed to speak with him. I went to the business and meet with Mr. H[redacted] and Officer Carter. Mr. H[redacted] admitted that I only owed him $1,800.00 but the lien was being handled by a lien and recovery company. I asked Mr. H[redacted] if the company that is handling the lien say that you can adjust the amount owed to the correct amount of $1,800.00 will he change it. Mr. H[redacted] told me to contact them first and see what they say. I contacted the Lien and Recovery Company the next day they told me that Mr. H[redacted] can call in and adjust the cost to the correct amount. I contacted Mr. H[redacted] by text and told him what the recovery company told me. Mr. H[redacted] text me back and told me to call the Recovery Company back. I did call and they corrected the original lien said that I owed a little over $4,100.00 in repairs and $999.00 for the process of the lien, and now with the corrects Mr. H[redacted] called in it was now $1,800.00 for the repairs, about $1,800.00 for storage fee, and $999.00 for the lien process. I asked the recovery company to send over the paperwork with the correction and the orginial break down of the cost. Once they faxed the paperwork over to me, I noticed the Mr. H[redacted] had taken the print out appraisal estimate from [redacted] and altered the document and covered up [redacted]s logo and placed his company logo over [redacted]. This was the document he used to obtain the lien on my car and sent to [redacted] saying I owed what [redacted] appraised the damage for the vehicle. I called the Lien and Recovery Company back and ask where did they get this reciept of cost breakdown from. They said that Mr. H[redacted] provided it to them I told them that this was an altered document. And I also had a police officer who witness that he confirmed that I only owed him $1,800.00. They told me that they had no knowledge about an altered document and that they only work for Mr. H[redacted] and they only use what he submitted to them. I want to give Mr. H[redacted] the chance to make good on the scam that he ran on me which in turn I lost my car and I had to pay this money back to [redacted] that they gave to Mr. H[redacted]. Mr. H[redacted] not only got the $900.00 but he also got a little over $5,100.00 from [redacted] which I had to pay them.Desired Settlement: I am requesting Mr. H[redacted] to pay me back $3,300.00 which I am owed for monies that he received from [redacted] that he was not entitled to.
