For this particular client, she received her refundShe was fully made aware of the cancellation fee on the contract which states any cancellations made will result in a $cancellation feeShe was given the opportunity to postpone which would result in full refund once her challenge is completed successfullyIt is unfortunate she does not understand the legal document signed by her stating she understood all conditions regarding the challengeI hope this is evidence to show this client is disputing a charge that has been refunded and also has been thoroughly explained as to why the $cancellation fee will apply to her cancelling only days before the start of the challengeI have tried multiple times to help her understand

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below They are still not agreeing to reimbursing any of my moneyI have been offered either to start a new challenge in April or June or apply it towards months of membershipI have repeatedly let them know that due to an injury I am unable to do the workoutI do not know if and when I will get cleared to return to high impact workouts againAt this stage of my injury I just started physical therapy a week and half agoI have no end date for treatment, I will stop when my condition resolves and if it doesn't my only other options are pain relief or surgeryI'm not quite sure what they are not understanding about not being able to do high impact workoutsThere reasoning is keeping the integrity of the program intact, however I feel that the program owners and directors themselves lack of integrityIntegrity is the qualification of being honest and having strong moral principalsHow is refusing to reimburse a client any portion of the $fee they have been charged being honest and having moral standardsThis company is about making money for themselves onlyThey do not care about their clients in the slightestIf they did they would actually listen to them, when someone is telling you they are UNABLE to do the high impact workouts signing up for the next challenge or working out for months isn't an acceptable optionI have attached my MRI report that I just received yesterdayI have also attached the email chain between Tanya Sites and II am still waiting for a letter from my Dr stating that I have been recommended to avoid high impact exercises and can upload it when I receive it Regards, [redacted]

In regard to the deposit and the cancellation, it states on the contract as follows: "You the challenger, may cancel this agreement at any time prior to midnight on the fifth business day after the signed contract date of this agreement, excluding Sundays and holidays.... A cancellation fee of $100 will apply to any cancellations. Any refunds require a 14 day processing period." What this means and where the confusion may be is that cancelling within 5 business days or any other time thereafter will result in a cancellation fee of $100. In order to receive a refund minus the cancellation fee, it must be stated that the challenger wants to cancel within 5 business days of signing the contract. The contract was signed by the client, which indicates the client completely agreed and understood all conditions of the agreement. And extension was offered to postpone the challenge to a later date giving the client the opportunity to receive full refund of the deposit but this offer was rejected.

They are still not agreeing to reimbursing any of my money. I have been offered either to start a new challenge in April or June or apply it towards 4 months of membership. I have repeatedly let them know that due to an injury I am unable to do the workout. I do not know if and when I will get cleared to return to high impact workouts again. How is refusing to reimburse a client any portion of the $500 fee they have been charged being honest and having moral standards. This company is about making money for themselves only. They do not care about their clients in the slightest. If they did they would actually listen to them, when someone is telling you they are UNABLE to do the high impact workouts signing up for the next challenge or working out for 4 months isn't an acceptable option. I have attached my MRI report that I just received yesterday. I have also attached the email chain between Tanya Sites and I. I am still waiting for a letter from my Dr stating that I have been recommended to avoid high impact exercises and can upload it when I receive it.

Unfortunately we are unable to fulfill the request to refund as we must be sure all challengers are held to their end of the agreement. We would be more than happy to discuss any further action in person in addition to retrieving the letters from [redacted]'s doctor indicating she is unable to workout. Our policy to suspend the challenge due to injury holds true. We can place a challenger on hold until the doctor has cleared him/her to participate in the workouts. The information I've collected from the director of this particular location has contradicted what this client is explaining and I find it unfair to be criticized for ensuring all challengers are held to the same standards. I would be more than happy to discuss with [redacted] any concerns she has but unfortunately we cannot settle by simply refunding her challenge deposit since she has received our services and started the program.

For this particular client, she received her refund. She was fully made aware of the cancellation fee on the contract which states any cancellations made will result in a $100 cancellation fee. She was given the opportunity to postpone which would result in full refund once her challenge is...

I hope this is evidence to show this client is disputing a charge that has been refunded and also has been thoroughly explained as to why the $100 cancellation fee will apply to her cancelling only days before the start of the challenge.
