Good afternoon [redacted],
I am responding to the customer's complaint, but please note that this is the first time that I am hearing about this, I never received the email on 8/13/2014. [redacted] signed a contract, hoping to buy a 2003 [redacted] from our dealership. She signed all the paperwork, gave us a deposit of $1350.00, which she was made aware that it was a non refundable deposit (She signed a form stating that the deposit was non refundable, and I can submit a copy of it if needed) . The purchase was pending approval from the bank that was working on [redacted]'s loan. The bank requested References from [redacted], they needed phone numbers and addresses. We spent a week trying to reach [redacted], left numerous voice messages, but never heard from her. At the end of the week, the bank called, and said that they are returning [redacted]'s deal, they no longer wished to finance her vehicle, since they couldn't get any references. At that point, we called [redacted], told her to return the vehicle, or we would have to send a repos truck to get it. We didn't hear from her that day, the repos company could not find her either at the address that she provided us. The next day, [redacted] drove the vehicle to our lot, stormed into the office, yelling that she was very busy all week, and that she did not have time to get us those references, and that she would get to it the following week, IF she has time. We explained to [redacted] that it was too late, the bank already sent the paperwork back, and the sale was canceled. We asked her to hand out the keys, but she refused. Luckily, the vehicle was blocked after she pulled into the lot, so we kept it blocked, and repeatedly asked for the key. That's when [redacted] started yelling at the salesperson and calling him names, and threatened to call the police, which she did, and they told her that it was a civil matter. She left the lot, with our key, we had to tow the vehicle to the [redacted] dealer, to get a new key and get it reprogrammed, which ended up costing us an extra $344.00: $100.00 was for towing, $75.00 for a new key and $169.00 to reprogram it. Should you have any further questions, or need any kind of documentation, please feel free to reach me at ###-###-####. Thank you, Bobby K[redacted]

We tried to help [redacted], but he decided to turn the car in, keep the keys, knowing that he signed paperwork stating that the vehicle was sold to him AS IS, and that his deposit was NONREFUNDABLE.
So at this point, there is nothing that can be done on our end, and we will not be issuing any refunds.

Sincerely,

Bobby K[redacted]
The Car Store

Good morning [redacted],
I will reply to each concern separately. The first one is about the sale price, we did not change the selling price, those were the fees added by the bank in order to purchase [redacted]'s loan, due to his very poor credit score which was a result of [redacted] not...

paying on his previous loans, and being delinquent on others. When [redacted] bought the 2013 [redacted] from us, he was aware that the vehicle was sold AS IS, he was also aware that his deposit was non refundable, it clearly stated that in the paperwork that he signed.
With that said, when [redacted] came back after 3 days, not 2, (we never received any phone calls from him as he stated in his complaint), and informed us of the issues that he was having with the vehicle, I told him that the vehicle is still under manufacturer's warranty up to 100,000 miles. The vehicle had only 32076 miles. He came in the evening, so I told him to leave the vehicle with us, and in good faith, was going to help him out by sending  it to the [redacted] dealer the next day to get it checked out and fixed for him. [redacted] had already made up his mind that he was returning the car, I assumed that he probably was interested in a different car somewhere else, and he already called the bank  and told them that he lost his job. So his loan was rejected by the bank the very next day.
After trying to explain to [redacted] that he didn't have any reason to return his car, made him aware that he won't be getting his money back due to our business policy, he decided to lock the vehicle that he purchased, leaving it  in the middle of the lot, and taking the key with him. After locking up the dealership, and finding the car there and [redacted] gone, I called him and asked him to bring the key back so we can move the car, he refused and said that he would keep the keys until he gets his money back. So we had to call the [redacted] dealer the next day, to come to our lot and get a new key cut and a remote programmed, which ended up costing us an additional $500.00.
Therefore, we are unable to refund [redacted] his money, we are sorry that this deal turned out this way, we don't sell lemons, we stand behind our product, and our great ratings are a proof of that. In fact, [redacted] was referred to us by one of our repeat customers.
Should you have any further questions or concerns, please feel free to contact me at ###-###-####
Sincerely,
Bobby K[redacted]

Review: Purchased a car on August 3rd, provided them with the contract and downpayment. Received the car, title and temporary registration. Drove the car for a week. General Manager called me to tell me that he needed addresses for my references and that my references were not valid. Personally came in to offer the telephone numbers again, but still did not have the addresses. General Manager took the car and refused to let me have it back. He did not offer an explanation on why he was taking the car or returning my money. He yelled at me in front of everyone, was very disrespectful and humiliated me as well.Desired Settlement: Refund of my deposit. I no longer want to do business with this establishment
