The contract was written on 10/21/with a $down payment (not $300.) The Day Right to cancel for down payment refund does not apply to this contract due to the amount of time from originally written and requestNo additional payments were received on this contract and it was cancelled for
Nonpayment on 03/12/ Around Memorial Day this year, *** did speak with this family and offered to help them apply a "credit" in the amount of their down payment to a new contract She set a couple of appointments with them but those were cancelled by the perspective customer. They recently called in and spoke to *** and when the conversation turned "unproductive" *** says she told them that she would not remain on the phone while they spoke to her so rudely and said "good bye" and ended the call

For your reference, details of the offer I reviewed appear below.Neither Memorial Gardens West nor ***s could provide a copy of the contract of sale/transfer that would have clearly shown what was included in the purchase of the plot at Memorial Gardens West I believe this violates Kentucky Law KRS Chapter to 367.974.On 11/2/I provided to Louisville Memorial Gardens West a copy of the Transfer Agreement for the two plots purchased and the Memorial Gardens Charge for Interment showing no charge for a vault when the first of the two plots purchased was opened and closed for the burial of a relativeNeither ***s nor Louisville Memorial Gardens West provided any documentation whick is required by law

“A family member had mentioned to the purchaser that she had purchased a vault previously. We did not have a prior contract that the vault had been purchased prior with Louisville Memorial Gardens West. Family stated they could provide a contract copy of vault purchase made with
***’s Funeral Home but were unable to provide that documentation with us. As a courtesy to the family we reached out to ***’s Funeral Home as they had thought they may have purchased the vault through them. ***’s replied that they did not have a record of a vault sale for the deceased To facilitate a timely burial we assisted the family with their purchase of a vault from Louisville Memorial Gardens West.”

As we are in receipt of information that complainant has sought legal counsel in this matter, we contacted the Revdex.com to confirm that a response to this complaint is not required at this time.

Louisville Memorial Gardens West has no record of selling a vault prior to 11/2/16 for the deceased.  Prior to selling the 11/2/16 vault to [redacted], based on information family shared, our Sales Manager contacted [redacted]’s Funeral Home to ask if [redacted]’s had previously sold a vault to a member of this family as was mentioned by a different family member.  [redacted]’s shared with our Sales Manager that they had no record on file for a 2nd vault.  Family has not provided proof that they purchased a vault prior to 11/2/16 from Louisville Memorial Gardens West for their recently deceased loved one.  It may be that there is some misunderstanding in the family on what was formerly purchased and from which service provider.  Louisville Memorial Gardens West and [redacted]’s Funeral Home are not affiliated with one another but do work closely together when needed to accommodate the needs of those suffering a loss. If the family has additional paperwork that was not found in our records, then we would ask that they provide that to us so that we can reconsider this situation.

We do not accept this response due to the fact we have been told since June or July these things would be done and they are still saying they are scheduled. I think it's shameful they take people's money and create nothing but headaches for families like ours. Tress was supposed to be cut down in the summer and it's still not done and the cleaning isn't done on a regular basis otherwise there wouldn't be cobwebs and dead bugs and gnats all over the place. The place is disgusting and we want action now.

We appreciate your concern with being able to visit your family members entombed in our Alpha Utopia mausoleum.  We are hopeful this response will give you some comfort that your concerns with the Revdex.com are being addressed.  While most of our families find this beautiful building comfortable...

and accommodating, we continue to work to improve our facilities and grounds. Steps already being taken include cleaning and vacuuming every other day, weekly pest control, repair of exhaust fans to improve air movement.  Additional steps scheduled to be started within the next month include removing and replacing the carpeting and increasing our pest control efforts through various options.

As stated before, we are in receipt of communication from complainant's attorney. Further communication via Revdex.com is unwarranted as per a call we placed to Revdex.com. Our attorney will correspond with her attorney.
