perform real estate closings, In performance of closings, we pay special attention to items on thesettlement statement which are iienable as they are covered by the insurance, Other items — not related to thetitle insurance - placed on the settlement statement such as home warranty payments are included as a courtesyand handled base on the best information available to us.In this case, the document we had In file was the sales contract showing a one year warranty. Though Mr. [redacted]states that there was an amendment to the contract changing the warranty to two years, I cannot find a copy ofthat amendment in our file. I presume we did not receive a copy and this Is not unusual. Often parties in a realestate transaction fail to send addendums and amendments to our office prior to closing.The seller, buyer, and their respective real estate agents had personal knowledge tithe transaction and theamendment to the contract, These partIes had a duty to review the figures on the settlement statement to makecertain the terms were correct before they signed the statement. We did our duty by disbursing funds as Itemizedon the settlement statement.When I spoke with Mr. & Mrs. [redacted] recently, I was not rude or ignorant, I simply explained that the homewarranty Is not covered by their title insurance and that any remedy they may have would be from the seller or thereal estate agents.I hope this explanation is helpful, If you need further Information, please contact me.Diane C[redacted]General Manager

Review: I bought a home last year and hired The Closing Specialists to help with my closing. The home we purchased included a one year warranty. Prior to closing the seller was going to reduce the price of the home by $500 for an issue that came up during inspection. Instead of lowering the price the seller and I agreed that they would provide a second year of coverage for the home warranty. The cost of that year was due at the time of closing. The Closing Specialist collected that money and wrote the home warranty people a check and all seemed to be fine. We are into the second year and needed to call the home warranty for an issue that has come up. When we called HSA they informed us that our 2nd year of warranty was never paid. I called The Closing Specialist and they sent me the 2nd year contract and the cancelled check, I called HSA and they said they only received that one payment. They didn't receive a second payment. I called The Closing Specialist and they told me I would have to contact the Seller or the Realtor to get the money for the warranty. I believed that I had hired them to assist at closing to avoid these issues. Instead they have washed their hands of the issue and were generally rude and ignorant to the problem. They are a horrible example of a professional company.Desired Settlement: I want The Closing Specialist to pay HSA for the year of warranty we are do. They were hired to make sure all bases were covered and that no problems like this would occur. They dropped the ball and they need to do the right thing for me their client.
