Complaint: [redacted] I am rejecting this response because:Thanks for your assistance in addressing ID [redacted] .It's apparent that the Porto Cima staff has not negotiated in "good faith" Mr [redacted] never gave us the names such as [redacted] or the *** family of [redacted] which is substantiated by my "open e-mail" However, Mr [redacted] did call me to alert me That [redacted] would be addressing our situation.For the record, we were among the first in FY to purchase property and a Sports Membership We resigned the membership in FY( while in good standing) We wanted to know from Mr [redacted] the number of memberships held/sold by Porto Cima so we could have some idea where were were on a "so called list' of resignations In FY 2016, the membership person told us we were # [redacted] on a list to receive our refundable membership deposit Last month (FY 2017), we were told that we were "about" #** We were never given a current active membership number by Mr [redacted] or anyone!In closing the business' response is not satisfactory and we would like to for you to keep the file open until our complaint is resolved.In the meantime, it is our intention to retain a personal attorneywe will notify you of our finding as we proceed.Again, thanks for all your help in trying to help us resolve our conflict with Porto Cima Sincerely, [redacted] ***

November 22, 2017 Via Electronic Mail Dispute Resolution [email protected] Dear Dispute Resolution Department, This letter acknowledges The Club at Porto Cima, Inc.’s (“The Club”) reciept of your Novemer 17, letter regarding complaint # ***I apologize for the delay. We needed to update contact information for The Club in your data baseThe letter was sent to an old contact.The Club is a Missouri corporation and a wholly owned subsidary of *** *** ***, Inc. It is located at the Lake of the Ozarks. For more informationabout The Club, please see our website at www.portocima.com.I have attached our Membership Agreement and Membership Plan and provides that the membership deposit is refundable. The Membership Agreement (and the Membership Plan) states that until all memberships in a particular category have been sold three new memberships in that category will be issued for everyone resigned Membership re-issued on the basis of first resigned first reissued. There are currently two-hundred and two (202) active memberships, but not all of the sports memberships have been sold.The complainant and was placed on the resignation list and has been moving up the list for a refund of her deposit. Because of the recession and resulting slowdown in real estate activity, the membership sales have been slow. The complainant has been in contact over the years with the membership department at The Club regarding her status on the resignation list, and she has consistently been informed of that status. If the complainant was told last year that she was *** (***) on the resignation list, that was a miscommunication. She was *** (***) on the resignation list in 2016, and remains *** (***) on the resignation list as of the date of this letter. Complainant has not been jumped by any other member on the resignation listThe Club has been very careful to follow the refund plan set forth in Membership Agreement and Membership Plan. Complainant is requesting information such as the names of the members and resigned members of The Club. We have refused to provide this information because of The Club’s privacy policy (on the website mentioned above). It is our understanding that such a policy and adherence to the policy is required by federal statute. Also as a privately owned private club, The Cub has an internal policy of not releasing its list of memberships or resigned memberships. Disclosure of additional information is not required by the Membership Agreement or Membership Plan.Regarding my alleged refusal to give the name and address of the management company, *** *** ***(“***”), that statement is false. I told complainant that I worked for *** , which is the third-party golf management company and not the owner of The ClubThe following is the excerpted email dialogue of our correspondence, which is attached. “Me:*** ***,All correspondence should come to me directly and I will forward to the appropriate departments at our corporate office for review.*** ***:*** ***,I am not use to a mediator reading my personal mail addressed to another person, therefore just send this "open e-mail" to the appropriate department at your corporate office.I will await a reply from the corporate office.Me:*** ***,I will be reaching out to *** ***, VP of Finance for our parent company. She will address your situation and move forward from there.”My intent in forwarding the correspondence to the appropriate *** department was to ensure the right person obtained the complainant’s letter/request. *** has a large corporate office and over two-hundred (200) properties. *** *** works for *** *** ***.Soon after this conversation we received the complainant’s Revdex.com complaint.
