This is the response to Mr. [redacted] complaint in regards to the property address on his purchase of a commercial property in [redacted], I*, on June 8, 2017....

Mr. [redacted] did contact [redacted] the closing agent, the day after closing in regards to the information I & M gave him in regards to the property address. [redacted] did tell Mr. [redacted] that as a title insurer, we certify to the legal description, not the property address. [redacted] did inform Mr. [redacted] that the records in Huntington County indicated the property address was [redacted] in [redacted], **, the same we used on our paperwork. I am including the Listing Agreement, the Purchase Agreement in which Mr. [redacted] signed, the tax record from Huntington County, our title commitment and recorded deed to Mr. [redacted], all showing a property address of [redacted] Street in [redacted], I*.
[redacted] came to see me in regards to Mr. [redacted] request that Metropolitan Title change the address on his paperwork. I told [redacted] that we had no information that would indicate that the address was different than the one the county had assigned to that tax parcel. I told [redacted] to speak with Mr. [redacted] and tell him if we had sufficient evidence from the county that the address was other than what they had assigned to the tax record, we would certainly change the address on his title policy and that his legal was correct and that the correct legal description was used to transfer the deed to him.
A few days later I received a call from one of the officers of General Title Insurance Company, the insurance carrier we wrote the title policy on for Mr. [redacted], He called the insurer to state that Metropolitan Title had used an incorrect address in his paperwork and wanted General Title to change for him. General Title told Mr. [redacted] that there was nothing of record that indicated that the address was anything other than [redacted] in [redacted], I* but if the county made a certified change in the address, the title policy would be updated to include the corrected address.
On June 19th, Mr. [redacted] sent [redacted] an email indicating he had received a letter from the Huntington County Department of Community Development indicating the correct address was [redacted]. [redacted] Street. I have enclosed a copy of this correspondence from Mr. [redacted]. I sent Mr. [redacted] an email in response indicating we checked with the county and found a revision of the tax bill with a new address of [redacted]. [redacted]. I sent him a copy of the original tax bill with the address of [redacted], the new tax bill with the address of [redacted] and a revised title policy.
Metropolitan Title has made every effort to communicate as well as show good faith to Mr. [redacted] in regards to the discrepancy of the property address. Throughout the entire transaction and correspondence after the closing, the legal description has remained the same as the one Metropolitan Title insured.

My complaint stands. Ms. [redacted] and her company will answer to General Title Ins Co to change the address but will do nothing to fix the error on the Warranty Deed they sent to Huntington County to be recorded. When I go to sell this property in 3 to 4 years some entitya bank, the buyer, the government or a professional title company will balk at this error and want ME to "clean it up". Even though Metroplitan may think having an error on a legal document is "no big deal" I think it is and a reasonable person would want it changed in the beginning of the process. Ms. [redacted] will be hearing from me again if this does happen when I go to sell this property.

Re: Consumer Response

In response to the consumer's concerns regarding the postal address on the deed. For the purposes of land transfers, the County uses legal descriptions to describe which property is being sold. We also use these legal descriptions as the basis to describe the boundaries of the properties on which we are issuing a title insurance policy. At the time of the transaction, the County Tax records showed the postal address as [redacted]. [redacted] Street in [redacted], I*. In addition, the last deed of record also showed this property as [redacted]. [redacted] Street in [redacted], I*. The postal address of the property is not the information in which the transfer of ownership nor our title insurance policy is based upon. The County's only concern in describing the property resides in a correct legal description, which is what the current recorded deed reflects. As a courtesy, we have changed the postal address on the consumer's title insurance policy and we will be re-recording a deed showing [redacted]. [redacted] Street as the current postal address. We stand by our initial statement that the business that was conducted was accurate to the standards required by the County for recording purposes and our underwriting guidelines to insure the consumer.

They are missing the point of my complaint. They did *OTHI*G to resolve the issue for me. That is the point of the complaint. A reputable and professional business would not fall back on the "that's the info we had at the time" or "what we did complied with county requirements". Said business would FIX the paperwork properly. They are sloppy and only trying to save a few dollars for themselves. Greed does not make for a good business model. [redacted]
