Unfortunately this business was recommended to us by friends and the owner still made off with our deposit and never did any work. Said he had used the money to purchase materials for our project but never produced materials when we finally had to terminate his services. The excuses were endless. ***.
My wife and I contracted 'The Country Handyman', also know as 'Zorra Handyman? owned by a *** to do some renovation work on our kitchen. As requested we provided him a deposit to purchase among other items for the renovation, windows that he informed us were on sale but he had to act fast to secure the sale price. The agreement was signed in April with work to begin early May.
Six days after we provided our deposit I notified *** I had lost my job and I was cancelling the renovation. Under the CPA we are legally allowed to cancel a contract within 10 day for no reason.
We were told that windows for the project had been ordered and he would try and cancel. I followed up 5 days later and was informed the windows could not be canceled. We agreed to take possession of the windows and he would install them in June with the balance of the deposit refunded.
Multiple attempts were made to have the windows installed but *** never met an appointment.
In mid August we had another appointment scheduled to install the windows though when *** arrived he claimed he could not install the windows as he had hurt his shoulder over the weekend at a charity event.
He was to give us an update later that day after visiting his doctor. Nothing ever materialized and no update was provided.
Finally mid September when I contacted him for an update and a new installation date I was told he could not provide a firm date. At that point I resigned his 'services? and demanded our money back. He assured us he would comply and we would have our money back 'soon'.
With all the missed appointments and stories we began to doubt the windows even existed. Following up with the window manufacturer listed on the original quotation they claimed they had never heard from the business owner and had no record of windows being ordered.
Despite a multitude of promises from the business owner to install said windows and/or refund our balance, we have received no services and no return of our money.
Refund To resolve this issue we require a complete and full refund of our deposit via Certified Cheque. If *** has the windows and can present us with an original and verifiable manufactures invoice which includes a date of order no later than April 24th 2017, (3 days after we were told the windows could not be cancelled and were on order) as well as the terms of order showing cancelation was not possible, and verify the terms of the 'sale price', we will accept the windows and the manufactures invoiced cost may be deducted from the deposit. This is provided the windows are returned to us in as new condition and are acceptable for installation by a certified *** installer by the date listed below. If the invoice is not available or the date of the order is later than April 24 2017 the windows will not be considered as part of this settlement as it will indicate no effort was made to cancel the order.
