Review: Took collectable majic cards to sell to The Days of Knights store. Assuming it was owner [redacted], said he was taking the cards to the basement to assess them and calculate a price. He came back an gave me an offer or 900.00 for mulitple cards and wrote me a check. I returned again with more cards and the same process was done and I was given a second check for 425.00. Total of $1,325.00. After going home I realized he did not give me a receipt or itemized bill of sale of how he came up with that figure. He said that it was a 60 / 40 split on the value of the cards. I got 60% he got 40%. I calculate the total sale should have be $1925.00 and that he made an error of $600.00. My mother and I went to the store on January 6, 2014 and asked for the owner. The sales person at the counter (a younger man) said he was in the mens room and would be right out and would let him know we where there. Then a woman came out (assuming it was his wife) and said he was not there. We said we were just told he was there and she said he was but had to leave for a doctors appointment. We told her the story of the miscalulation and asked if he could please recalculate the figures and asked for a itemized bill of sale of receipt and she said no, but she would ask him to do it when he returned. I went back later in the day and spoke to him and he said not sure if he could do it because it would take about an hour of his time and then offered to give me half the amount which would be $300.00. Then the woman (assuming is the wife) said NO do not do it and slammed the register drawer. She was irate. He has already sold one of the cards on ebay for $725.00. All I want is a fair deal, an itemized receipt (bill of sale) with the correct pricing (value of card) an the amount he was supposed to pay me for each card. My mom told her everyone makes mistakes we feel there was an error in his addiition and given the wrong amount. It is not professional business practice to take cards to a back room, no receipt, no itemized detail, no proof of purchase, no pricing, no bill of sale and (the was woman was totally rude). Could this be a civil case in court?Desired Settlement: To get the money he owes me $600.00 and an itemized receipt. Proof he did or did not make an error when adding up the total I was supposed to receive.

Thank you for this opportunity to respond to the groundless complaint

made by [redacted]. This complaint is so full of inaccuracies

that it is difficult to know where to start. On January 3rd,

[redacted] came into The Days of Knights just as I was about to go to

lunch. He had called earlier about coming in and selling us a collection

of Magic: The Gathering cards. I decided to stay and evaluate his

cards rather than going to lunch.

I told the young man as soon asI saw the type of cards that he had that it would take me a good deal

of time to evaluate his cards. I mentioned that I would give

him 40% to 60% of the amount that I evaluated the card. I also told him

that many of his better cards were in less than good condition. I choose

45 cards from collection. Before spending the time to evaluate the

cards, I specifically asked him if it was his intention to sell the

cards. He replied "yes" because he needed the money so his mother could

pay rent. He added that he needed at least $700.00 so I told him that

the cards I chose would net him more than that amount.

I took the cards into my back office (at no time did I take them into the store

basement!) so I could sit at a computer terminal without disruption

from the normal business of the store. I spent nearly two hours

evaluating those 45 cards at a number of Internet sites that buy and

sell Magic cards. As an amateur evaluator, [redacted] fails to

understand that the “value” of Magic cards fluctuates widely

depending which sites you look at. Evaluating MTG cards is more of an

art than a science. Also, expensive cards like his Alpha Ancestral

Recall, are very dependent on condition.

My initial evaluation of the 45 cards was $850.00. [redacted] was a bit dismayed by that

amount. He said at the time that he thought the Ancestral Recall alone

would be worth that

much. So I pulled out that card and showed him

its deplorable condition (it was in “Poor/Heavily Played” condition). I

had evaluated it as being worth $500-$600. [redacted] was not

happy with my offer and asked me to make the total amount $900.00 for

all 45 cards. Since I was uncertain about the ultimate sale price to

expect for the Ancestral Recall, I agreed to the $900.00 amount

that he proposed. We both agreed to that amount and I wrote him

a check to cover the sale.

[redacted] then filled out and

signed a receipt form that specially stated that he had acquired the

cards by legal means and that The Days of Knights was purchasing 45 MTG

cards for the amount of $900.00. It also stated that he was

relinquishing ownership of said cards. As the buyer of the cards, it is

not my responsibility to itemize or breakdown the assessment of each

card. My wife provided a list of the 45 cards to him as a courtesy.

[redacted] returned the following day with his father and brought in

additional Magic cards for sale. I purchased these for $425.00. At

that time, he made no mention of his complaint

about not receiving a fair amount on the previous day. He again filled out the receipt form

and accepted a check for the amount. As a result of these two completed

sales, I went ahead

and put about six of the cards purchased up for sale on eBay. Only two of those cards have sold.

[redacted] and his mother returned the following Monday and spoke with my

wife, Mica, and my employee, Joe Brumfield. At the time [redacted]

was very accusatory and implied that I had made a mistake in my

evaluation and owed him over $600. My wife was very upset by his

attitude and demeanor. Although I was not there and can't give an eye

witness account, I can assure you based on a conversation with my wife

and Joe that while she may have exhibited some frustration, Mica was not

rude to him. At his mother’s urging, my wife said she would talk with

me about the issue when I returned from a doctor’s appointment.

Unfortunately, [redacted] returned that afternoon before I had the opportunity to

thoroughly review the situation. He was aggressive and abusive during

this conversation, causing some customers of my store to mention that

they were uncomfortable about his loud, argumentative tone. In fact, he

yelled at me and called me a “shyster” and then told customers in the

store not to buy anything from us because “they are shysters

here" and "Don' t buy stuff here because he cheats his customers!" He

also claimed that he recorded portions of our conversation without

informing me or getting my permission, and could prove that I owed him

more money. I'd say his actions qualify as being very rude and

slanderous. During this conversation I never offered him an additional

$300.00, nor did my wife ever yell "No" or slam a drawer closed.

I will attach both of the receipts that [redacted] signed to show why I

believe that both deals were completed fairly, and I do not owe him any

additional money. In addition to this, I

have reviewed my

initial assessment of the cards and my opinion has not changed about

their worth for resale. Many of these cards will not sell easily and it

may take me years to recoup

my investment, much less make a profit.

Although

I believe that his complaint is spurious, it is not in my best interest

to have someone in the community bad-mouthing my store. So I would like

to find an amicable solution. However, I have great reservations about

discussing it with [redacted] because of his unacceptable behavior in

my store. I had hoped to invite his parents in for a sit down and

have a civil and

intelligent conversation to discuss the situation.

I would still be willing to do that, and hopefully resolve the

disagreement to everyone’s satisfaction.
