In response to Ms ***'s complaint, ID #*** I would like to correct a number of erroneous assertions that she made.First, she states she was under the impression that we were pulling a permit, when she specifically stated that she did not want a permit and didn't want to pay the fees
involved. We were simply following her instructions. Concerning the building according to Colorado Codes we did what we could but she would not allow us to come on the premises to add hand rails, even at no cost to her, or any otheritems we identified. She never suggested, in any way, that we should go to arbitration and at this point it is too late due to her inaction concerning any compromise we offered, including a $reductionin what she owes us under the contract. We offered to pull a permit and no response was made to yet another offer on our part to resolve the issues she asserted. In summary, we have tried to work out some sort of compromise but Ms*** has been unresponsive to our offers and chooses only to complain She is vindictive and tries only to muddy our good name of years and spotless record We are owed $2,265, which, if paid, will resolve all issues Meanwhile, our mechanics lien will remain in place against her property

We have offered several compromises with Ms***, since she would not allow us on her property With every offer, including a reduction of the amount owed by $500, she has never responded She has never given us the courtesy of even contacting us She prefers to complain to third parties, including the Revdex.com. Since, she had elected to remain silent, our only recourse was to file a mechanics lien, which will remain in effect untilsuch time as we receive payment in fullIf she is willing to contact us directly, we may be able to find some common ground

I am rejecting this response because:I had been in contact with the Deck Company many times between April 8, 2016 and May 23, 2016 which at that time I suggested taking this to mediation/arbitration as per the contract they already were not honoring. Any offers form the Deck Company asked for more money for the work they should have done per contract to bring the deck up to code. They insisted that the deck was up to code in some correspondance but then in other correspondance offered to bring it to code for an extra fee. I do not trust this company and was told by the city of Aurora not to let them back on my property without a permit (It's illegal.)and not to pay them the balance until the work was done properly. On May 23, 2016 I received a letter from the Deck Company's lawyer stating they were putting a lien on the house and I was not to contact the Deck Company; all contact must be made through the lawyer. So I hired a lawyer who also counseled me not to pay for this shoddy work. I have had the deck inspected by several professionals who said it was not to code and to avoid any company working without a permit.I had given the Deck Company many chances to rectify this situation but had only recieved conflicting information about the state of the deck, requests for more money and a letter from a 3rd party lawyer asking me not to contact them anymore.Sincerely,

In 2015 I had a beautiful custom home built by a very reputable builder who contracted The DECK Company for the deck. My deck is beautiful and well built. [redacted], the owner of TDC, uses a photo I took of my deck on their website to promote more sales for TDC. He has used my photo without my knowledge or consent to promote his business. I discovered his usage today.

At the HBA Home show in 2016 I spoke with a representative of TDC regarding moving my steps on my deck so I would no longer have a full flight. If the steps were moved to another end, I'd have half a flight of stairs with which to contend. Having MS & a spinal cord injury this would be very beneficial for me. The rep assured me he'd get back with me soon.

Over the next couple of months I called the rep a few times requesting somebody come give me an estimate to no avail. I tried being VERY nice and posting compliments on their facebook page in hopes of getting some response for an estimate. Nice & polite did not work.

I then posted the truth. My posting was removed. After SIX MONTHS I finally got a response from the owner, [redacted]. He had a list of excuses why I had not had anybody come to my home for an estimate. One excuse he gave me was the termination of an employee (he gave the name) and the reason for the termination. It is ILLEGAL to share this information and VERY unprofessional!

[redacted] gave me an estimate. While he was doing his measuring and calculating he was also telling me how successful he is. He told me he makes over a million dollars a year and really doesn't need to do jobs like mine. He's so busy opening more companies and so wealthy he told me. He further explained that he really didn't have the time to mess with managing people and little jobs. I suggested he use some of his money to get people who would. He was the most unprofessional AND arrogant alleged business person I've ever encountered.

He gave me an estimate and I asked WHEN the job could get done as I've already waited over 6 months for the estimate. He assured me they could get to it in a couple of weeks. We shook hands and agreed to the job. That was SIX MONTHS AGO.

The job I need done is very simple, a monkey with a strong back could do it blindfolded. Since I'm moving existing steps and rearranging existing rails, materials will be a minimum. This is 95% labor - a managing people situation which [redacted] doesn't like to do and apparently doesn't have enough interest in his own company to invest some of his "millions" into investing into his own company.

Since the owner of The DECK Company refuses to invest in his company with a few bucks of his own, I see no valid reason for anybody else to throw money their direction.

I've since learned that [redacted] has personal issues which obviously have run over into his business giving him such a horrible attitude. I'd recommend he step back and get his life together, get OUT of business - let people run a business who CARE about running a business, not waste other people's time while trying to get over their inferiority complex.

In the meantime I'll get a strong, blindfolded monkey to move my steps. He'll have much more integrity than Mr. [redacted]

I am rejecting this response because:The deck that the The Deck Company built for me was not up to code as specified it would be in our contract.I had attempted many times to work this out with The Deck Company through phone calls and emails.I asked them many times to correct the issues with the deck and bring it up to code as per the contract I had with them. The Deck Company kept telling me the deck was to code and that I would have to pay for any further work, calling it a change order. On Friday, May 19, 2016 I sent an email, suggested it was time to go to mediation. On Monday May 23, 2016, I received an email from their attorney telling me they were going to put a lien on my house.
Sincerely,
[redacted]
