Failure to deliver product when given a generous amount of time, poor attitude, construction deficiencies, poor quality of service & product.The contractor entered into contract with the owner for a complete building to be built on the owner's property within a six (6) week time period (contractor indicated he only needed three weeks), in which surpassed the nine (9) week time period prior to the owner terminating the contract due to numerous fallacies on the contractor's part. In addition, the contractor was unwilling to respond to phone calls, emails, and failed to report to the jobsite when expected without notice or any communication. Due to these fallacies & those outlined below, the contractor breached the contract & services were no longer allowed:Inability to complete the project in the specified time periodUnwillingness to communicate a completion schedule when requested numerous timesUnwillingness to communicate with the owner via phone call, email, etc.Construction deficiencies (quality of work) that have not been remedied in reasonable time (including anchoring of building, substandard slab & foundation, etc.).Numerous unwarranted stop work threats Payment schedule was set as 33% at start, 33% after slab completion (which was paid despite poor slab quality) and balance due at completion. Prior to completion (framing was complete, building was wrapped with plastic, roof was 75% complete), the contractor requested an additional amount due to family health care costs and duration of project. The owner generously paid ahead of the contracted amount (due to compassion for the contractor's family health issues) & two days later, the contractor threatened a stop work & then vacated the jobsite with building not complete. As the owner, I expected a much higher level of service from this contractor, and I am quite disappointed.Desired SettlementI am seeking partial refund on the project in the amount of $4200.00 which has been outlined in an email to the contractor.Business Response mr.[redacted] has fausley filed a claim 20 days to build a garage is not a generous amount of time , less sundays and rain days. the permit issue date was 13 oct. the same day my had a stroke and was hosp. at duke hospital, One week later she had a second stroke.Many would have taken these two weeks for family issues.We did no.we continued with construction.His allegation of too much time not true. His demands too rebuild the front was contrary the the contract and blueprints.His demand too rebuild the rear wall was contrary to the contract and blueprints. Two days of delays to make these changes,on him.The demand too reframe the front wall a third time was contrary to the contract and blue prints. He and I reviewed production to that point each and every day he was satisfied with the work and any issues were discussed and resolved before we cont. We had made an agreement on financial issues that he agreed to we continued working he failed to follow through with the financial agreement after another week of delays on his part and stopped the jod. That was the week of thanksgiving. At that point we were 5 Days from completing th garage. his actions and not being truthfull caused all the delays on his own garage doesn't make any sense. Making an attempt to collect $4200 when the garage is 80% complete will never happenConsumer Response The company's response is inaccurate. Review of the building with the contractor on-site was made once, maybe twice a week, as the contractor was off-site by 3pm daily, after arriving between 10-1030am. During review, items that did not comply with the original documents were flagged & many were not addressed by the contractor, example being a poorly installed slab (variations of 2-3" in some locations in a single vehicle garage). I requested a window on the back wall, which was the only request above original documents & took 1/2 day to install and was flagged during framing (minor rework). Other items mentioned in the rebuttal were a part of the original documents. Several times, the contractor indicated he could finish in 5 days, but the work was never finished & the contractor eventually stopped communication (email, phone calls...) He mentioned a financial agreement, but there was never an agreement outside of the original contract & I clearly described this in my original outline. I maintained a daily log of activities, including emails & the contractor's rebuttal is not valid.
