In response to the complaint, the customer had indeed contacted and booked the reservation directly with the MerchantCustomer was guaranteed the advertised Groupon rate that was on the Groupon Daily SpecialThe Customer guaranteed by prepaying with her credit cardCustomer was advised at
time of reservation that then advertised Groupon Special was $The Merchant does not promised to match any future reduced Groupon rates The Merchant charged the customer the discount with the understanding that the day of service, tax and tip with be additional keeping in mind the full value of the service was $350.This is clearly stated in all our Groupon coupons -"Remember-there is no discount on great servicesGroupon customers tip on the full amount of the pre-discounted service and tip generously! That is why we are the coolest customers out there." Customer openly admits she had a $bill and doesn't disclose what she basically did was decide before coming in she was not tipping more than $and admits she was not going to pay taxYet she was in a state that makes tax MANDATORY on all servicesSo unless the Customer is "tax exempt" and presents her tax exempt certificate, she owes tax The advertised massage was Comfort and Joy minute Couples Massage with Hot StonesIt was not a Hot Stone Massage which is normally minutes longThis Groupon was a promotion to advertise adding on a ampler of hot stones to the Signature Treatment -Comfort and Joy Couples Minute MassageThe oil used with this treatment is a locally made organic blended infusion of locally crafted plants. The Customer openly admits in her Complaint that she gave $to the Front DeskWhat she has omitted is that she stated to the Front Desk-that was all she brought-$20 with her and claimed she did not have her credit card on herThat is when the Front Desk asked the Customer if she wanted to use the Credit Card that we had on fileThis is customary standard practice by hotels and spas-a customer's credit card is maintained on file for incidentals, upgrades or other charges incurred during their stayThe Customer glazed over the question and just left the $on the counter -giving no indication that it was the "tip" and she left with no conversationWe see this frequently after a great massage, that the Customer is unable to really make any additional verbal decisions thus leading us to ask-are you okay to drive? Therefore, after the Customer left and did not return to take care of MANDATORY STATE TAX ACCORDING TO THE NEW MEXICO LAWS-"New Mexico does not have a state sales taxHowever, the state imposes a gross receipts tax (GRT) on many business transactionsThis resembles a sales tax, but unlike most states' sales taxes it applies to services, as well as tangible goodsNormally, the provider or seller passes the tax on to the purchaser, but legal incidence and burden apply to the business, as an excise tax.' The front desk called the Customer and left a message for her to please call us so we could close out her billShe did not return the call resulting in her card being charged the tax and tip as disclosed in the Release and Waiver that she and her husband had signed when checking inTHE RELEASE AND WAIVER states in Item #8-that the "Patron agrees to pay for all services that were reserved, including tax and tip.What started out as a playful interaction with visitors, turned lethal when the Customer lashed out via YELP-rantingWe are hands on business that answers our phones, booking paper reservations -not on computer or via the Internet, We ENJOY direct contact and landline phones to reach out to our customers and resolve issues that may present themselvesThe Customer did not return calls or reach out to us to discuss the charges yet lists on the Complaint under the heading Desired Settlement-Explanation of ChargesI personally know when I have filed a Dispute with my credit card company, one of the questions asks if I have contacted the Merchant before filing the Dispute.Merchant is available to fax or mail in additional documentation to support its response.
