landscape was not approved, vendor installed while customer was out of the country for 2 weeks, vendor denied customers requests resulting in damage
On or about February 20, 2018 I hired this landscaper from Concord area in NC. My home is an hour from concord, it is a private gated estate with horses and many acres, no nearby neighbors, I was treated unfairly by this landscaper from the start. I wanted mostly to update and improve my irrigation system, but after discovering the front 2 landscape beds that border my foundation had a drainage problem that may compromise my homes foundation, I was faced with the decision to tear out my beloved 10 year old landscape. The landscaper insisted from the start that I had to remove it all when I wanted to save my favorite trees, I regret every moment of meeting this man, he obviously believes he is upstanding and is threatening to sue me which is incredibly audacious considering I am the one left with the damages and the inescapable view everyday of dead plants, trees I don't like and 205 roses that will be dead in winter, the pushy, non-flexible attitude that began this relationship was bound to end terribly bad. I say I was treated unfairly because he actually drew a design on paper, wrote a list of botanical names with symbols to match his drawings and I was not ok with it, I didn't want to sign on and he insisted he had already ordered these plants and they could not be returned. The contract was not signed and he continued to work on irrigation. One might think you would just ask him to leave but it wasn't like that, he actually said he ordered the evergreens I wanted and they would arrive soon. On May 30, I went to Italy for 2 weeks and while I was away he installed these plants from his list, when I returned, I had new lighting and I saw it in the night upon arriving late, I knew about the trees I didn't like but I had not paid him yet and I figured because of many factors, I could get him to fix it, I sent him a quick text on the morning after my arrival, saying, this and that, I like, this and that I don't like but overall A+ for specific this I said before I realized what he had done and NOW the irrigation was not working, my old sod which was beautiful was dying and while I am begging for him to come, he said , 'get a water hose' he might be able to come next week, obviously a property this big needs more than a water hose, he ruined the balance of my irrigation system, he has completely dismissed how upsetting this is for me, I cannot escape it every day, this is my home, I am a lady farmer with many animals and plants and I especially love my lawn and pastures, this man does not care, he never once after installation has returned and checked his work, he used equipment to do the work, he took soil from my land for his own business use, he relied heavily on my employees to do work for him, I am devastated. I was out of town, he never once informed me he would be here while I was in Italy. In response to my anger, I wrote a review on his *** page to tell my story, he took immediate offense to this and has called a lawyer, calling it libel, I have not yet retained my lawyer but it looks like this is probably going to be inevitable, I feel he should be happy he got paid $42,500, even after I had agreed to allow him to take the 23 trees I hate and didn't ask for, I'm left with the task of redo it all, I wont allow him here after I found out when I wasn't home he used all my farm equip and employees to do work and the trees were never what I wanted, I told him what trees I wanted and I have all proof of our correspondences in texts, apparently he thinks because I told my true story on , I have ruined his reputation, I gave him a bad review on his page and photos of what he did here to my beautiful home, it is incredibly bad, no care, things planted in rows, colors that don't compliment, my rocks that were pulled out were not replaced, the lighting looks great at night but in the day you realize what an amateurish job was done and now he's trying to collect more than $42,500,his conduct was unfair.
I want him to go away and not ever bother me again. I overpaid him and he will make me prove it in court. I live a peaceful life and I let him off easy by paying him, I feel his conduct was immoral, unethical, oppressive and unscrupulous, he has upset my peaceful home and I must pay again to restore it. I am left with unavoidable reminder of his unfairness.
On July 30th, 2018, The EarthScape Company received a letter from the Revdex.com stating that a complaint had been filed by Mrs.. The EarthScape Company has been in business since 2002 and has an excellent work ethic and history which is obvious thru the Revdex.com as they have the company rated as an A+ (the highest given by the Revdex.com).
The EarthScape Company provided substantial amount of landscaping improvements for Mr. and Mrs. at their personal residence during the first and second quarter of 2018, proceeding at all times under parameters set by Mrs.. On multiple occasions throughout the project, we were subjected to insulting outburst and inconsistent statements by Mrs. however at the conclusion Mrs. wrote a statement that was complimentary of the plants and other landscaping installed by The EarthScape Company as recently as June 12th, 2018, stating "boxwoods look great....lighting is awesome.....overall A+."
Numerous written documents including a signed agreement have been turned over to the company attorney and is pending further legal action. We feel confident that once all the evidence is presented that there will be a favorable outcome for us. However, due to the recommendation of the company attorney because this case is pending further litigation, no further statements will be made until after the case is closed or unless statement is made by our attorney, *** at *** law firm in Concord.
All of us at The EarthScape Company have strived to give 100% customer satisfaction and did not wish to involve attorneys, however Mrs. has not been cooperative, or payed her bill in full since the work was completed and has forced us to pursue our legal options.

MY LANDSCAPE WAS FAR FROM EXTENSIVE, IT WAS TO SOLVE A DRAINAGE PROBLEM IN 3 AVERAGE SIZE BEDS IN FRONT OF MY HOME, I WILL SUBMIT PHOTOS OF AN EARTHSCAPE COMPANY PREVIOUS CUSTOMER IT IS AN "extensive" LANDSCAPE JOB AND SHOW IN PHOTOS OF WHAT THEY PAID AND HOW I WAS OVER-CHARGED AND INVADED WITH LANDSCAPE I DID NOT ORDER, ALL WHILE I WAS AWAY FROM HOME FOR 2 WEEKS, I WAS NEVER ALLOWED TO 'set parameters' AS THIS MAN FORCED HIS DESIGN AND HIS PLANTS ON ME BY TRESSPASSING ON MY PROPERTY WHILE I WAS IN ITALY FOR 2 WEEKS, HE KNOWS MY PROPERTY SUPERVISOR AND USED HIM TO GAIN ACCESS TO MY MACHINERY AND EVEN USE HIS MEN TO HELP HIM, HE RUINED MY LANDSCAPE WHILE I WAS NOT HERE.

POPE DOES TO EVERYONE I KNOW, BECAUSE HE IS UNETHICAL, RUDE, PUSHY, SELF-RIGHTOUS AND HE WOULD NOT TAKE NO FOR AN ANSWER, HE STOLE TOPSOIL FROM ME, HE TRESSPASSED ON MY PROPERTY AND HAS BEEN UNFAIR AND INCONSISTENT SAYING AT TIMES IN TEXTS THAT HE HAD ORDERED SOME OF WHAT I ASKED FOR AND EVEN AFTER HE PRESENTED DRAWINGS I REJECTED, HE CLAIMED PYROCANTHUS AND JUNIPERS WERE ON THEIR WAY, HE PASSED BY MY HOUSE 2 WEEKS AFTER OF INSTALLATION, DIDNT CHECK ANYTHING, DID NOT STOP, AND EXTORTED A $47,000 FROM MY HUSBAND BY SURPRISING HIM AT WORK AND WHILE HE WAS IN A MEETING, check and inconsistent statements by Mrs.

HE CONTINUES TO USE MY STATEMENTS OUT OF CONTEXT, I FIRST SAW MY HOME AT NIGHT AFTER 10 HOUR FLIGHT HOME FROM ITALY IT WAS WHILE DRIVING UP THE DRIVE AND IT WAS LIT UP AND BEAUTIFUL, LATER I STAYED IN ALLDAY BUT THEN I SAW WHAT I HATED SO TO BEGIN THE TASK OF DEALING WITH THE THINGS I MUST CHANGE, I COMPLIMENTED HIM ON WHAT I LIKED IN A TEXT, WHAT HE'S FAILING TO MENTION IS ALL THE OTHER I SAID, YES CALL IT AN OUTBURST, A RANT AND PRETTY UNPLEASANT AFTER I SAW THE MESS IN THE DAYLIGHT, IT SEEMS IN HIS NATURE TO TAKE THE ONLY POSITIVE THING I SAID IN AN ATTEMPT TO SOLVE A VERY UPSETTING PROBLEM AND USE IT AGAINST ME WHEN I HAD NO CONTRACT AND I HAD THIS SITUATION FORCED ON MY WHILE I WAS GONE, I KNEW SINCE WE HAD NO CONTRACT PRICE, HE EVEN TEXTED WHEN I ASKED THE PRICE, 'i dont know, I must figure it up' SO THEN I KNEW I ONLY THEN NEEDED TO ARRIVE AT A PRICE AND THEN WE COULD WORK TOWARD SOLVING WHAT I DID NOT LIKE, PLEASE UNDERSTAND I HAD NOT SEEN MY LANDSCAPE IN THE DAYLIGHT WHEN I COMPLIMENTED MR. POPE, IT IS BEAUTIFUL LIT UP AT NIGHT AS I WILL SHOW Revdex.com IN PHOTOS, THIS DOES NOT SOLVE THE UGLY PART OF WHAT HE DID TO RUIN MY IRRIGATION BALANCE AND MY DRAINAGE DITCH, I MUST CHANGE AND THE FACT THAT HE NEVR FOLLOWED UP ON HIS WORK IN THE DRIEST 2 WEEKS WHICH CAUSED MY SOD TO DIE BECAUSE WE HAD A POWER OUTAGE WHILE I WAS GONE, BUT HE NEVER FOLLOWED UP TO SEE THE IRRIGATION WAS OFF, I DONT KNOW THESE THINGS, IT COMES ON WHILE I AM SLEEPING. ALL THE UGLY PLANTS HE PLANTED WERE DYING AS WELL. DOES NOT MATTER TO ME THAT THEY DIED, I DIDNT ORDER THEM AND THEY ARE ALL TO BE REMOVED WHEN WEATHER GETS COOLER I HAVE A PROFESSIONAL SCHEDULED TO FIX IT ALL IN SEPTEMBER . THOUGH MY DRIVEWAY DRAINAGE DITCH HAS HAD TO BE COMPLETELY REDONE WE REMOVED 87 ROSES I DIDNT ORDER AND 78 BUTTERFLY BUSHES PLANTED IN THE ACTUAL DRAIN PART OF THE DITCH, JUST CRAZY...ON JULY 27 WHEN I DID PAY MR. POPE $42,500, I WAS NOT HAPPY, BUT I DID OFFER HIM THE CREPE MYRTLE BACK BECAUSE I HATE FOR TREES TO JUST BE KILLED, THEN I LEARNED AFTER MY PROMISE THAT HE HAD USED MY EQUIPMENT AND MY MEN TO PLANT THEM, AND HE'S CHARGING ME FULL PRICE TO PLANT THEM, I DIDNT EVEN ASK FOR THEM, DEAR Revdex.com, I JUST KNOW ITS NOT WORTH RELIVING THIS NIGHTMARE DAILY, I WILL PAY AGAIN TO FIX THIS AND MOVE ON, HOWEVER IF MR. POPE INSISTS ON A LAWSUIT, THEN I AM PERFECTLY CONFIDENT HIS EXPECTATION WILL BE MET WITH THE REALITY OF THE LAW AND WHAT NC CONSIDERS UNFAIR BUSINESS PRACTICES, YOU CANNOT CHARGE PEOPLE FOR WHAT THEY DIDNT ORDER AND YOU CANNOT INVADE THEIR HOME WITHOUT THEIR KNOWLEDGE AND USE THEIR EQUIPMENT AND THEIR EMPLOYESS. YOU ESPECIALLY CANNOT LEAVE THEM WITH A CONSTANT REMINDER OF THEIR UNFAIR ACTS AND EXPECT TO PREVAIL IN A COURT SAYING YOU WERE SUBJECT TO WRITTEN INSULTS AND OUTBURSTS, IF YOU DO WHAT YOUR CUSTOMER ASKS THEN YOU DONT HAVE THESE PROBLEMS, WHICH IS WHAT I THINK Revdex.com IS FOR, TO SOLVE DISPUTES BTWN CUSTOMERS AND BUSINESSES, I WILL MOST DEFINETLY HAVE MY LANDSCAPE REDONE EXACTLY AS I ASKED MR. POPE TO DO AND I WILL COUNTER SUE MR. POPE FOR THE COST OF MY HEADACHES, MY ATTORNEYS FEES, ALL MY NEW LANDSCAPE, MY TOPSOIL HE STOLE, MY EMPLOYEES HOURLY COSTS WHILE HE USED THEM, MY NEW RIP RAP I HAD TO GET TO REPLACE WHAT HE RUINED, ALL THE MAN HOURS SPENT UNDOING WHAT HE DID WRONG WILL BECOME A GREAT FINANCIAL BURDEN TO MR. POPE, WHEN I CAN COMPARE WHAT HE CHARGED ANOTHER PATRON, I HAVE COPIES OF ALL OF WHAT HE DID FOR THEM AND IT WAS EXTENSIVE AND MY SMALL LANDSCAPE COST MORE, AND THEY WERENT FORCED TO GET PLANTS THEY DONT WANT, I CAN AND WILL PRESENT THE TESTIMONY OF EVERYONE, EVEN MR. POPES OWN WORDS, ALL OF WHAT HAPPENED HERE AND I HAVE ON CAMERA OF HOW LITTLE MR. POPE WAS HERE, HE WAS ALWAYS HERE TO COLLECT A CHECK, HE DID NO ACTUAL WORK, HES SEEN ON MY ATV DRIVING AROUND LIKE HE OWNED MY ATVS, I OFFERED A SETTLEMENT OF PEACE, FOR HIM TO WALK AWAY FROM HIS WARRANTY AND HE GOT $42,500 AND I GOT NOTHING BUT UGLY AND DEAD AND DRIED SOD GRASS I LOVED FOR 10YRS, I DO LIKE THE LIGHTING AND THE BOXWOODS AND THAT IS WHAT I SAID IN A TEXT, OTHER THAN THAT, HE RECVD PLENTY OF TEXTS FROM ME FROM THE BEGINNING OF MY BEING VERY UPSET AND HE KEPT PUSHING EXACTLY WHAT I WAS REJECTING AND HE GOT AWAY WITH WHAT I AM STUCK WITH CHANGING, BY TRESSPASSING ON MY PROPERTY WHILE I WAS 5000 MILES AWAY, THAT IS DEFINITELY ILLEGAL AND HE THINKS BECAUSE IT WAS MY EMPLOYEE THAT BROUGHT HIM THIS JOB THAT HE NEVER HAD TO SPEAK TO ME AS A HOMEOWNER AND THATS WHAT HE WILL LEARN, YOU CANT USE YOUR SO-CALLED FRIENDS ACCESS TO DO TRESSPASS, THE LAW IS THE LAW, HE HAD NO PERMISSION TO INSTALL THIS LANDSCAPE WHILE I WAS NOT PRESENT AND HE IS AGAIN TAKING ONE TEXT PRIOR TO MY ITALY TRIP OUT OF CONTEXT, IN EARLY JULY, I WAS GOING TO SC AND I TOLD HIM MY EMPLOYEE COULD REPRESENT ME WHILE I WAS AT A MEETING IN SC, HE IS USING THAT TO SAY 'AS LONG AS I WASNT HOME HE DIDNT HAVE TO ASK ME ANYTHING' AND THAT'S HOW THIS SPECIOUS CHARACHTER THINKS HE IS GOING TO PLAY THIS, I WILL SEE HIM IN COURT, THE TRUTH IS DEFINITELY ON MY SIDE.

The EarthScape Company stands by its quality of work and at all times had authorization to proceed with the work provided to the customer's property. The customer's comments to the Revdex.com should help any reasonable person understand that her complaints have no merit. In one breath she says that The EarthScape Company refused to help her turn on the sprinklers (which had been turned off by another vendor) while in the next breath saying that The EarthScape Company would have been trespassing if it had. She says she loved the lighting installed by The EarthScape Company but that The EarthScape Company was trespassing while installing it. Similarly, all work performed by The EarthScape Company was authorized and later she claimed it was not. In another instance she prepared and sent The EarthScape Company an agreement where The Earthscape Company could come remove the crepe myrtles (which were authorized) and when The EarthScape Company signed the agreement she reneged and would not honor it. It is not difficult to see through the customer's misstatements and inconsistent statements. All work was authorized, performed in a workmanlike manner and any reasonable person would be happy with the results.

Is this a business professional responding in hopes of a resolution or is this a five year old saying nanny nanny boo boo?
This is a serious matter, this business seems to talk a large talk about their ethics but there's no proof in their actions to back it up, this business refused to build a good customer relationship from the beginning, first by not granting the customer the plants she asked for, second by lying and saying the plants he listed were ordered and that's why customer cant get what they asked for, third; refusing to work out the disagreements with the customer yet constantly using her employees to talk to and avoid contact with her, showing up at a persons home without her knowledge is trespassing, I had no choice to refuse 26 crepe myrtle up my drive, I am trying to be NICE to this non-business and he's trying to call me crazy by what? saying I liked part of what he did, this job was 2 things, most important and first was irrigation, 2nd was landscape replacement and he insisted he had bought a list of plants he could not return, the reason I say hes lying is because when he tried to pass these plants off while I was out of the country, he also installed the lighting, he used my equipment and my men and this was not known to me until AFTER I tried to settle with him and I did, I paid this man $42,500 for work that is horrible, its upsetting, its just BAD all of it except some boxwoods and the lighting, so he can attack his customers in a response and it only shows the lack of concern and self righteous attitude Ive had to deal with, he has other customers that will follow with Revdex.com complaints because he deserves this, he is a bad business person and I'm not going to repeat this again, its too complicated, go away, try to care more about your customers and what they want because what you want does not matter, try this brilliant concept and read *** magazine and apply their suggestions and maybe you wont go under, FYI; you actually have to do what the customer asks, not what you want in there landscape and you cannot use other people on their property to avoid your customers, I hope this lesson helps you, good luck, I've paid you too much. I ve got to redo all of it, (except the lighting and the boxwoods)..... I really like it..thank you...it cost a lot....
