Good Afternnon I previously spoke with you regarding the move out charges for unit #located at Howe Avenue Sacramento CA I have reviewed the charges and have responded to your dispute belowRegarding the day noticeAs per the lease requirement you are required to put in a day notice prior to movingYou are currently being held rent responsible through days from the date you vacated the unit at the month to month rate of $because no written notice was providedI have attached a copy of the lease and have highlighted the areas in questionIt states on page 7, section CTerm, if the Variable Lease Term is checked to indicate an automatic continuance of the Agreement on a month-to-month basis after the Termination Date, the Agreement will continue after the Termination Date until either party terminates the Agreement by giving the other party at least days written notice, or as otherwise specified by lawThis part of the agreement is not referencing the early termination option, it is referencing the month-to-month option on page under monthly rentAs you can see this option is checkedI apologize if the complainant feels as though this is unfair however this is a legal binding contract and we expect all parties to adhere to the rules set forward in the contractPlease also keep in mind that no notice to vacate was given at allper the California Tenants Guide page 49-"You must give the landlord the same amount of notice as there are days between rent paymentsThis means that if you pay rent monthly, you must give the landlord written notice at least days before you moveIf you pay rent every week, you must give the landlord written notice at least seven days before you moveThis is true even if the landlord has given you a 60-day notice to end the rental agreement and you want to leave sooner (see discussion, page if your rental agreement specifies a different amount of notice ( for example days), you must give the landlord written notice as required by the agreement." I am rejecting this response because:Agent that received the keys should have pointed out that I was not meeting contract agreement.  Agent did not advised of this and process my termination of the lease.  Otherwise, I would have seek another solution.  Agent did not provide due diligence.

I previously spoke with you regarding the move out charges for unit #322 located at 1100 Howe Avenue Sacramento CA 95825. I have reviewed the charges and have responded to your dispute below.
1. Regarding the 60 day notice.
As per the lease requirement you are...

required to put in a 60 day notice prior to moving. You are currently being held rent responsible through 60 days from the date you vacated the unit at the month to month rate of $815 because no written notice was provided. I have attached a copy of the lease and have highlighted the areas in question. It states on page 7, section C. Term, if the Variable Lease Term is checked to indicate an automatic continuance of the Agreement on a month-to-month basis after the Termination Date, the Agreement will continue after the Termination Date until either party terminates the Agreement by giving the other party at least 60 days written notice, or as otherwise specified by law. This part of the agreement is not referencing the early termination option, it is referencing the month-to-month option on page 3 under monthly rent. As you can see this option is checked. I apologize if the complainant feels as though this is unfair however this is a legal binding contract and we expect all parties to adhere to the rules set forward in the contract. Please also keep in mind that no notice to vacate was given at all. per the California Tenants Guide page 49-50 "You must give the landlord  the same amount of notice as there are days between rent payments. This means that if you pay rent monthly, you must give the landlord written notice at least 30 days before you move. If you pay rent every week, you must give the landlord written notice at least seven days before you move. This is true even if the landlord has given you a 60-day notice to end the rental agreement and you want to leave sooner (see discussion, page if your rental agreement specifies a different amount of notice ( for example 10 days), you must give the landlord written notice as required by the agreement." The break down for the rent charge is attached to this document.2. Carpet Clean
The carpet was cleaned inside your unit in order to restore the unit back to the condition it was when you moved in. The cost of this was $80. we did not replace carpet in the bedrooms for units that did not need it. Your carpet did not need to be replaced therefore we just cleaned it.
3. Utilities
Utilities are typically billed in arrears since billing cycle follows that of the local utility provider. For example, a billing statement mailed to a resident due March 1st normally reflects usage for January and is created in February. When Utility Billing West begins billing, you can expect for Utility Billing West to bill between 1-2 months in arrears. The last utility paid on 6/1/15 while residing in the unit was for the usage between 4/1-4/30 totaling $78.15. The resident moved out on 6/21/15. the total bill from 5/1-6/21 was not paid and is charged at move out.
Your current amount due remains $1,112.60
