Review: We had a lot of work done by Essex in the fall of 2014. They planted a tree (crape myrtle) for us in late October. I contacted Essex in March to discuss a couple concerns, one being a hardscaping issue, the other was that the tree was dead. The landscaper, [redacted], urged me not to worry about the tree yet, as it was only early Spring and it may not have started blooming yet. I was given the run around for a few months and then [redacted] said that the tree was not covered because they don't warranty plants. I showed her ON THEIR WEBSITE that they had written they were warrantied for 6 months and then I contacted the company's owner, [redacted], and he stated that they would replace the tree, since their website did in fact say they warrantied their plants. Two dates were set up for them to come replace the tree. Both times they rescheduled. Then, 2 weeks ago, [redacted] emailed and said they wouldn't be replacing the tree after all. They have now "updated" their website to say that they don't warranty plants. But when I signed my contract last fall, this was NOT their advertised policy. I asked for [redacted] to again give me a call about this issue, and I have not heard back. I would like the tree replaced, or a refund for the cost of the tree.Desired Settlement: I would like a refund for the plant (they stated in writing it would cost $267.00 for a replacement), or replace the tree as they promised.
