Here is my response to their response:
 
1.     I ordered two pair of glasses after consultation with their optician and his recommendation; the two glasses were somewhat different and were to be used for computer work for one pair and the other pair for driving; I certainly would not have known to ask for different pairs as I have never even worn glasses before other than cheaters from the dollar store; not sure what “letter” she is referring to because I have never written them a letter.
 
2.     The options Dr. M[redacted] offered, he stated, would be of lesser power than what I already had in these glasses and would have attempted to correct the astigmatism even less; why would I opt for that option?; I did grab the glasses and left; why would I have left them since I already paid for half of them and Dr. M[redacted] said they wouldn’t refund the money; I will gladly give them the glasses back since I can’t use them anyway if they will refund my money….less the eye exam; I wouldn’t expect that.
 
3.     I guess I wasn’t aware of the discounts they had given me and do appreciate that; I can’t imagine how much the bill would have been without the discount.
 
4.     Her statement of “payment in full at time of ordering product” is incorrect; the office staff specifically told me it was 50% down with the balance due at time of delivery of the glasses to me; that’s when the issue began.
 
As stated above, I would be happy to return the glasses if they will refund my money or at least compromise; I’m really not trying to be difficult but feel I’ve been taken advantage of in some respects.

Thank you [redacted] did let us know it was for two pairs of glasses. If that was omitted in the complaint, that was our error, not his. He also stated he would like to return the glasses if he can get a refund, but has not been told if that was possible. Is that possible? He is not wearing the glasses. 
Also, do you have a copy of the payment policy he signed? And is the return policy explained to patients at the time of service? We had added that to the complaint as well as it is an Idaho law that merchandise purchases must include a clear return policy.

[redacted] was referred back to our office after he had been seen by a Salt Lake City corneal specialist who was unable to meet [redacted]’s expectations. [redacted] has had a very poor outcome with previous corrective eye surgery.
[redacted] knows we were doing our best to get him as good of vision as we possibly could....

If this were an “experiement” with glasses we surely would have only “tried” one pair first. He had our optician do two pairs, a computer pair and a single vision pair. As you can see from his letter he never mentions this “small” detail sadly.
Sometime after receiving both pairs of glasses, [redacted] returned to have us recheck his eyes and the glasses, of which we were glad to do. [redacted] was offered several remedies to modify/remake the lenses. As we visited, it became clear that no option other than full refund of his $361 he had paid initially as a down payment toward his $897.29 total. He grew agitated and stormed out with both pairs of glasses in hand valued at. He has only paid $450 which included his $89 exam which should be noted. Also worth noting is that he selected 2 frames, [redacted], which are $280 each. We also gave him a 10% discount on his first pair of glasses and as a courtesy, 30% on his second pair.
As our 26 year track record with the Revdex.com shows, we have been able to reach a 100% satisfactory outcome with any disgruntled patient. At this point we are forced to move in a small claims court direction seeing that [redacted] has $536.29 due and he has in his possession both pairs of glasses. This is a sad lesson of trust and integrity. Our office policy is payment in full at time of ordering product, but in good faith we let him put only $361 towards his glasses.
Sadly, under the circumstances, having tried to rectify the situation and [redacted]’s having the products, we are left with no alternative but to proceed with the afore mention process of Small Claim Court.

I met with [redacted], Dr. M[redacted] wife Friday morning; I arrived early so Dr. M[redacted] had not arrived yet and never did arrive to participate; [redacted] brought out her file and we discussed the whole situation; it was obvious that she had already decided on what they were going to offer; I ended up having to pay for just the lenses themselves since she stated they were like a medical device (her other example…dentures) and specific to each patient and therefore non-returnable and non-refundable; I challenged her about the return policy and sited my experience with Dr. M[redacted] and contacts and they weren’t charged to me; she said contacts were different since they are inserted into the eye and therefore can’t be returned and resold; makes sense; it appears the return policy is just an assumed issue because she never showed me where that is written nor did I see it posted anywhere; [redacted] stated she could resell the frames so she gave me credit for those; she also returned all three of my checks I had written along with a check from them to me to cover the doctor’s appointment; I thought they had cashed one of the checks when in reality they had only posted one to the account but didn’t cash it; not sure why they did that; total out of pocket was $361 which is obviously better than $900+ which is what the total would have been; I told her had I known they couldn’t be returned if they didn’t correct my vision I would have approached this differently; first of all I would have probably selected a cheaper frame and only one pair of glasses; she said one pair is typically the norm; I told her the guy fitting the glasses is the one that talked me into two pairs (one for driving and one for computer work); she said yes…..he no longer works here; read into that what you want; I’m still not happy that I had to pay that much money for something that didn’t work and then walk away with absolutely nothing but it was a compromise and I will chock it up as a bad business deal and a lesson learned.
