To Whom It May Concern,Ms*** applied on May 30, and the application was disapproved on May 31, 2017. The Application Holding Deposit was processed on May 31, and electronically sent to our Accounting Department located in Florida. The attached Account Ledger indicates that
the a check #in the amount of $was issued on June 19, 2017. Additionally, attached is a copy of our paper Application and the Application Screening Consent Form, which both state, "If you or any co-applicant is disapproved or deemed disapproved we'll refund all applications deposits within days of such disapproval. Refund checks may be made payable to all co-applicants and mailed to one applicant. It does not state that the refund will be received in hand by days if disapproved. Fairways Management Team believes that they did what was required by law and in good faith to have the refund issued within days. In no way is The Fairways or Pinnacle have any control over the Federal Postmaster's distribution system once a refund check leaves our facilities.I, Angela F*, Property Manager has issued an inquiry with our Accounting Department in Florida to see if the refund check has been cashed. If it has not I am requesting a stop payment and have new refund reissued and priority mailed to Fairways Leasing Office. I am dedicated to diligently resolving this concern for Ms***. To Whom It May Concern,After, speaking with The Fairways' team members directly handling the [redacted]’s application it was made known to the Property Manager that the [redacted]’s had a Real Estate Agent locate and visit The Fairways for them.  At that time, our Leasing Consultant shared with...

the Real Estate Agent about our community and all information regarding renovations in and around our community.  We have no control over whether that information was communicated back to the [redacted]’s.  Additionally, another Leasing Consultant spoke with Mrs. [redacted] in detail on July 15, 2017 in regards of breaking their lease and the two options the community offers.  Option One, Buyout Fee, which is paid within one day of 20 Day written notice from the day they intended on moving of that monthly period or Option Two, after 20 Day written notice is given and be rent responsible through the lease term and once a new resident has taken possession of the apartment home we will do a reversal of from the day prior on their account ledger.  Mrs. [redacted] wanted to know if she could receive a discount on the Buyout Fee.  Our Leasing Consultant explained there is no exception to the policy for the Buyout Policy.  Mrs. [redacted] at that time began to complain about the gym not being available and the use of only one shower since July 3, 2017.  Mrs. [redacted] wanted the complaints to be used as a way to obtain a break or discount on the Buyout Fee.  Mrs. [redacted] stated that she would speak with the Property Manager to see what kind of concession she could receive.  Our Leasing Consultant continued to explain that we do not offer rental concessions for the items Mrs. [redacted] was speaking of.  In regards to the work order, the initial work order for the shower concern was established on June 30, 2017 and addressed on July 3, 2017.  It was determined after that initial assessment from our Maintenance Tech that a section of the shower needed to be replaced.  Our Maintenance Supervisor then contacted our third party vendor to get this on their schedule for repair.  The first available appointment that they had to offer for the [redacted]’s was on July 19, 2017, which we scheduled.  The Property Manager adhered to the Apartment Lease Contract, Page 3, Section 26: REQUEST, REPAIRS, AND MALFUNCTIONS: Paragraph Two: “Rent will not abate in whole or in part.” and believes that the Management Team acted in good faith to actively resolve the [redacted]’s shower concern in a prompt timeframe while working with a third party vendor.  Additionally, The Fairways adhered to the COMMUNITY POLICIES, RULES, AND REGULATIONS ADDENDUM, Section 1:  GENERAL CONDITIONS FOR USE OF DWELLING PROPERTY AND RECREATIONAL FACILITIES, Paragraph One: “Owner reserves the right to set the days and hours of use for all Amenities and to change the character of or close any Amenity based upon the needs of Owner and in Owner’s sole and absolute discretion, without notice, obligation or recompense of any nature to Resident.“ For all other complaints, the Management Office has not received any written or verbal complaints prior to Mrs. [redacted]’s visit on July 15, 2017 and email on July 18, 2017.  It is difficult for the Property Manager to address concerns that have not been received in writing per the Apartment Lease Contract.   The Property Manager received the first written correspondence from Mrs. [redacted] on July 18, 2017, asking for a rental concession for the gym undergoing renovations and for one of the two showers being down since July 3, 2017.  The last sentence of the email states, “Overall, we have been very impressed with the apartment complex and people you employ here at the Fairways, and we would love to be able to give favorable recommendation in the months and years ahead.”  This can be considered blackmail or a threat to publically give The Fairways a bad reputation for not providing them with a Rental Concession.  Mr. [redacted] immediately after the last email correspondence with Mrs. [redacted], did follow through with posting negative reviews on [redacted], Revdex.com, [redacted], and [redacted] and believe that this is a malicious attempt to give The Fairways and the Property Manager a bad reputation. The Fairways believes that we have acted promptly and accordingly to Policy and Procedures set forth in the Apartment Lease Contract and Addendums that the [redacted]’s have signed along with adhered to the Fair Housing Laws applicable to both Federally and Washington State.  If you have any further questions or concerns, please do not hesitate to reach out to the Property Manager at 253-927-9430.  We look forward to resolving this concern.Sincerely,Angela F[redacted]Property Manager

To Whom It May Concern,As stated on Friday, July 13, 2017 that The Fairways has issued an inquiry on the check issued.  Most companies do not issue a stop payment until 30-days after a check has been issued.  I have sent an email to our Accounting Department that is located in Florida (3 hours ahead of us in Eastern Standard Time) to see if it is possible for them to go ahead and stop payment on ck #[redacted] and reissue another one and have it priority mailed to the Fairways Leasing Office.  Once, I have confirmation I will notify Ms. [redacted].  Until I have confirmation from our Accounting Department there is nothing that can be done from The Fairways Management Office.  We do not issue checks from our location.  If you have any further questions or concerns, please do not hesitate to reach out to me at [redacted]@pinnacleliving.com or 253.927.9430.  We look forward to resolving this issue soon for Ms. [redacted]. Kindest regards,Angela F[redacted]Property ManagerThe Fairways Apartments
