holding fee becomes forfeited should they cancel their application or fail to move in as agreed. The complainant came in on March 23rd to view his apartment, did not like it and said that he wanted to cancel. It was reiterated at that time that the $200 he had paid on the 16th would not be refunded and he said that he would have to think about whether or not he wanted to take the apartment since the $200 would be forfeited. The complainant finally informed us that he would be taking the apartment and would need to come back to take measurements. We attempted to contact the complainant on several occasions to no avail. He was scheduled to move in on March 20th, and did not show up on that date as agreed. As a courtesy, and to make sure that we still had something to offer him, we changed his move in date to April 1st. We continued to make attempts to contact him and were unsuccessful. As a result, he was cancelled out of our system on April 2nd. Since he was notified multiple times and on different occasions that the $200 would not be returned should he cancel or not take possession of the apartment as agreed, his $200 was not returned. The additional $1.95 that is listed is the convenience fee for paying online and is non-refundable via the online payment processing company.
Initial Consumer Rebuttal /* (3000, 13, 2015/06/08) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The company has a voice mail that I left messages on daily. Every time I called the voice messages would indicate that the company was busy and to leave a message and someone would be in return the call. My cell phone records will prove that the company did not call me. Also, it clearly indicate that I called them several times. If the company will lie about $200.00 what would they had this been a major investment. The apartment complex has history of this type of action with customers. I would advice anyone that plant to move there read the history first. I fully disagree with the reply.
