broker, we are not in a position to authorize any equipment returns once the lease documents are executed (signed) by the customer. We do encourage our customers to read the full 3-page lease agreement before signing. The terms, payments and early termination details are clearly stated in the lease agreement. Customers have the ability to request a copy of their signed, non-cancellable TimePayment Lease Agreement and review the terms that are clearly laid out. The customer has the option to pay off the equipment lease prior to completion at a discounted rate. There is an "Early Termination" clause in the contract within item #18 referencing that early payouts are discounted at a rate of 4%. Management has reviewed the transaction records and found no evidence to confirm the claim.

In this particular situation Ms. [redacted]'s credit score was below our pre-qualification threshold to submit to any of our network of funding source partners. We send an email notification to an applicant when they don't meet the minimum credit profile to be submitted to our funding sources. We did attempt to submit Ms. [redacted]'s application as a Corporation Only which was declined by our funding source. By doing this the funding source would look solely at the business credit and not personal credit. A Decline email was sent to [redacted].[redacted] Jun 1st at 9:29 AM for App # [redacted]We provided the information we could to Ms. [redacted] over the phone however as our ECOA states we must receive a written for specific information. I have taken a few things back to The Farmer's Daughter. That will not be disputed. This is a small community and I am not a tourist. We live and work together. However, being in a tourist town, Rita's return policy is ridiculous. People return things and don't ALWAYs want a store credit. The lights that I took back were broken. Pure and simple. It is only ethical business practice that she return my money. Receipt or no receipt.

This response is in regards to the complaint filed against our business by Mr.[redacted] on March 2, 2017. Mr. [redacted] alleges various bad practices by our business, QuickSpark Financial, LLC ("QuickSpark") which are simply not true. To provide some background, Mr. [redacted] initially reached out to...

QuickSpark and made the first contact with us by filling out a Commercial Equipment Lease application on January 28, 2017 to obtain financing to purchase a drone for his business Credit Ding Repair, LLC. A link to this application is provided on the website of the vendor who sells the drones, to provide an additional purchase funding option for customers of that vendor. There can be no consumer law issues in this matter, as Mr. [redacted] represented that he was dealing with us on behalf of his business; indeed, he filled out a "commercial" equipment lease application, not a personal or consumer lease application. After considering his financing options with QuickSpark, Mr. [redacted] told our employees that he would instead use his "business credit card" to purchase his desired equipment, as it was going to be cheaper for him to do so. Again, this indicates that Mr. [redacted] was dealing with QuickSpark on a commercial matter rather than a personal or consumer matter. If Mr. [redacted] did not desire to receive business calls on his personal cell phone, he should not have provided this information on his commercial lease application, which is for businesses. In fact, as a matter of business practice, QuickSpark deals almost exclusively with commercial/business clients, and does very few personal financing deals. Moreover, Mr. [redacted] alleges that QuickSpark used an auto dialer to call him when, in fact, QuickSpark does not utilize auto dialers in its business or even own any autodialer technology - all calls are made by live QuickSpark employees. Mr. [redacted] never indicated he had any problem with QuickSpark calling him at any time when speaking with QuickSpark employees, andQuickSpark never contacted him again after he made the decision to pursue other financing options (i.e. his business credit card). QuickSpark did make a call to Mr. [redacted] at 7:17 am Arizona time one morning, but Mr. [redacted] did not answer the phone and no message was left; he later called QuickSpark back on the same phone line to inquire about the missed call he noticed on his phone.It is QuickSpark's firm belief that there were no legal or ethical violations made during the context of its communications with Mr. [redacted], which Mr. [redacted] initiated by filling out the commercial equipment lease application. the lease after the purchase order for the equipment had expired, and the equipment was not yet ready for delivery.  The $4,000 referenced was paid by the applicant to the equipment vendor; QuickSpark is not in possession of those funds.We have been in continuous contact with the applicant, equipment vendor and lease underwriter since the beginning and are working on potential solutions.

The "constant contact" that was referred to was simply being told over and over "You need to take that down from the Revdex.com." There has been no resolution. I still am not getting a trailer. I was told by Casey J[redacted] that I had a $16,000 loan through Pawnee. I was never told of any time limit or any type of stipulation, only that they would pay out the day the trailer was finished and I would get my $4000 cash back. The other loan/lease for  $4,000 in equipment was to go onto the $16,000 trailer that I was supposedly approved for.  When I contacted Pawnee myself, I was told that I had been approved back in June for five days under certain stipulations that I was never told of. And that other than that they had declined applications for me and nothing approved since the first part of June. Casey J[redacted] had been telling me the entire time that it was a done deal after he apparently knew that the stipulations were not met and there was no funding. I am still unaware of what the stipulations were. After Pawnee was no longer funding the trailer, Casey J[redacted] had both of our credits pulled multiple times dropping our credit score very low. He had also had us come up with $4000 cash to secure the loan with Pawnee and to begin the building of the trailer with Southern dimensions. Now there will be no trailer because there is no funding, which he knew about but continued to let us believe was there. Casey J[redacted] also told us that pawnee was requiring us to carry insurance on the unbuilt trailer and to secure funding we paid three months on an unbuilt trailer for insurance. We put $4000 +3 months of insurance out of our pockets to secure a loan through Casey that he knew was not there. Southern dimensions will not return our money or the loan/lease money for equipment. I would feel this was resolved if Casey/Quickstart gave us our $4000 +3 months of insurance since he knew there was no loan. I am aware that they do not have our $4000 cash or the $4000 loan/lease money but neither do I. He cost us that money on lies. The loan/lease money cannot be returned from Southern dimensions we have to settle for a Revdex.com pit that we cannot use, because it is made to be attached to a trailer, because of the way that case he worked the lease on it. We put every penny we had into this on Casey's word and contracts that we signed a through him. We have a lost $4000 cash and are tied into a three-year $4000 lease and we have nothing usable. I hold Casey J[redacted] and Quickstart solely responsible. He then put all the blame on my husband who he already knew was bipolar and almost committed suicide because Casey would not take responsibility for his actions and put them on him. Southern Dimensions did their job. They are also having to try to recoup their money for building the trailer. Casey owes us the money. Once I get my $4,000 cash back and $200 for the insurance from him, then it will be resolved. I also do not need calls demanding I withdraw my statement to the Revdex.com.[redacted]

from TimePayment Corp. the company that is financing her equipment. QuickSpark Financial does not have any legal agreements or contracts with Ms. [redacted] or her company. The TimePayment Equipment Lease Agreement was reviewed and signed by Ms. [redacted] and does not show "PO BOX" in the address. Please advise Ms. [redacted] to direct the complaint to TimePayment Corp.

Response to Complaint ID #[redacted]  We maintain that the claims made by Ms. [redacted] are false and unsubstantiated. We claim no responsibility or ownership of the damages suffered by the customer.  However, as promised, we have been in continuous contact with the equipment sellers, funding sources, and customers involved with this transaction to come to a resolution.  The $4,000 that the trailer manufacturer had in its possession has been refunded to the customer and we have made numerous attempts to contact Ms. [redacted] by phone and email to  discuss the potential reimbursement of the $200 she spent on her insurance.  While we are not responsible for the insurance, we understand the frustrations the [redacted]'s experienced in the transaction and are offering the $200 as a gesture of goodwill provided that she will consider this matter closed. Once we can make contact with Ms. [redacted], we can make arrangements to get her the $200 she is requesting.

states this  on my  receipt given to customers and  attached on my register where customers can see. Susie is always returning merchandise she purchased, keeping maybe two items she bought. She returned a sweater  with no tags and no receipt, I accommodated her with  a smile and a credit to store. She purchased battery lit stars, when she returned them they were wadded in a ball and thrown in a bag, no receipt, no package and wanted her money back,  I explained to her I needed a receipt, again I was going to break my policy with her and credit her back. She stormed out of my store and said whatever. I truly feel that as much as I try to make her happy and have her way,  I believe there is no way satisfying her.
