Hello ***,As per our phone conversation this morning I am providing you a synopsis of what took place regarding the marketplace transaction in ***. On or around March 15, *** *** agreed to purchase a Kentucky trailer owned by The Finest Carrier, Inc TFC was
given a $deposit with the understanding that *** would be paying the balance within the week*** requested a copy of the titletitles were sent to him on 3/16/and 3/17/The first title sent to him on 3/16/was a copy of the Michigan title which reflected the owners of the trailer prior to usThat title had (1) digit incorrectRight after we purchased the trailer from the original owners our lender noticed the incorrect digit and the proper forms were sent to the CADMV where the incorrect vin # was correctedThat was the only title copy we had in our files the day *** requested a copy. The second copy of a title sent to him on 3/was the California title held by the lender that had our loan and had TFC as the current ownersThat title was the current title, the corrected title and a positively valid CAtitleOf course we didn’t have that title in our office the day *** first requested a copy as there was still money owed on the trailer and that title was held by our lenderAs soon as our lender sent us a copy of that title we forwarded it to *** 3/17/In hind sight we never should have sent *** the first title as it had the wrong digit in the vin# which had subsequently been corrected. *** also requested that the trailer be put in the shop to have some mechanical issues resolved that we agreed to pay forThe trailer was taken out of service since it was to be sold within the week, put in the shop and we ordered the requested repairsWe later found out that while the trailer was in the shop *** had ordered the shop do additional repairs that *** told the shop he’d pay for himselfAfter all repairs were done, approximately days, the trailer remained parked at the repair shop awaiting *** to pay for it and pick it upWe were still obligated to continue to pay for insurance and make the trailer payment while awaiting ***'s payment of balance and of course the trailer could not generate any income for us any more. on 4/6/I spoke to a man named *** *** from ***’s lender FCA Wholesale, Inc*** asked me to have our lender fax him a Guarantee of title which I immediately didAfter our lender forwarded the guarantee to *** he called me and said that he was unable to verify that the title on the trailer was free and clear and validThis was the first time the title became an issueI contacted the California DMV and personally verified the newest and current CAtitle was in good standing and that there were NO issues regarding the titleI contacted *** again and informed him of what DMV said and gave him the telephone number of the appropriate department at DMV to verify the titleFor several days I attempted to follow up with *** to see if he in fact did verify the titleEach time I was given an excuse as to why he hadn’t gotten around to it yet and eventually he told me that the fellow whom he worked for that was actually the lender just basically changed his mind about lending the money to *** for the trailer. It was evident at this point that *** wasn’t going to get his loan and was trying to blame it on us, as if the title was an issue. On 4/we heard from *** again suggesting that the trailer had a different vin # than it was born with and that somehow the title had been pushed through the CADMVNow the story had gotten ludicrous. We received a demand letter from ***’s attorney and also a visit to our office from Inspector *** *** of the CaDMVOur attorney responded to his attorney’s letter and hasn’t heard anything back sinceInspector *** looked at all the documents associated with this trailer and the transaction and agreed with us that everything was in order and that there was no reason that the trailer couldn’t have been purchased with the clear correct title that we provided ***She concluded that there was zero grounds for the non refundable deposit to be returnedInvestigator *** *** can be reached at ***We contacted another potential buyer who was interested in the trailer and he proceeded to buy the trailerHe was given the exact same title, the CAtitle we sent to *** on 3/17/and of course there was no issue with that title what so everThe sale of the trailer was completed with the new buyer without any issues and of course with the same CAtitle. I see that *** mentioned something in his complaint about the trailer being in our fleet and not our regular inventoryThe trailer was owned by The Finest Carrier, Incwhich is a trucking company and the fact that we also own a classic car dealership has absolutely nothing to do with this trailerJust another ploy to try to get back his nonrefundable deposit after he defaulted.
