To whom it may concern,The Fishel Company ("Fishel") had crews in this area from November 21, 2014, through November 26, 2014, and back again on December 1st through the 12th This particular job entailed drill work in front of plus homes on several streets in the city of Mesa.Our local
division received a call from *** *** on Monday, December 1st, stating that our crews had dug up her yard and caused damage to a PVC water service line to her home She was advised that an investigation would be done and if Team Fishel had caused the damage, we would fix it At that time Ms*** stated she already called a plumber and that he had come out on Saturday, November 29th Ms*** emailed a copy of her invoice on December 1st Upon investigation, it was determined that we were not digging or drilling in the area where Ms***'s damage occurred This information was relayed to Ms***, however, she advised Fishel her plumber told her that it was our drilling that caused the pipe to break.We currently have a call into the plumber to verify this information Once this information is verified, we will be back in touch with Ms***

I have reviewed the response made by Team Fishel on January in reference to complaint ID*** Team Fishel's further response was to have a representative arrive at my door (without prior notification) on February with a check for $ and release forms This check reimbursed me for the cost of the plumbing repairs. Team Fishel's acceptance of financial responsibilty is satisfactory.Team Fishel's recounting of events in their written response contains inaccuracies Especially rankling is the portrayal of their response as an "investigation" when they repeatedly refused to accept evidence and apparently reached their conclusion by looking at pictures of the hole they dug A company whose business involves installing utilities doesn't realize that pipes are connected???The Team Fishel representative who delivered the check told me that:A Century Link process exists to provide detailed notification to residents before subcontractors like Team Fishel begin workA Century Link process exists for an independent company to process complaints from residentsCentury Link's processes require subcontractors to respond to resident complaints within daysCentury Link expects subcontractors to avoid leaving holes in resident's property over long holiday weekendsTeam Fishel did not comply with these processes or expectations in this instance Compliance with these processes and expectations in the future would go far in avoiding complaints similar to mine

Repair work at said property has been completed.

Our supervisor met with the homeowner on Friday July 29. We had a crew with him to complete the repairs. Homeowner was satisfied with the repairs when our crews left. We are happy to investigate any other outstanding issues if any are noted.

the sidewalk was poured the week of July 11.  However, no one has been back to remove frame of sidewalk or the barriers they put  up.  Yard has not been restored.  No topsoil has been delivered or spread not has grass been planted.

I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory to me.

Crew followed up with claimant and performed services that show Team Fishel is not liable for the damages Homeowner stated. Homeowner satisfied with the work we performed.

There is not anything is Ms. [redacted]'s response to respond to as she does not give any reasons for rejecting Fishel's response or any new information.   For that reason Fishel stands by its original response and feels it still accurately states the reason for not accepting liability in this matter.  Fishel verified through its GPS system its truck was not speeding, investigated and determined that the trailer in question was empty and the pictures submitted by Ms. [redacted] while showing some scratches, does not appear to show any damage indicative of debris hitting it while flying off a moving trailer.  Fishel also did not receive any complaints from any other drivers that day regarding debris.

To whom it may concern,Ms. [redacted] reported an alleged incident wherein she states one of our vehicles was "spraying" debris all over the road while speeding.Once the report was received, our company promptly spoke with Ms. [redacted] regarding this alleged incident.  Ms. [redacted] indicated that...

our truck was speeding and "dirt" was flying off the truck and into her car.  She was advised that the incident would be investigated and a liability decision would be made.  She was also advised that The Fishel Company has GPS in all vehicles and that we can track the speed of our vehicles.  At the end of the call, Ms. [redacted] was advised that liability would be investigated and no promises were made.Upon completion of the call with Ms. [redacted], our GPS on the alleged truck was checked.  At no time on May 15, 2015, was our truck speeding.  GPS report shows the truck actually going at or below the speed limit around the time of Ms. [redacted]'s complaint.  Also, at the time of Ms. [redacted]'s complaint, our driver indicates that the trailer was clean and his passenger confirmed that it was clean as they were on their way to pick up a piece of equipment.Ms. [redacted] was driving a 2013 Chevy Malibu.  She complains of rocks hitting the windshield so hard that she thought it was going to crack.  This would indicate that debris was hitting the FRONT of her vehicle.  After looking at the pictures, which I have attached, it is our opinion that the damage to the side of her vehicle is not consistent with her initial report.  In addition, the damages she alleges do not appear consistent with rocks being thrown at her vehicle.  Since our vehicle was stated to be in clean condition AND was not speeding, it is our opinion that the "debris" Ms. [redacted] is alleging appears to be on of the normal hazards of driving.  Based on our conversation with Ms. [redacted], our conversation with our driver, our review of the GPS reports, and review of the photographs submitted by Ms. [redacted], we have formally denied liability in this matter.  Ms. [redacted] has been advised that if she disagree's with our liability decision to submit any additional information she may have and it will be reviewed.Thank you.  If you should have any questions or concerns, please do not hesitate to contact me directly.[redacted]Claims Administrator###-###-####
