Refrigerator/Freezer dented and door on freezer side looks to be sprung. Linoleum flooring in dinning room needs to be fix.We are in the process of buying a modular home, from [redacted] in Rocky Mount, NC. The refrigerator/Freezer has dent on top edge of refrigerator and the Freezer door looks to be sprung,The hinge is bent and wobbles when door is opened. It is closer together at the top left side of freezer door than the bottom left side of freezer door, handles were left inside refrigerator when first turned on, no one will except responsibility for turning it on.The next thing is the Linoleum flooring in the dinning room. It was scraped and the flooring was messed up.They had a crew to come and replace the linoleum, they seem to be unable to fix the problem. When they installed the linoleum they were to line it up with the linoleum in the utitly room, but they didn't. It is off about 1" from lineing up, it should be fized properly.Desired SettlementWe would like to have the Refrigerator/Freezer replaced with a new one. Complaint[redacted] (president) refuses to acknowledge customer after promise to work through to resolution.I am filing this complaint because I am at a loss as to what to do next. My husband and I bought our home five years ago from Home Headquarters, subsidiary of Fisher Housing, and within the last few weeks, our septic system has failed. This is a major concern because a new system should last a minimum of twenty years. The problem was discovered when we hired a company to come out and pump the tank and inquire about the, newly rancid, smell coming from the front yard. Our tank and filter are fine, but the leach field has failed. In the expert's opinion he was confident that the failure was caused by poor installation and grading.Once we realized that the problem was bigger than we first thought, we decided to contact our builder. Initially, [redacted], president of Fisher Housing, was very kind and empathetic on the phone, and he promptly arranged for his subcontractor to look at our leach field. By the time the subcontractor came we had already had three experts in the septic field give us their opinions. All of who agreed that it was a grading and installation issue. One gentleman also suspected subpar materials were used. So when Fisher's subcontractor arrived, we were hoping for a quick resolution, but instead he started making accusations towards us such as; you are using too much water, there is evidence of a heavy truck driving over these lines, your walkway destroyed the whole field, and it looks like you finished the upstairs, did you put in a third bathroom that you are hiding from us? All of which are outrageous claims. I realized Fisher's subcontractor clearly has some other impetus for displacing blame about the failing septic system. To pacify the subcontractor, in hopes of a faster resolution, I address all of his concerns. After that ordeal, I promptly called [redacted] and told him I was quickly losing faith in his subcontractor. [redacted] responded by saying, he thought there was some obvious grey areas and wanted to work with us. This conversation happened on Thursday, March 6th 2014 at 4:00pm. [redacted], knowing my husband is deployed thanked us for what he is doing and went on to say, "I always try to do right by my customers, but want to go above and beyond for our military." [redacted] suggested that all parties could pay a third of the cost, to expedite the resolution process. I was open to settling this matter quickly; agreeing with [redacted]'s statement that "no one wins when these things are brought to court...I am confident that if we keep open communication we can come to a resolution that makes everyone happy and takes some of the financial burden off of you."That was the last time we spoke. It was over a week ago. This is an emergency situation that is exposing our family to the dangers and smells of hazardous waste. [redacted] and I seem to differ in our definition of "open communication." I have made over 15 attempts to contact [redacted] and have left several messages trying to resolve this issue, and all attempts have been ignored. During this last week, the subcontractor, the site manager and I were supposed to meet and resolve this problem, but the weather caused the subcontractor to postpone the meeting. I began to have some confusion about what the point was of this meeting was. That is what prompted my first ignored phone call to Mr. [redacted]. I was seeking clarification, wanting everyone on the same page. I had a friend help me by calling the sub-contractor to find out what exactly he was told by [redacted]. He claims he knew nothing about a settlement, in fact, he thought he was meeting again to show me how I was wrong. [redacted]'s subcontractor has no interest in coming to a resolution, since he believes this is an issue between [redacted] and me. Again, I am filing this because I am at a loss. Mr. [redacted], this is wrong. I feel you have taken advantage of my situation and my trust in our conversations. You cannot treat your customers this way.Desired SettlementThe settlement I am seeking is for Fisher Housing to cover the expense of replacing the failed septic leach field and directly associated costs such as, removing contaminated soil. Business Response 1-There is no warranty on a septic system 5 1/2 years after installation. 2-Even if there was responsibility this long after, it would be with the installer who I tried to put in touch with the customer but she refused to meet with him. 3-The system was installed per and inspected by county. 4-Even after all this, I tried to settle this but the customer is seeking legal counsel. Consumer Response First I would like to point out that [redacted] did not even address the primary reason for my complaint, and that was the fact that he and his office neglected to answer any of my phone calls. This started the day after he told me, "I want to keep open communication," and the silence continued for over a week. So I will address this. [redacted] did call me back, coincidently it was the day he received my Revdex.com complaint, so thank you Revdex.com. [redacted] claims he was out of country. He never told me of these plans and stated that we would all talk after the arranged meeting, which would have been two days after we spoke, it took him 11 to contact me. Further, there was no one in his office that answered the phone. Normally I would get a secretary, but not after March 6th. I was left in the dark. Now to address [redacted]'s four points: 1.There is no warranty on a septic system 5 1/2 years after installation.There may not be a written warranty put out by Fisher Housing for this septic, but there is something called industry standard and a seven year liability for contractors in the state of NC. Acknowledgment of this would make future customers more comfortable purchasing a home from you. 2. Even if there was responsibility this long after, it would be with the installer who I tried to put in touch with the customer but she refused to meet with him.YOU, Mr. [redacted], are my builder. I never paid money to the subcontractor, YOU did. As I see it, I am supposed to come to YOU. As a consumer reading this it should make you question why you should hire Mr. [redacted] as a builder. A builder is supposed to build your house and coordinate all those involved in this process. If he just, five years down the road, expects you to do all the work when something goes awry, ask yourself, what is the point of hiring him? And the second part "she refused to meet with him" is just simply not true! I canceled the meeting because I couldn't get up with Mr. [redacted] the day after he suggested the meeting. This is an important point! The meeting was canceled because Mr. [redacted] failed to communicate! I had questions of clarification such as; what is the purpose of this meeting, should I get a nonpartisan expert involved, does this subcontractor of yours know what you are suggesting (referring to the deal that we split the cost three ways)? I was given the cold shoulder and did not want to walk into something with no understanding of the end goal. But I NEVER refused to meet with his subcontractor. I spoke to Mr. [redacted] at length about this and he is still bringing it up against me. Also, I talked to [redacted]'s subcontractor at length on the phone and later found out that he was thinking that this "meeting" was again to reiterate what we had already talked about in detail and that he was NOT informed of [redacted]'s settlement and was NOT willing to entertain this idea. I am still wondering what the meeting would have accomplished. Mr. [redacted], you also have the responsibility to know the kind of people you hire to work on your homes. Your contractor stated that he was only concerned about passing the bare minimum code standards, not installing a system that would last. These are the kinds of people Mr. [redacted] are hiring and it makes me question his ability to produce quality homes. Those of you reading this and considering one of Mr. [redacted]'s homes need to understand that if your septic system fails after five years his answer will be, "it was built to code." The question you should be asking yourself is, would this answer, "it was built to code" satisfy you? 3. The system was installed per and inspected by county.Your third point is irrelevant, even things that are inspected and pass sometimes later fail. This is just you blame shifting. Again, I paid YOU. At one point you said to me, "if we find out it is the subcontractor's fault, maybe we can go after him together." I have over and over again shown, by the experts brought in, that this is not my fault. If you are so convinced it is not your fault why are you not helping me as you promised? You have responsibilities to your customers and to your word. 4. Even after all this, I tried to settle this but the customer is seeking legal counsel.Lastly, your settlement offer is not sufficient! It is about 1/10th of the cost. This is not a small problem. I have to replace the entire leach field and dispose of the waste in my front yard. Obviously Mr. [redacted] is only concerned with doing the bare minimum. Is this how you, the potential home buyer, want your builder to act? Now to address the accusation that I am seeking legal counsel, again this is not true, at this time. I know the rules of the Revdex.com and will honor them by not getting lawyers involved until this is dispute is closed (which I am assuming will happen shortly.) Then I will consider it. I don't understand your negativity to this idea, Mr. [redacted]. I need someone that has my best interest in mind and that is obviously not you. I am not looking to just make you pay for no reason, my goal is to find out who is liable and hold them accountable. Since you are so sure this is not you, you should have nothing to worry about.Based on our interactions with each other, even if you are not found liable, I would not recommend your company to anyone! I hope this complaint sheds light on what kind of business you are running and cautions consumers to stay away.Final Business Response Not going to go back and forth. stand by my previous points. Am expecting some feedback from the meeting with her legal counsel. Still trying to do what is right within reason. [redacted]
