Complaint: [redacted] I am rejecting this response because: information received from the collection agency is not validI initially moved into The Flats on San Felipe on 10/24/to a bed/1bath (apt 02-203) and then on 5/5/requested to transfer to a 2bed/2bath (apt 04-417) and resided in the 2bed/2bath from 06/22/2016-07/22/This dispute is about my $deposit paid for the 2bed/2bath (apt 04-417) that was not received within days of moving out, nor was an itemized document containing valid/applicable deductions made from the deposit, received I challenge and dispute the validity of the document received from the collection agency (I.QData International, Inc) that served as 'validation' of this debt for the following reasons: 1)The address on the The Statement of Deposit Detail says it was sent to ' [redacted] , [redacted] ***' and not [redacted] as indicated by The Flats on San FelipeAnd since the date of preparation is 05/05/and date of print is 08/7/2016, the [redacted] would not have been a valid address to mail to, as I did not move into that apartment and sign a lease until July 21, 2)The Statement of Deposit Detail provided by the collection agency on behalf of the business, indicates this is in regards to the 1bed/1bath (apt 02-203) that I occupied from 10/24/2015-06/22/ and not the apartment 2bed/2bath (apt 04-417) that this deposit and dispute is referencingThis is the first I am seeing that charges were still outstanding from the 1bed/1bath (apt 02-203) 3)The Statement of Deposit Detail indicates the document was created on 05/05/and printed 08/7/and lists several charges for maid cleaning, carpet clean/damage, pest control, trash and water/sewer however, I did not vacate 1bed/1bath (apt 02-203) until 06/22/2016, show these charges were not known at the time of the indicated date that the document was prepared (05/05/2016) 4)I included my 05/02/2016-06/22/Pest Control, Trash and Water/Sewer charges in my July (see attached) so these charges have been paid in full 5)The Statement of Deposit Detail lists a transfer fee of $for when I moved from my 1bed/1bath (02-203) to 2bed/2bath (04-417), I do not recall being required to pay a transfer fee prior to signing my new lease, obtaining my keys, paying my prorated rent for June (see attached cancelled check dated 6-23-2016) and moving into 2bed/2bath (04-417) [I recall paying a deposit $250, prorated June $rent thus retroactively charging a transfer fee is illegal 6)The Statement of Deposit Detail lists a credit of $245.07, however I am disputing not receiving my $deposit paid on 05/05/for my 2bed/2bath (04-417) apartment which should have been returned to me by 8/21/(days from my move out) 7)The Statement of Deposit Detail is not on standard company letterhead, the [redacted] signature contained at the bottom of the page is not legible/readable and the [redacted] signature also did not contain a date, so it is difficult to validate the document's authenticity The Statement of Deposit Detail that was sent to collections and ultimately ended up on my credit report, is full of inaccuracies and my $deposit that has been held, is being held in bad faith by The Flats on San Felipe Regards, [redacted]

We accept the below proposalAfter receiving the check for $for apartment 417, we will contact our collection agency to remove the other charges from your accountPlease let me know if there are any further issues. My proposal to resolve this and move forward without incurring further legal action is the following:1. While I have concerns that I did not receive the letter and itemized statement for Apt 04-at the address indicated, I can at least verify that the itemization provided appears to have been actually charged on my accountI will remit a check payable to The Flats on San Felipe for the balance $within days.2. For the Statement of Deposit Detail for Apt 02-203, in order to assist in assessing and evaluating the charges indicated on the letter, please provide a similar move out statement (that was provided for Apt 04-417) that lists a running account of my rental account for Apt 02-for the months of May 2016-June 2016, so that I can see an accurate picture of the credits/charges on my account and the dates they were charged

This dispute is about my $250 deposit paid for the 2bed/2bath (apt 04-417) that was not received within 30 days of moving out, nor was an itemized document containing valid/applicable deductions made from the deposit, received.  I challenge and dispute the validity of the document received from the collection agency (I.Q. Data International, Inc) that served as 'validation' of this debt for the following reasons:   1). The address on the The Statement of Deposit Detail says it was sent to '[redacted], [redacted]' and not [redacted] as indicated by The Flats on San Felipe. And since the date of preparation is 05/05/2016 and date of print is 08/7/2016, the [redacted] would not have been a valid address to mail to, as I did not move into that apartment and sign a lease until July 21, 2017.   2). The first attachment is the move out statement for apartment 417. The address that it was mailed to you can see at the top was [redacted]. This statement was mailed out on August 8, 2017. You can see at the bottom of the itemized statement the security deposit was credited to the account as well as the pro-rated portion of rent making the total balance due of $422.29. We had to replace carpet, trash out the apartment, there were three broken windows, extra heavy cleaning, as well as 2 days of hold over. The second attachment is the move out statement for apartment 203. This was mailed on August 7, 2016 and mailed to [redacted]. This apartment also had to be cleaned, carpet cleaned, transfer fee, and final water bill for a total due of $245.07.
