I am rejecting this response because:I'll wait until I recieve a check before I let them off the hookI tried for months and neverheard from them after the initial brush offLet them wait for the removal as I did

The item that this customer order has been discontinued by the manufacturer. We do show a Store Credit for the customer and will issue a refund check immediately in the amount of $21.95. This additional amount includes the shipping that he was not charged

Consumer states: I have been dealing with the Director of Marketing and I can confirm that I did receive my refund and have concluded my business with them

Review: I received a catalog from Fly Shop and sent in a check for clothing and sun glasses. The clothing came but noglasses. When I wrote back they informed me theywere out of that pair of glasses. They then informedme they did not charge my credit card for items theydid not ship out.???? Really, they cashed the checkand tried to brush me off without even looking to howthey received the payment. Still waiting for my $20.00Still waiting for a reply. All in all this is what everybody fears with catalog people.Desired Settlement: Check made out to me for $20.00the price of the glasses I paid for but never received.

Review: Went by yesterday and found out the product on their website was not available. Upon returning home, it was still on their website and I suspected it was in a different location. I went to order through email and they confirmed they had the product (see attached). Before going to pick up the rod, I called to confirm and suddenly they did not have it again. Then they told me they would work with me and took my number. I was driving by and decided to stop in. They told me they would take twenty dollars off of a reel which I don't need. When asked to honor the price or to work with me they were not willing to work with me in anyway.Desired Settlement: I feel like this is false advertising not once, but twice. I feel they should make it right or work with customers to honor this advertising. I think they should either meet me in the middle between full price of 730 and 399 offering. Another option would be to give me a store credit if I have to pay full price for the fly rod.

Response:

The Fly Shop has been in business at this location for 36 years. In that time, to the best of my knowledge, we've never before had a Revdex.com complaint lodged against us. In fact, this company was selected as the fly fishing industry's finest shop by the American Fly Fishing Tackle Association the very first time that the "Top Shop Award" was made. We were recently honored with the most prestigious award that that the Fly Fishing Federation makes to members of industry (The Lee Wullff), chosen by Field & Stream Magazine as "one of the top 10 tackle shops in America", and have received more accolades in the past three plus decades than there is time to mention in this response. It is no stretch to beat our collective chests and claim to be one of the finest fly shops in the world. We've managed to bridge several recessions, and survive the most recent economic downturn because we've been taking good care of our customers since the day we first opened our door in 1978.

But we have limits and during those 36 years we have adopted a very practical customer service philosophy. Everyone here has been taught to "bend way over; but don't let them bend you over."

Frankly, This complaint is completely baseless and is the personification of

someone using the Revdex.com pulpit as a method to leverage an unreasonable demand.

The merchandise in question is a discontinued product and was identified as such on our website. It was, understandably and quite clearly advertised as limited to stock on hand. The rod is no longer available here, at any price. It is discontinued,

discontinued, discontinued... The advertised price of

the dc'd fly rod was a great deal and actually below our cost. Because

it was a great deal, all three that we had were quickly sold. That's what stores do with

discontinued merchandise and any reasonable person would simply

recognize that the opportunity was missed. Had the customer actually attempted to order it on-line, our state-of-the-art POS would have automatically searched inventory, found it sold, and informed him it had been sold and was no longer available. Instead, he called and dropped by our store location with a local friend, since he was visiting the area. Our staff made every attempt to mollify him and spent a total of two hours with the guy and his friend, answering questions and giving tackle and destination advice. There was no attempt to 'bait and switch" the (discontinued) product and it was explained that the fly rod had simply been sold and the website (which is updated every two or three days) had not yet been revised. He made a number of unreasonable demands for discounts when he was in the store and was very politely refused. The customer left the store with his friend after thanking our staff for the help with a number of product and destination related questions.

He suffered no significant inconvenience, no expense; left the store without spending a penny, and now appears to be looking to profit from an everyday, dynamic, retail situation that has nothing to do with false or misleading advertising.

Because it is discontinued, the fly rod may be available elsewhere at a similarly discounted price, and I encourage him to look on-line and suggest that he'll probably find a bargain elsewhere. But what he wants from The Fly Shop is now asking for the the difference

between the original, full retail price of $730 and the advertised, discounted

price of $399 in the form of a store credit should he find it elsewhere? What he is going to get from The Fly Shop is nothing but our repeated apology for what any reasonable person would call a very minor inconvenience.

Very sincerely,
