I have been working on this since Friday [redacted] called in was upset and requesting a refund due to the folders not arriving in the school thus farI let [redacted] know that I am sorry that she is upsetHowever the school was sent the artwork and the list of sponsors to approve but neglected to do so before leaving for summer breakI assured [redacted] that this is incredibly uncommon for our companyWe want all of our schools to have folders in a timely mannerI have been working with the Principal and have gotten the approvals and artwork changes neededWe wll be going to print as soon as possible, we will also be extending the exposure time of ***'s ad in the foldersMeaning she will be featured for all of this year and for next year for the delayThe delay is no fault of oursHad we gotten everything approved through the school earlier we would have delivered the folders on timeBecause our program is sponsor based we alert the school that they will be delivered once the sponsor spots have been filled, as close to the first day as possibleWe have an agreement with the school that we will not print anything until it has been approved fully through the administrationOur agreement with the school also states that upon delivery of the folders our folders will be the only folders used throughout the year for all correspondence between the parents, students, and teachersI tried very hard to explain this situation to [redacted] and her husbandThe Assistant Principal is not who we have our agreement withOur agreement is with Mr [redacted] the Principal who has been helpful to get this process moving along now that they are back in sessionWe are sorry that the folders have not arrived but we have done everything in our power to please [redacted] and her husband in this matter We have already created artwork for their ad space in the folder and now that we have approval from the Principal we will be going to printThank you for your time and please let me know if there is anything else I can do to help here

This is a completely fraudulent complaintMr [redacted] is making accusations and has nothing to back up his claimsWe would like for this complaint to be disregarded completelyWe would also like to look into options of reviewing his business for his unprofessional and rude demeanor Mr [redacted] first called in on Jan 16th to accuse our company of being fraudulent and unethicalAfter asking questions and wading through his accusations, we discovered that Mr [redacted] was believing he was pitched an incredibly grandiose marketing planAccording to him, he was promised to an ad that he paid $for which would be featured in a folder for every real estate office in statesWhich is a ludicrous assumption We are amazed at the audacity of his claims, as well as confused as to why he spent over months running around before ever reaching out to usWe confirmed that Jan 16th was the first day that he had even done a search for us online, when the original sale had been months ago on September 12th, We have artwork created for him, he sent it in on 9/and the final copy was approved on 10/He has talked to our graphic designers over the phone and by email, and it never seemed to occur to him to reach out to them with questions regarding production at any time these past few months Our program works with Realtors and Offices across the countryEach folder is produced per individual contractSometimes it is with one office, one team, or one realtorWe have Never made a promise for a folder in the entirety of statesThis folder was for a team of realtors and would be available to the entire officeWhat's more, we will be printing as many folders as the team desiresIf the team and office use more folders than what they're given, our contract states that we will gladly supply them with more As for the original sale back on 9/12, we have phone records of separate phone calls over the course of hours between himself and Rocky, our account executiveWhat we mean to say is that on the day of purchase, Mr [redacted] has separate conversations with Rocky to solidify and understand the contract, as well as all the conversations with the art department over the next month We have asked Mr [redacted] for any evidence or records to back up his claimsOriginally he told us that he "had it all in writing" and that it was all in an email conversation between him and Rocky, our account executiveShortly after he changed his tune, saying that he was promised it all over the phone and that he didn't have any records regarding his promisedWhat's more, as we went into our own records regarding the sale, we saw nothing out of the ordinary and all of our official documents backing up and supporting our standard program Due to our experience dealing with Sole Proprietors and new businesses across the nation, we believe that Mr [redacted] started his business expecting to make plenty of money right of the batAnd, as most new business owners tend to testify, experienced hardships in launching his new enterprise that he did not foreseeWe believe that after the expenses of the Holiday season, Mr [redacted] wished to take back some of his promises from the year before, and looked at his payment to us last September as a good way to regain some of his moneyWe have reason to believe that Mr [redacted] 's actions are based not out of a promise from our company, but from a lack of proper financial planning on his endThat he overextended himself this holiday season and is looking to accrue funds from other companies in any way that he can We plan on honoring our contract and producing the presentation folders on time, as they are still on scheduleOnce printed, we would be happy to produce a physical copy of the folder that Chaz legally agreed to We hope that this shows that The Folder Center operates with faith and goodwill to all of our clients, and do our best to answer and settle any questions, concerns or confusions that our clients bring to us -- Scott T [redacted] Operations Administrator

I would not have made a complaint had they returned numerous phone calls I had left previously. Ms. [redacted] called in on January 9th, 2018 to ask for a refund to her account. The Refund was approved on Jan 11th, 2018 and a check was sent out to her address, [redacted], shortly thereafter. On Jan 19th, 2018, Ms. [redacted] called in again to ask about the...

refund, and we assured her that the check had been sent out and should've still been on it's way. Ms. [redacted] called in yesterday, Jan 30th, 2018 twice at about 6:20 am our time (West coast, 3 hours behind her on the East coast), sent an email at 6:40 am our time asking us to return her money, and we have strong belief that she filed this complaint at about the same time. I (Scott) got into the office at 10:00 am our time (1:00 pm her time), received the messages and email and gave her a call back right away. She didn't pick up and I left a message. at 2:22pm our time (5:22pm her time) she called back. She told me about how she had not received the check in the mail and was a little accusatory and sharp (I don't blame her, in her situation I would most likely be upset as well.). I assured her that I would see what I could do. I went to my supervisor, we discussed the matters, and went up the chain of command and got approval for the finance department to refund her payment through our merchant processor. The refund was processed and the funds should be in her account by now. I gave her phone calls and left messages 1/30/18 @ 3:09pm & 1/31/18 @ 10:07am to give her an update that the check had a stop payment place on it and to make sure that the funds had been returned successfully. I have not received a reply at this time. -Scott - Operations Manager   If the funds have not been returned successfully, then we would like to know so that we may take extra steps to insure the return of those funds. Since the time of this response, we have tried to contact Ms. [redacted] 3 times, 2 phone calls with messages and an email, and have not had a response from her at all. We would like to remedy this situation and get her her refund, however we have had a difficult time getting her on the phone. If we could have help discussing with Ms. [redacted] about what has happened to her refund, that would be much appreciated.

I am rejecting this response because: After talking to Mrs. K[redacted] she is adamant that she did not sign a contract with the Folder Center and they acted without her consent. I would like a copy of the signed contract between the Folder Center and Mrs. K[redacted] so I can provide that to my attorney so the appropriate legal action can be taken. As well I have every email correspondence between the folder center and myself that I can provide to show Scott K[redacted] was the sales rep who contacted me, discussed the opportunity, and took my payment.

The Folder that Mr. [redacted] purchased an ad on was Real Estate Associates in Clanton, Alabama owned and brokered by Diane K[redacted]. When Ms. K[redacted] first agreed to use our company's service, she signed a contract with us stating, among other things, that she would act in good faith with us and not try...

to hinder our actions in providing her with her folders. Through multiple actions and a refusal to compromise, Ms. K[redacted] breached her contract with us and terminated the project.   As part of the contract that Ms. K[redacted] signed, it states "...If a Realtor cancels, through no fault of The Folder Center, after sponsors have been secured for the Realtor's folder, then the Realtor agrees to refund any monies sponsors have paid to be featured in the Realtor's folder." Because of this we have legal reason to place the responsibility of Mr. [redacted]'s refund onto Ms. K[redacted]. She was the one who had initiated our service, and after we had put multiple hours into putting her folders together, refused to honor the terms of the agreement and breached the contract. We do have the contract on file if it is needed for reference.   We at The Folder Center accurately provided our service to Ms. K[redacted] and Mr. [redacted], and are sorry that the project did not complete fully like many others have. We had tried to explain this to Mr. [redacted] when he had called in and offered many alternatives to accommodate his situation, but were unable to reach a mutually beneficial conclusion.   As a side not, the salesperson that we have on record was not Scott K[redacted], he is one of our Customer Service associates. We have another sales rep on file as the one who initially contacted Mr. [redacted] about the Folder Project.

I am rejecting this response because:
The information is false. I never stated that the false sales pitch was in writing. It was done over the phone. And the sales pitch stated that it would be in the welcome packets of every [redacted] Realtor in MD, DC, and VA for one year. And when I told the sales rep that I wasn't licensed in VA, he told me to just disregard those calls or recommend them to another Home Inspector. And I did contact them in early October after finding out that the things they told me over the phone were false after talking to several [redacted] Agents and team leaders. All they did on that call was give me the phone number of someone that I have called and left several messages with, and they have yet to get back with me. And finally in January, I visited the main [redacted] Office in Upper Marlboro, MD, and was told that each Agent creates their own welcome packets, and they have never heard of The Folder Center. By then I had proof that I was lied to by the folder center sales rep, so that is when I called and escalated the issue. And what's this about me over extending my finances during the holiday season. They don't know me. I have 4 separate personal bank accounts with thousands of dollars in them, as well as a business account. I wanted a refund, not because of financial stresses, but because I knew that The Folder Center was ripping me off by not providing everything that they said they would when they took my money.
