Initial Business Response / [redacted] (1000, 8, 2015/08/25) */ We originally suggested doing the interior repair, which would mean having to take many measures in his basement. With this, we provide a lifetime warranty guaranteeing the repair. He had his interior basement finished so didn't want to have... to take everything apart and install it. We told him we could try the exterior drain, but there wouldn't be a warranty because it wouldn't be a guaranteed fix. The interior repair is the only way that it would be a guaranteed fix. He stressed that he does not want to the interior, so we did the exterior. He called a few weeks after the repair was done and I went back out to do another evaluation. He still had that hydrostatic build up and I once again told him the only way we can guarantee the problem is solved is doing the repair in the interior system. He then shooed me out his front door.

To whom it may concern,This is the first notice we have received of this complaintIt appears first notice was mailed to our old address in Arnold, MO We moved locations years ago *** *** *** *** *** *** *** *** I will get this complaint to Jason Bauman to respond this afternoon as he handles our production and will have the information needed to respond.Thank you *** ***

I went out to the property on 4/24/to look at itWhen I was there, I observed there was drywall up, covering the area of concernI couldn't see anything so I told the home owner he'd need to take it down if we'd like us to look at Re: the extension cord, that was the responsibility of the
previous owner, that was not in our proposal to addressThis property is located in Imperial, MOThe warranty clearly states that it is voided by earthquake and adverse, sub soil conditionsThere was an earthquake recorded in Imperial on 9/5/I informed the customer of this fact a few days after 4/24/I've attached a copy of our warranty and the original proposal for the record

Our company was contracted to install a drainage line against the foundation of this property. Moving any rock structures was not in the scope of work listed in our contract, nor did our company charge for this .

This was over eight months ago and it is the first I am being about it. 1. Our drain tile needs to go against the foundation. 2. He asked my foreman to move it, but he did not move it. In an email I have, he was told that if he was given an additional cost, we would have moved the for him. He said...

he also had a fence company come out to put a fence pole, and the rock was removed by that company. I am a little confused why I am just receiving this complaint when the issue has been resolved and it has been this long since this job occurred. I cannot ask the foreman about this, because he is no longer with the company.

Complaint: [redacted]
I am rejecting this response because:The earthquake provided from the news report barely shook a leaf on a tree. Per government guidelines, a 2.6 Earth Quake falls into a Type 1 Earthquake, where the description from earthquake.usgs.gov states "Not felt by a very few under especially favorable conditions". The term "Damaged" such as the term the business is referencing doesn't occur until a Type  VI (5.0) occurs. I find it hard to believe that once a foundation is repaired better than the original state, a earthquake of half the Richter scale could cause this to occur.  I'd like the business to come back to my residence now that the dry wall is removed to re-examine my issue as well as where the water is continuing to enter my basement. I've had other professional foundation repair companies come out and have told me the issue was never with a earth quake, but the lack luster work performed with securing the plate correctly and the failure to use bigger plates  when performing the repairs. My next course of action is to initiate a lawsuit, which then becomes a matter of public record. I have already consulted attorneys that are willing and capable to take this to a court.
Sincerely,
[redacted]
