We have offered multiple options to this residentThis resident wants to keep his residency at Foundry and will not accept any of the options provided to himWe have offered to release him of his lease - no penalties or transfer unitsThis resident has had the opportunity to speak with owners and company representatives and is still not satisfiedOur attorney is now handling this resident's complaintAs the management company and owner's, we are sorry this resident is not satisfied with his options but all communication had been directed to our attorney

We have given this resident multiple options to remedy the issues, including letting him out of his lease.  The resident has decided that he does not agree with that option and would like to stay in his current apartment.  This resident refers to "we" on multiple occasions, referring to...

additional residents.  We have only been contacted by this individual regarding this matter.

I am rejecting this response because: this response does not solve this issue. Foundry is not offering multiple options to resolve, they have offered one - for me to leave. Previously they offered moving me to another unit, but recently seemed to retract that offer. Before this issue escalated, I was given a $300 credit, each month, for the past three months because of these issue, what I told them was that I would remain in my unit for another year if they extend the credit. I question why they would have paid $300 for the last three months but all of a sudden stop with no resolution of the issues. Foundry's statement of them not hearing this from other residents is completely inaccurate. They (Michelle) has told me residents are coming in complaining about the NEP bills, other residents complained all winter about the window issues (ice, frost, etc). In fact, she said, some residents have it worse than me, which were her words. Clearly she knew that because of complaints. One of my neighbors stated that he's complained a number of times. The other neighbor said foundry gave him a check to compensate for the issues. That should be proof enough that others are complaining. Furthermore, I requested a community meeting so that they could hear for themselves that other residents were complaining. Foundry ignored that request. I have a lot of documentation regarding this matter that I am happy to provide. If you notice, again, Foundry ignored our request for documentation that the building is in energy code compliance. I did a lot of legwork up to this part regarding research and gathering information from the city. I drew my conclusions which doesn't look favorable for Foundry. All I am asking is that they can show me they are in compliance and have an inspector validate this. Obviously, it wasn't done correctly the first time around and I have documentation from Foundry representatives that states this (email from architect).

Hello. I am in the process of PDFing and gathering all of the documentation that you have requested. There are quite a few documents, which some (one email from architect) even acknowledge our findings. Their attorney has also reached out to me. And while he says that his client is not willing to provide documentation to prove energy code compliance, they MAY be working with me to not increase rent next term because of these issues. His client is asking that I sign a document (that he is currently drafting) that would release them of this issue. I have not yet agreed to sign, but did ask that he send to me to review. I also asked that I see the lease. I will be in touch. Thanks.
