I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me.
Lastly, I attempted to resolve the matter with the clerk at the front desk, I was treated unprofessional and disrespectful by her timesI was upset
for that reason, not for the amount of money I was charged.

The Garage Auto Repair is offering a resolution and refund based on new information submitted in the rebuttal offered by Mr***. The most recent statement given to the NMRevdex.com by Mr*** states that the attempt to stop his credit card payment has failed through ***. That is brand new information to us, and we have been adamant that we would not issue a refund to Mr*** due to the fact that a refund was already being issued through merchant services, which would in turn, cost us double. On 9/15/2014, the amount of $plus $were removed from our account as a result of a dispute initialized by Mr***. As of 9/24/2014, the funds have not been returned to The Garage Auto Repair from ***, and we are told that the process could take 30-45 days, and that the complaint is still active and is being reviewed. The Garage Auto Repair is offering to refund the diagnostic charges if the following minimal conditions are met. First, there must be an accepted resolution from the NMRevdex.com, a resolution stating that The Garage Auto Repair has acted in good faith to resolve the concern. Second, a copy of the repair invoice is provided showing that the vehicle was repaired at another shop, as stated by Mr***, for under $and that The Garage Auto Repair did not diagnose the vehicle correctly. Lastly, funds are credited back to the Garage Auto Repair from ***, in turn freeing up the funds to be returned in full to Mr***
For future issues, it should be known that a simple phone call to the owner gets far better results than aggressive legal actions like credit card reversals and Revdex.com complaints. My first notice that there was a problem was from the credit card company. Businesses should always be given the first chance to remedy potential problems with service I personally handle concerns professionally, eliminating the need for clients to attempt to get refunds through these extreme measures

The garage is mad because we did not agree to their scam!! This is why we were charge "a diagnostic fee for doing nothing" , I gladly look forward to your response

Mr*** has already stopped his payment through his credit card company, and no other restitution will be considered. Mr*** has also changed his story three times in writing about the events he believes happened. Story #submitted to the credit card company stated
that they were issued a refund for merchandise that was returned, but never received credit. Story #submitted to the credit card company stated that the services were cancelled and no refund was given. Story #submitted to the Revdex.com stated that they were promised free services by our manager. All three stories are documented in writing and will be included in our defamation law suit being filed All supporting documents have been faxed to the Revdex.com for public review
Mr*** keeps referring to an imaginary event that happened on a Saturday. In this event, Mr*** claims our manager offered free services from our business. This event did not happen, The Garage Auto Repair is closed on Saturdays. Whom ever had this discussion with Mr*** on that magical Saturday was not affiliated with The Garage Auto Repair. This discussion did not happen, we were not open for business on that day
Moving forward, Mr*** had his Mini Cooper towed to The Garage Auto Repair on Wednesday July 2, 2014. In person, Mr***, accompanied by Mr*** ***, authorized in writing, for The Garage Auto Repair to perform diagnostics on their vehicle. Mr*** also initialed a box on our contract, prior to services, that specifically authorizes the diagnostic charges to be accrued. The New Mexico State Attorney General specifically allows diagnostic charges to apply without prior authorization. The Garage Auto Repair takes one additional step in this process by explaining to the customer that diagnostic time is not free, and that they must initial for the charges before a mechanic will look at the vehicle. Mr*** accepted these terms and initialed for the diagnostics to be performed. The signed work order authorizing diagnostic charges of $45.00-$has been faxed to the Revdex.com for public review. Mr*** had no clue what was wrong with his vehicle except that it is "not going into gear". To determine the failure, the vehicle had to be diagnosed
The vehicle was professionally evaluated and diagnosed in our shop and an estimate was generated. I personally spoke with Mr*** *** about the failure. In great detail, I educated Mr*** that we found a failure with his pressure plate. I explained that by simply replacing the one failed component was not a smart idea, and that clutch has several pieces that all function as one. The intelligent method of repair was to replace not only the failed component, but all the parts associated with the clutch. Suggested repairs included the pressure plate, clutch disk, updated tube assembly from the dealer, throw out bearing, pilot bushing and the slave cylinder. An estimate of $1,840.00, not $5,000-$6,000, was given to Mr*** and he declined the repairs on behalf of Mr***. The estimate included the known failure (which was diagnosed by an ASE certified Master Mechanic) as well a few accompanying parts that usually get replaced at the time of a clutch service. All the parts were quoted from the dealer, *** ***, and quoted at the dealer list price, and the labor was fairly priced through the Mitchell Labor Time Guide
Due to the fraudulent nature of this complaint, accompanied with information, dollar amounts for drama, and the fact that there are still slanderous actions being taken even after the credit card payment was disputed, The Garage Auto Repair has been left with no choice but to seek damages through the court system. Legal actions have been instigated by The Garage Auto Repair for damages incurred as a result of information given to the credit card company and also to the Revdex.com. Damages will far exceed the initial disputed amount of $
The bottom line is that Mr*** authorized the diagnostics to be performed, but doesn't want to pay for services rendered
