Yes, I did receive $from [redacted] to draw plans! The first plan idea she sent me, I spent a lot of tome and drew up and sent to herShe said that's not what she wanted, that was just a plan she like! She sent me a second drawing with the comment Poor drawing, but a general idea! After quite a bit of work and numerous changes she wanted, I finished the plan and sent it to herThe next email from her said ***,We are pleased with the drawingsLots of livingspaceJust what we were looking for.I asked her if she was ready for me to send it out for pricing, and she said yes! As I was bidding it out, the next correspondence was, ***,We have decided to go a different routePleaselet me know what our options are for getting our $backI told her I spent a lot of time drawing the plans and did my job! I should be paid for my time and don't feel because you changed your mind, I should refund the money for drawing the plans!I have the complete plans and all of the emails showing all of the documenting the changes she keep asking for!

Tri County Builders, drew the plans for Mr***, per his requestTri County Builders would never for obvious reason, promise someone a price per sqftwithout first bidding the job outYes after we received the selection from Mr***, we bid the job out and gave him the priceHe
agreed on the price and we went to contract with itTri County Builders, worked with Mr*** to try and lower the price to his budgetMr*** insisted on certain selection and would not compromiseLand clearing and pad (if required) was the owners responsibilityWhen I visited the building site, it was obvious it had to be clearedI told Mr*** where the best location was to build, but he wanted it in a different spotThe new location was extremely low and I advised he have a pad built up as there was a drainage creek close to itMr*** asked if that was included and I told him we never include clearing are pad's just the house itself!- Mr***, then asked if he did some of the house paint etcwould I pay him for it, so he could pay for the site workI hesitantly agreed, then latter he wanted me to pay the invoice for workTo date, I have never collated the money from him for that work are any other EXTRA's he requestedThe specification are very clear as to work to be doneMasonry, are masonry concrete ledge, where never part of the contractThis is an ongoing pattern with Mr***, he wants things and says we talked about them, but after having to adjust his bid to meet his budget, they where deleteThe specification are outlined to this- There was no temporary lighting installed, Mr*** wanted to change it recessed lighting and we gave him a change order for the workMr***, did not like the price and argued it was includedThe specification do not list recessed lights! -The windows were installed properly and the leak was corrected - The plans clearly did not show a door to the walk in showerMr***, reviewed the plans before bidding and was totally Mr***, as stated previously, wanted to do the painting himself to save money to pay for the extra's(which we have not been paid for to date) He selected, paid for and applied the paintThe majority of punch list items have been correctedWhen Mr*** refused to pay us, we had no choice but to stop workUnder the Texas Residential Construction Contract he signed, Item #Default By Owner: 1.) Owner or Owners agents or representative fail to make payment due under this contract, including payment for any Change OrdersItem #Substantial Completion, Inspection, Release And Occupancy: If the owner moves into Improvements, the Improvement shall be deemed to be substantially completeOwner shall in no event be entitled without prior written consent of the Builder, to occupy any portion of the improvements until Builder has been paid the Total Contract Priceand all payments as set forth hereinWith the house being occupied, it created a very un-workable situation for the Builder and his Subcontractors, making finishing the house and Builders Right to Cure impossible

As has been the case from the beginning, there is no attempt by the company to negotiate or come to any sort of agreement I have offered more compromises than I should have - especially considering that the last thing I believe I should have to do in this situation is compromise - and have never succeeded in getting Mr*** to even enter into a discussion about meeting in the middle His claims are false, yet to continue to debate the facts with him is pointless I have made my case countless times, always providing supporting documentation, emails, or pictures to justify my position When asked to provide anything which would support his stance, however, he was either unable to or never felt compelled, I am unsure which Saying that I refused payment is ludicrous He was well aware of the deadline for the draw period with the bank, having even been reminded of it by myself on numerous occasions as it drew near, yet the paperwork for the final draw was never submitted The change orders he speaks of were never presented to me, let alone signed, and since he is so familiar with the contract, he certainly knows that any and all change orders were to be signed by both parties and the payment received before the work even began That being said, however, I would not have hesitated to pay him for the extras which I verbally requested and agreed to (those being the walk in shower and the upgraded wood for the cabinets) had he taken the time to have a civilized discussion about the final payment options and submitted the draw request All I want, at this point, is to be able to focus on repairing/finishing my house and not have to deal with someone so unprofessional anymore Given my experience with him thus far, I think it is safe to say that Mr*** will never consider a compromise, and I don't think it is fair for him to demand money out of my pocket because he could not submit his draw request by the deadline set forth by the bank The amount we are in disagreement about wouldn't even cover the legal fees to fight this battle, and I doubt that either of us wants to take the time out of our lives to do so He is in poor standing with the bank, he is in poor standing with me, and I think a gentleman would realize that the most civil move here is for both of us to simply cut our losses and go our separate ways

I told the [redacted], I had knee surgery and was recovering. I also told them I wanted to go myself to take care of an punch list items, when I felt better. It's a few minor items, that I had plan to do for them.
