I am rejecting this response because:Some of the information in the response from the Girard is completely untrue First of all....the contract states residents have to give days notice if they are moving out of the Girard...this means that I had a total of days after notice to vacate was given to find a place and still give the Girard days notice that I was moving out I never once received clarification on that question....not once I thought I was going to be breaking the original contract if I didnt find a place within days of the vacate notice and so I busted my as to try and find a place....to no avail I understand by law the Girard only has to give residents days to leave...and they were soooooo gracious to allow us a whopping instead Go ahead and pat yourselves on the back for that one This complaint has NOTHING to do with state law, or what you did as far as giving plenty of notice, or accommodating displaced residents (by holding back apartments for a total of weeks)....are you kidding me? When I received no clarification from *** on my questions regarding the days vsdays vsgiving days notice to vacate since I was moving offsite...I was incredibly pressed for time and had to get out asap I also had a hernia surgery last Friday which I notified *** (manager) of well before I left...and that I had no way to move out AFTER my surgery and had to move out BEFORE my surgery while I was still able That obviously didnt matter, and so she just *** *** my questions YOu can sit there and say you gave me plenty of notice, explanation, etc....but that is a complete statement Not once did I get clarification from *** about my questions to regarding vacating within days in order to give days notice as stated in teh original contract I do not accept their response as an answer....it still did not answer my question If they stated in their notice to vacate that it nullified the original contract....I didnt see it And since it did not, my impression was that I needed to find a place within days in order to still give them days notice that I was moving out! Do you understand my question? Why I'm confused that you believe you answered my question and WHY I left when I did?

*** *** feels that we have not answered his question so I will try to answer his question here. We sent *** *** a letter on May 12, 2016, a copy of the letter is attached, the letter states in option #"Vacate your unit on June 28, 2016: Please let us know if you intend to move out at the end of your lease ...you will need to give us notice if you intend to move out prior to June 20, 2016." The site manager responded to *** ***'s emails times and stated in those emails that the day notice is only needed if he intended to vacate the unit prior to the date given on the notice, June 28, 2016. We requested several times that *** *** come into the office and speak to us personally because we did not understand his confusion. I understand that *** *** had a medical issue that he had scheduled during this time and we apologize for any inconvenience that this may have caused him. We were willing to work with him however he was not satisfied with any of the options that we had to offer and refused to speak to us personally. In an effort to work with *** *** I am willing to waive the rental charges through the end of the notice period per the lease agreement and only charge *** *** for rent through the day he vacated the unit. I am not sure if this is what *** *** is requesting but I would be willing to discuss any further issues or requests that he has, please contact the office and let us know what you are requesting from us

*** *** received numerous emails from us explaining our position. Our apartment complex maintains a very high occupancy rate and we don't have enough units to accommodate everyone who is interested in moving into our complex or transferring to another unit within the complex. Our
apartment complex was built in and is in need of renovations, as *** *** has stated the units really need to be renovated. The renovations of the units include updating the kitchen, opening up walls to create a better flow through the unit, updating the bathrooms, adding a washer and dryer, removing the popcorn ceilings as well as updating the paint, carpet and hardware throughout the unit. These updates are very expensive for the owner to complete, in order to justify the expenditure it is necessary to increase the rents after the renovations are completed.As we explained to *** *** our lease agreement allows us to give a day notice to vacate, per Colorado law we are only required to give the resident days notice. We gave the residents days notice in an effort to give the residents enough time to locate other arrangements. We gave notice to units and we only had units available for residents to transfer into, we accommodated residents on a first come, first served basis. We had residents that contacted us the day they received the notice and we were able to accommodate them. *** *** did not respond to our original notice so we reached out to him by email several times to try and help him relocate within the property if that was his choice. He notified us on May 23rd that he was not interested in transferring to another unit on site and he would be moving out by 6/27. The Girard at Cherry Hills has met and exceeded the requirements of Colorado State law, we tried very hard to answer *** ***'s questions and give him options of other apartment complexes in the area that have units available in the price range he was currently paying. We are very sorry that *** *** is unhappy that he was required to move. We would have really liked to transfer *** *** and meet his needs, however we don't have any vacant units on the property that met his needs. *** *** stated that he was only given days to find a place outside The Girard, this is not factual *** *** was give days to locate a place outside The Girard. He was never told nor did we imply that he had to give us notice in order to move outside The Girard, the notice that we gave him clearly stated that he had days to vacate his unit. If he wanted to vacate sooner than days than he would need to give us notice of that date.We hope that *** *** is able to locate an apartment that he is happy with and we would gladly give him a reference of his rental history at The Girard at Cherry Hills. As we all know we can't make everyone happy, however we do our best to accommodate our residents, we do need communication and understanding from the residents in order to make the communication productive.Thank you *** *** for your residency at The Girard at Cherry Hills and good luck in your future endeavors.Respectfully,*** ***Aviva Properties, LLC
