However, I received a notification from the buyer's attorney advising me not to release the escrow until the dispute between the parties was resolved. As an attorney, I have a fiduciary obligation as an officer of the court to retain the money held until an agreement is reached between the parties or a court order is received. I advised him of my obligation. Subsequent to his complaint, I advised him that I would notify the buyer's attorney that if they did not commence an action within 10 business days, I would release the escrow. I also advised him that if we received a written response with another demand to hold the funds, I would commence a small claims action on his behalf.
