Pd apt deposit of $250.Never signed lease. No apt in over a month.Requested deposit refund.Mgr refused claimed apt was avail day after refund request.Sept 5, 2013 paid $250 deposit. Made numerous calls inquiring as to status of apt. Each time apt was not available. On October 5th, I called to request a refund and was told by [redacted] that an apartment would be ready the next day. On October 12th, I went to The Greens to pick up deposit and was informed by [redacted] that we would not receive deposit refund however he would speak to his manager and call back on October 14th. Did not receive a call back as promised. Called the corporate office and was advised that we would not receive a refund because their policy is if you are offered an apartment and refuse to accept you do not get a refund.Desired SettlementI am requesting that The Greens refund the $250 deposit that I paid in good faith in hopes of receiving an apartment.

I applied and secured a $450 security deposit with The Greens at Marion apartment complex in Marion, AR on June 10, 2015. I originally requested a move in date of July 1, 2015. Between June 10 and July 6, the certainty of an available apartment that would be ready for me was always an issue as explained to me by the complex's leasing agents. On July 1, I contacted the property to see when my exact move in date would be but again I was met with uncertainty. On July 5, I was told I would have an apartment but the very next day I was called again to say that the residents of the apartment decided they were not going to move and that I had been assigned to another apartment. July 7, I visited the complex to view the apartment but was told that it would not be ready until July 8 so I returned the next day and the apartment I was told was move in ready was a horrendous sight to see. There were holes in the walls that had been patched up poorly, the walls and baseboards were dirty and coming unattached from the wall and even some holes that you could see inside the wall, spiders crawling around, broken appliances, crayon drawings on the counters from the previous residents, mismatched paint on the walls, antiquated appliances, the floors seemed unstable and just the overall condition of the apartment looked substandard for living and especially for paying almost $700 a month in rent they were asking. The leasing agent told me that they were not allowed to do a walkthrough of the apartment with the resident. It seemed as if she had no idea of what kind of condition the apartment was in. They asked me if I would list everything that was wrong with the apartment and I asked if the outdated appliances could be removed but they told me that as long as the old appliances worked they would not be removed. They asked if they could fix the other thing on the list and allow me to move in at a later date but my question is why these things werent addressed BEFORE I was shown the apartment. I had not signed a lease or even moved in but the complex is holding on to my $250 because they said I had refused the apartment but the condition of the apartment was unacceptable and wanted to take it as is. The apartment shown to me was NOTHING like the model that was shown the month before. It baffled me to see landscapers working so diligently on the appearance of the front office area putting out new flowers and mulch, but the inside of the property's apartments were ragged and rundown.....what a bad misinterpretation.Desired SettlementI would like my $250 security deposit returned.

My fiancé and I paid a security deposit of to The Greens at Marion. We were suppose to move in August 1st but didn't and now cant get our money back.On June 13,2015 my fiancé and I paid an application fee of $15 each to apply for an apartment in The Greens at Marion in Marion, AR. After completing the application the property manager ** did a credit check and informed us that an additional $200 was required with the base deposit of $250. While talking to her she stated that if we could pay the deposit by June 26th no later than June 28th that we would be put on a waiting list and would have an apartment on August 1st. June 26th [redacted] my fiancé paid a $450 deposit by money order to Ro the property manager. After not hearing anything from the manager by July 25th I called to inquire about the apartment and was told there was nothing ready but something should be by August 10th. Being that we already paid the deposit and was told we would have an apartment on August 1 I turned in my 30days notice to my current landlord and was almost moved out of the house. On July 31 I call again to inquire about the apartment. I was told we had a unit but when I asked about specifics about the apartment she could not or would not tell me anything. I have a son with a heart condition so I wanted to make sure we had a downstairs unit, there is a $20 difference in rent based on if the unit is on parking lot side or golf side. After a few minutes on hold all she told me was it was a downstairs unit, no unit number nor anything else. On August 1 Mr. [redacted] called to inquire if we could get our deposit back and was told no so he and I both went to the apartments to talk to the property manager about why we couldn't get our deposit back seeing that we had no where to move in to. The manager was in the next office with the door open and would not address us someone we had not spoken to prior to that day was assisting us. She stated that because Mr. [redacted] was upset and hung up the phone her manager told her to call the next person on the list an give them the unit. When I asked why the lady stated that Mr. [redacted] told them we did not want the unit,which he did not say that at all, now we have nowhere to move and she only refunded $200 of the deposit. According to the application the only reasons for them to be able to keep the deposit is 1) we do not sign the lease agreement within 24hours of them calling us, which never happened or 2) we deny the unit,again did not happen. I reached out to [redacted] in Fayetteville, AR and received a call back on August 11th but there was no resolution.Desired SettlementI woukd like for the Revdex.com to help us in getting the full deposit back and investigate why this hSas happened on more than one occasion.Business Response
