I am rejecting this response because: The response by The Group is a blatant lie
We too can surely provide documents, copies of text messages and emails to prove the truth of this matterThe only thing we ever asked of the builder was that the basement be finishedWe were told by the builder that we could not do this because Tom had locked us into a contingent contractShould Tom have been honest and not done this, we could have had the builder finish the basementWe understood the position of the builder and did not blame him, as we knew it was again a misdoing by Tom W***We moved forward with the builder and were excited to get our outside contractor's thoughts and visions for our basementWe were extremely excited for the new home and had even packed up half of our "sold" home in anticipation of the upcoming move! We had movers arranged, etc
We did indeed take issue with a previous real estate agent who represented both us and the builder of our current home, and acted as a dual agent for the transactionThis is specifically why we told Tom W*** that we did not approve of him representing the buyer of our home, as this created tensions in a past transactionEven though we explained this to Tom, he bullied us into continuing with his dual agent status by threatening to take "his" new buyers and find them a different home( We have documentation of this in an emai and several text messages to prove this conversation's true details)
With any transaction, there are always questions that come up and things to be addressed before closing on a newly built homeTom Wasburn's insinuation that we were unhappy with the builder or anyone else is just another one of his desperate, dishonest attempts to draw attention away from his misdoings by creating a distractionTom is again being dishonest, we can provide details and all documentation necessary.

The Group Inctakes customer concerns very seriously and are happy to comply with your request for our stance on this customer's experience. As you are likely aware, the Group IncReal Estate is a Leading Real Estate Company both locally and nationally, and we pride ourselves in providing exceptional service to our clients and customers for the past yearsOur customer satisfaction ratings across all our brokers is perennially points on scale of to 10.
We regret that the complainant is not satisfied with their real estate experience with The Group and its Associates/Partners and Managing Brokers. Note that they were also not satisfied with the builder who they personally chose to purchase their new home from, nor were they satisfied with prior real estate transaction experiences since moving to Colorado per their own admission. We are not at liberty to discuss the specifics of our contracts, processes and engagements with parties not affiliated with the transactions per the contractual confidentiality commitment to those clients
The complainant hired the Group to sell their home and assist them in the procurement of a new home which was executed according to their requests and direction. Should the complainant provide expressed written consent to do so, we would be happy to provide complete documentation, timelines and conversations that demonstrate that the Group Incand it's Associates/Partners and Managing Brokers always acted in the best interest of the complainant and the other parties involved in the transactions, according to their instructions and direction throughout the entire process. We are confident that these records will not only hold up in the court of public opinion, but also any judicial court of law. Despite their claims, there were never any delays in responding to their requests for action and information and we'd be happy to provide the evidence of those interactions demonstrating such with the complainants permissionWe even offered on multiple occasions to sit down with them face to face with management to discuss the issues to which they declined, instead, choosing to stay behind the keyboard, professing demands, hurling insults and making derogatory comments about its brokers and managers.
Of course we apologize for the transaction not working out positively, but it was not from lack of effort, care or competency on our part.

It's important to remember that the clients, not the brokers are the decision makers in real estate transactions and this was the case with the transactions in question. We would also like to point out that the complainant was quick to terminate their contractual relationship with The Group once the buyers of their home were forced to terminate their purchase contract with them due to a loss of contract on their personal residence sale. Despite their continued insults and derogatory comments we worked in good faith to assist them in terminating their purchase contract and receive a refund of their earnest money. Unfortunately the builder was out of town and could no sign the earnest money refund until September 8, 2016. As of today that has been signed, and, at our urging, their earnest money is being returned
