Initial Consumer Rebuttal /* (3000, 12, 2016/04/13) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I did call and speak with Mr. [redacted] and at that time he told me that I had to give written notice so I wrote a handwritten letter stating that I wished to cancel my membership. They seem to have lost that copy of the paperwork they say they have. The thing that doesn't make sense about any of this is that I have not paid ANY membership dues since 1/22/2015 when I CANCELED my membership. That's what I have been trying to say this whole time is that I haven't been a member since then. Why are they now sending a collection notice for one months dues? It makes no sense! I have not been a member of this gym in well over a year and it is criminal that they send me to collections for one months late dues that I don't even owe them. Furthermore I never received any kind of contact from The Gym stating I owed them anything if I had maybe this whole thing could have been avoided. It's not the money that is the issue I have with this situation it is the principle of being ethical and honest when running a local business.

Hello [redacted],My name is [redacted], owner of El Libre. I received a complaint letter from y'all, ID: [redacted].  I'm writing to see how I can contest this and put this issue to bed. This girl came in and ordered a double espresso and was charged $5.00 for it. She admits to ordering...

exactly that, a double espresso, in her complaint.  If you look at our menu (www.ellibrenola.com), you will see that our espresso is $2.50. Accordingly, if someone orders a double, they will be charged $5.00. $2.50 (single) x 2 (doubled) = $5.00. I took her order and made her coffee, and she the tried to tell my coworker that she was overcharged when I was working on the next customer's order. We have an iPad POS system, which shows the customer their order before they pay, so she clearly saw what she ordered. She payed for and received exactly what she ordered. From my take on the situation, she was trying to scam us to get her coffee at half price, and is now trying to defame us because it didn't work. I sincerely hope that y'all can see this for what it is, do the math, and not let this negatively affect our Revdex.com rating. Thank you.Best,[redacted]OwnerEl Libre

Review: I was a member of the gym because of their yoga program. I had joined about 2 1/2 years ago. Recently, Sage Yoga decided to leave the Gym. Members were given no choice at this point to break their contracts and were told we continue to have a yoga program. I initially spoke with the membership director and requested, kindly, that I be allowed to terminate my membership. I was told to draft an email. I did. I waited a week and resent the email to multiple emails. I received a response that the information had been passed along. I waited two weeks and spoke with the membership director. He informed he had done what he could and that my only recourse was to speak with the manager. I left a message with the manager that I would be pursuing a claim with Revdex.com and my bank, as the gym had continued to withdraw from my account at a higher fee. I have also pursued a claim with my bank to have that money returned. I am now waiting for replies. I have more detailed information if need be.Desired Settlement: Refund and termination of my contract with the Gym.

Response:

Dear Sir/Madam:

Please be advised that I represent THE GYM of [redacted], LLC with regard to the above referenced claim. Specifically,

Ms. [redacted] is contractually obligated to the terms and conditions of an Amrnal Membership Agreement

that terminates on November **, 2013 and is without right of cancellation.

In support of our legal position, I have attached a copy of the Annual Membership Agreement fully executed and initialed by

Ms. [redacted] on November **, 2012.

Per the Agreement, the contract start date was November** , 2012 and the end date is November **, 2013.

Ms. [redacted] not only signed this agreement but provided payment and initialed the paragraph

that specifically states the following; "THE TERM OF THIS CONTRACT IS 12 MONTHS.'' In addition, the same contract also

provides the following; "MONTHLY PAYMENT IS DUE REGARDLESS OF CLUB USUAGE."

Furthermore, the contract provides, the right of cancellation is limited to the following circumstances;

(1) Within 14 days from execution of the contract; or

(2) Per physician order of significant disability for a period in excess of six months; or

(3) Death of the member; or

(4) Move more than 25 miles from location

(5) Services cease to be offered as stated in the contract.

Ms [redacted] does not satisfy any one of the rights of cancellation. Her only claim is that "Sage Yoga" decided to

leave the Gym" yet admits that yoga is still offered at THE GYM. (The existence of Sage Yoga at the Gym is not a

condition written or specified in the contract executed by Ms. [redacted]) In fact, there are more than 27 yoga

classes offered our facility and at least four (4) of the yoga instructors from Sage Yoga are currently teaching

more than fifteen (15) different classes at THE GYM. Further, within the 46,000 square feet of our [redacted] facility,

there are not only yoga classes to attend but more than 150 group fitness classes offered

in addi tion to state of the art fitness equipment for her use.

In light of the foregoing, Ms. [redacted] is obligated to complete her contractual

obligation and her claims are without merit.
