searched back to the last recorded deed. In this case, Community Title Company searched back to 1977. It identified the ownership interest back to that date, and it included any and all liens recorded against the property. If a client wishes for the search to go beyond the last recorded deed and prior, it would have to be identified at the time of ordering. Community Title Company cannot comment and/or explain what other title companies supply and/or whether or not it comes in a folder. The information provided, was accurate and appropriate for what was invoiced.
OFFER:
Pursuant to the regulations as set forth by the Indiana Department of Insurance, Community Title Company has to charge for the work that was performed. In this case, title was searched back to 1977, all liens were identified, and a Title Property Report was issued, which is $175.00 at Community Title Company. That was the exact amount that was invoiced to the client, and therefore a refund is not an option pursuant to state regulations. Community Title Company is willing to offer the following:
1. Either perform a search beyond the last recorded deed and/or issue a Title Policy, in return for the consumer paying for whatever additional work to be performed pursuant to state regulations.
2. Provide a copy of the last recorded deed identified from 1977 at no additional cost to the consumer.
3. Reprint the Property Report, provide any of the items from numbers (1.) and (2.), and place them in a folder.
