Complaint: [redacted] I am rejecting this response because: I Totally Reject the Price Gouging offered by the [redacted] **as I ASKED THEM IF THE ACCEPTED MY INSURANCE 1ST & FOREMOST BEFORE EVER ENTERING THEIR FACILITY--NEVER WOULD HAVE ENTERED IF I KNEW THEY WERE DISHONEST PRICE GOUGERS!!!!!!!!!! Federal EMTALA regulations require hospital emergency departments to provide a medical exam, stabilize, and treat emergency patients without regard to patients' ability to pay Hospitals are subject to stiff fines and penalties if inquiries regarding financial status or insurance are rendered before emergency medical services Unfortunately for this patient, the patient's insurance plan explicitly stipulates health services are covered only within the Seton/Ascension facilities (historically [redacted] ) making the visit to the ER at The Hospital at Westlake Medical Center out of networkThe billing department would like to reach out to this patient to resolve this billing dispute and work with this patient to establish a payment plan for the services rendered The Hospital offers a discount to patients who are self-pay status depending on payment terms, such as 25% if paid in full

Per the Emergency Medical Treatment and Active Labor Act (EMTALA 42 USC Section 1395), every individual who comes to the hospital’s emergency department and requests a medical examination or treatment must be provided a medical screening examination, which must not be delayed to inquire about the...

individual’s method of payment or insurance status. This patient’s Medical Access Program is not a health insurance plan. The enrollee chooses a primary medical home which is the health center where they can go for care. This enrollee’s card shows that the health center she chose is CB BRACK, which appears to be [redacted]. We treated the patient first per EMTALA, and then inquired as to method of payment.
