2014, regarding your checking account ending in #### at The Huntington National Bank (“Huntington”).  Huntington received this matter on August 8, 2014, for review. 
A review of your account shows that the merchant attempted to debit your account $13.98 on May1, 2013, May 8, 2013, May 14, 2013, and June 4, 2013.  The four debit attempts were all returned unpaid due to non-sufficient funds in your account.  Each returned item was assessed a Returned NSF Item Fee of $37.50.
Please note the following information about electronic check return fees:
·         The electronic check initiated on your account was returned because there was not enough money in your account to cover the electronic check when it was presented to us for payment.  Each time we get an electronic check presented for payment that exceeds the account balance, the decision is made whether to return it or pay it. Please note that this decision to return or pay the check is based on customer history, amount of the check and account balance.
·         If an electronic check is returned because there is not enough money in the account to cover it, the check amount is not deducted from the account, and no overdraft occurs. For example, a customer’s checking account balance is currently $50, and a check he wrote for $100 is presented to us for payment. If we return the check instead of paying it, this account balance stays at $50 and there is no account overdraft.  Returned checks are subject to a fee.
·         If we pay it, the electronic check amount is deducted from the account, causing an overdraft. 24-Hour Grace™ applies only when we pay the check and an overdraft occurs. In that case, the customer has the opportunity to correct the overdraft by depositing sufficient funds on the next business day, at which time we could waive the overdraft fee. (In printed materials as well as our website description, it states that the 24-Hour Grace™ service cannot be used to waive return fees.)

The following is a summary of refunds and debits that were initiated by our collections department:
·         May 24, 2013: A courtesy refund of $100.00 for the Returned NSF Item Fees was issued with a verbal agreement that a deposit would be made within 24 hours
·         May 28, 2013: The refund of $100.00 was reversed because a deposit was never made
·         June 3, 2013: A courtesy refund of $81.28 for the Returned NSF Item Fees was issued with a verbal agreement that a deposit would be made within 24 hours
·         June 4, 2013: The refund of $81.28 was reversed because a deposit was never made
·         June 21, 2013: A courtesy refund of $100.00 for the Returned NSF Item Fees was issued with a verbal agreement that a deposit would be made within 24 hours
·         June 24, 2013: The refund of $100.00 was reversed because a deposit was never made
·         June 27, 2013: A courtesy refund of $100.00 for the Returned NSF Item Fees was issued with a verbal agreement that a deposit would be made within 24 hours
·         June 28, 2013: The refund of $100.00 was reversed because a deposit was never made
As a courtesy, we refunded $243.78 in fees to bring the account to a zero balance and we have closed the account.  We have also confirmed that your information was removed from Chex Systems on August 15, 2014.

Please know that we have completed a thorough review of this matter. Please note the following information:
Huntington Bill Pay Service:
As stated on our Bill Pay “List of your Payees” page in our Online Banking Service:
·         “Our Bill Pay cut-off time is 4:00 p.m. ET. However, any payment to a Huntington mortgage or personal credit line account made before 5:00 p.m. ET on a business day will be credited to the account as of that day and any payment to a Huntington credit card made before midnight ET will be credited to the account as of that day”.
We have attached a copy of our “Online Access And Bill Pay Agreement And Disclosure Statements” form for your review.
Your desired settlement you stated:
·         “This occurrence has caused me the amount of $300 in fees which I would like refunded”.
Our records show that on July 7, 2014 Huntington charged a $37.50 overdraft fee. This fee was charged because on July 6th, you overdrew this account by $39.88.
With our 24 hour grace service, you had the opportunity to have the pending overdraft fee from July 6th waived by completing a deposit on July 7th. The deposit must be enough to cover the overdraft from July 6th and any items that will post on July 7th.
Our records show that a $50 deposit was made on July 7th however an ACH debit to [redacted] loans in the amount of $159.74 was presented and paid by Huntington and the overdraft fee was assessed. Huntington refunded this overdraft fee on July 21, 2014 as a courtesy.

·         The last overdraft fee prior to July 7, 2014, that was not waived by our 24 hour Grace service was charged on October 4, 2013.
·         Since October 4, 2013, our 24 hour grace has waived 19 pending overdraft fees totaling $712.50.

Huntington called and left a message stating that we would be happy to refund fees on your account however we would like to discuss the account concerns with you.

Huntington received a deposit of $240.10. This amount paid the account to a zero balance and paid each fee that was charged.

it is not responsive to the complaint.  Specifically, I am the authorized representative to file the complaint and discuss all issues with Huntington Bank relative to the complaint.  Also, Mrs. [redacted] and I have suffered damage and injury as a result of the malfeasance complained...

of.  The only thing that Huntington has done was to send some paperwork to Mrs. [redacted], 6 days after payment in full was received.  As of yesterday, the RMV in [redacted] had not received the requisite documents to issue a title to Mrs. [redacted].  Because of the delay, a prospective buyer of the vehicle is no longer interested in purchasing the vehicle.  Huntington Bank is liable to Mrs. [redacted] in the principal amount of $48,000.00 and may be liable to  up to three times the amount of actual damages suffered, plus all costs of collection, suit and attorneys fees.  They are under a statutory obligation to respond to Mrs. [redacted]'s demand for a reasonable offer of settlement.

According to our records, a stop pay was requested on June 5, 2014, for the merchant [redacted] for the amounts of $1.00 to $250.00.  The merchant authorized a debit of $100.00 of the same day that posted to your checking account on July 6, 2014.  Huntington does not guarantee stop payments on debits or for the first 24 hours they are placed. 
On June 10, 2014, research case #####10Jun14 was submitted to attempt to recover the $100.00 debit from Strategic Funding that posted to your account on July 6, 2014.  We were unsuccessful in recovering the funds from the merchant.  The merchant supplied a copy of the service contract you signed in March of 2014.  We have provided a copy of the supplied contract for your records.

your checking account ending in #### Huntington received this matter on July 24, 2014, for review. 
As a courtesy, we have refunded two Returned Item Fees of $37.50 and one Extended Overdraft Fee of $25.00, for a total of $100.00.
We apologize for any inconvenience that you may have experienced due to receiving incorrect information regarding cut-off times for deposits.  Please know that when you overdraw your checking account, 24-Hour Grace® gives you until the financial cut-off time on the next business day to make a deposit to cover the overdraft amount, plus any current amounts that are pending or are presented for payment that day.
Example: If the account is overdrawn by $100, and a transaction for $100 will post to your account on the same day, a $200 deposit must be made by the cut-off time. Your account must have a balance of zero or higher by end of day.
 A deposit to correct the overdraft (as described above) must be made by the applicable financial cut-off time on the next business day. Financial cut-off times vary based on how/where you make the deposit.  Huntington recently updated the cut-off times for deposits on July 26, 2014.

Please know that when reviewing your account using Online Banking and the mobile application, checks and some electronic withdrawals from your account do not appear in the pending items.  Huntington is only made aware of their items during processing at the end of the day.  The key to avoiding charges for these items is to keep an accurate record of all transactions.
On July 17, 2013, you elected to Opt-Out for the paying of checks and direct debits from your checking account.  When Opted Out, if a check or ACH transaction is presented for payment beyond your available balance, regardless of the amount that it may overdraft the account, the item will be returned unpaid and a returned fee will be assessed to your account.
Please understand that the bank charges fees for returning items, and the merchant or payee to whom the transactions are returned may also charge you insufficient fund fees or other fees.

recent complaint filed through the Revdex.com (“Revdex.com”) regarding a $100.00 promotional offer for opening a new checking account.
Our records indicate that your checking account was opened on June 23, 2014 with a promotional offer for $100.00. The requirements for this offer include:
·         Set up a direct deposit of at least $50.00 within 60 days of account opening OR
·         Make 10 debit card purchases within 60 days of account opening
A review of your account confirms that a Mastercard debit card was ordered on June 23, 2014 and mailed to an address in [redacted]. This card was sent back to Huntington from the US Postal Office as undeliverable. A new debit card was ordered on July 11, 2014, and that card was also returned from the US Postal Office as undeliverable. On July 19, 2014, your address was updated and a new card was mailed to the above address. A review of the debit card indicates that the card was activated on July 31, 2014.
Upon review of your checking account, as of today’s date, there has been 6 debit card purchases completed and no direct deposit of at least $50.00 set up. Please understand that you have until August 22, 2014, to complete the requirements to qualify for the $100.00 promotional incentive.
Also, your account will be charged a Non-Huntington ATM Cash Withdrawal fee at the end of your statement period for using a Non-Huntington ATM machine. The fee is $2.00 for each time a Non-Huntington ATM machine is used and is charged in a lump sum at the end of the statement period. Your checking account was refunded 3 $2.00 Non-Huntington ATM Cash Withdrawal fees totaling $6.00 on August 1, 2014, as a courtesy.

Please understand for security reasons, as part of our check cashing policies we require appropriate id and endorsement of any check cashed at our retail offices for non-Huntington customers.  We need two forms of identification and a thumb print.  Please review the brief list below:

records show that your checking account was overdrawn $37.69 on August 27,
2014. Since your account has our 24-Hour Grace® service, the two
pending overdraft fees from August 27th would have been waived if we
had received a deposit to cure the overdraft by 11:59pm on August 28th.
            Since Huntington did not receive a
deposit until August 29, 2014. The pending  overdraft fees were charged to your
account. A copy of the

I was told that I could not be taken off of this account, that my ex had to be with me to sign papers.  I was also told that I could not just close the account.  My ex over drew that account and I went in to the branch several times with concerns.  I spoke to three different people and was told not to worry, that the funds would not be pulled from my personal account.  After my personal account was drained for the second time, I went back to the branch and was then told that I could close the overdrawn account.  I spoke to so many different people and was being told so many different things.  I was told that the off set could be reversed...but since the account was now closed that they could not do this.  I am so upset that this money was taken after I was told that it would not be.  My personal account is now overdrawn and I am getting overdraft fees. 
It seems that no one in the branch knew what to tell me, that they were all telling me something different.  The branch manager was the one who told me to call the collections dept to get my money back.  When [redacted] called the branch to verify this with the manager, the manager stated that he never told me to do this....yet he gave me the direct line for that dept.
Needless to say, I will pull my accounts and go to a bank that will stand by their word.  I have told many people of this situation and they are all shocked and taking their accounts and investments elsewhere.

have caused you.
Because we appreciate your business and we realize you feel that 24-Hour Grace® was not clearly explained to you, we have refunded $100 in overdraft fees on July 11, 2014 as a courtesy. Huntington has now refunded $156.00 in overdraft fees since October 15, 2013.
It may be helpful for you to understand how we determine if an account is overdrawn.  We immediately take “pending transactions” into consideration when paying items that are actually posting to the account.  For example, if you have a balance of $100.00, and you have a “Pending Transaction” in the amount of $60.00, we will consider your account to have an available balance of $40.00.  Any checks, debits or demands for payments that are presented for payment, and that exceed that $40.00 balance, could overdraft your account. 
24 Hour Grace®  allows you to avoid the overdraft situation provided that you deposit sufficient funds to cover the overdraft as well as all other items that are “pending” or deducted from your account that day, so that, at minimum, your ending balance on that day is $0.00 or higher. 
If your balance is less than $0.00 when all debits and pending transactions are subtracted from your balance, 24 Hour Grace® will not apply.
For additional information, please review the “Agreement and Disclosure of Account Terms and Rules and Regulations for Consumer Checking Accounts” originally given to you at account opening. A complete copy is available upon request.
Please direct your attention to the section titled “Timing of Transactions”.  This section specifies how pending items will be taken into consideration.  Special interest should be given to the information in regard to check card transactions and transactions initiated after the financial cutoff time.  You may also want to review the information in regard to making deposits.
Your account activity on July 7, 2014 shows a beginning balance of $774.15.
At the close of July 7th business day, Huntington paid an item for you when you did not have the available funds. In order for the 24 Hour Grace® service to waive the pending overdraft fee from July 7th, you would have needed to make a deposit of at least $97.28, plus an amount that would bring the account to a zero or higher balance on July 8th.
Your account activity on July 8, 2014 shows a beginning balance of -$87.10.
The pending overdraft fee was not waived by our 24 Hour Grace® because this account was not brought back to a zero or higher balance by the end of the business day on July 8, 2014.
At the close of July 8th’s business day, Huntington paid 3 items for you when you did not have the available funds. In order for the 24 Hour Grace® service to waive the pending overdraft fees from April 24th, you would have needed to make a deposit of at least $154.78, plus an amount that would bring the account to a zero or higher balance on July 9th.
Your account activity on July 9, 2014 shows a beginning balance of -$150.71.
Please note the following information about return fees:
The 2 pending overdraft fees were not waived by our 24 Hour Grace® because this account was not brought back to a zero or higher balance by the end of the business day on July 10, 2014.
Your account activity on July 11, 2014 shows a beginning balance of -$207.28.
Since the account was brought back to a zero or higher balance by the end of the business day on July 11, 2014, the pending overdraft fee was waived by our 24 Hour Grace® service.
·         Checks or internet (ACH) transactions written on your account were returned because there was not enough money in your account to cover the transactions when they were presented to us for payment.  Each time we get an item presented for payment that exceeds the account balance, we decide whether to return it or pay it. Our decision to return or pay the item is based on but not limited to the customer history, amount of the item and account balance and past or current bankruptcy.
·         If the transaction is returned because there is not enough money in the account to cover it, the transaction amount is not deducted from the account, and no overdraft occurs. For example, a customer’s checking account balance is currently $50, and an item he wrote for $100 is presented to us for payment. If we return the transaction instead of paying it, his account balance stays at $50 and there is no account overdraft. Returned items are subject to a fee.
·         If we pay it, the transaction amount is deducted from the account, causing an overdraft. 24-Hour Grace® applies only when we pay the item and an overdraft occurs. In that case, the customer has the opportunity to correct the overdraft by depositing sufficient funds on the next business day, at which time we could waive the overdraft fee. (In printed materials as well as our website description, it states that the 24-Hour Grace® service cannot be used to waive return fees.)
Please be aware, the key to avoiding this type of fee is to maintain an accurate check register.  While our Voice Response Unit can assist you in doing so, it is the responsibility of our customers to know the balance in their account.

accordance with the account “Agreement and Disclosure of Account Terms and Rules and Regulations for Consumer Checking Accounts” (“Rules and Regulations”), Huntington has the right to “set-off” one Huntington account owned by you to pay an outstanding debt to another Huntington account owned by you. A copy of these disclosures is available upon request.
Since an agreement could not be reached to pay the balance owed to your Huntington checking account number ending in ####  Huntington used our right to “set-off” your account number ending in ####
After the August 4, 2014 “set-off”, the balance owed to your account number ending in #### was $229.28. Huntington waived this balance and closed the account at your request.

realize you feel that
24-Hour Grace® was not clearly explained to you, we credited you $37.50 for an Overdraft Fee and a $25.00 Extended Overdraft Fee as a customer courtesy.
When you overdraw your checking account, 24 Hour Grace® gives you until the financial cut-off time on the next business day to make a deposit to cover the overdraft amount, plus any current amounts that must be paid.  You need to deposit enough to bring your account balance to at least (-$4.99).  Of course, if you can get your balance out of the negative, please do. But we give you a $4.99 cushion in case you can’t quite make it all the way.
Example: If the account is overdrawn by $100, and a transaction for $100 will post to your account on the same day, a $196.00 deposit must be made by the cut-off time.
Please understand that transactions are processed every business day.  The days that transactions are not processed are Saturdays, Sundays and holidays, due to the Federal Reserve being closed. When the cash deposit of $108.00 was made on Saturday, August 30, 2014 it was not a business day and was processed September 2, 2014 but because it was a cash deposit it was immediately available.
 24-Hour Grace® would have covered your original overdraft however you had 2 other debits that posted on September 2nd also. Those debits are [redacted] for $51.78 and [redacted] for $379.30. This caused your end of day balance to be -$430.70 which exceeds the -$4.99 cushion provided and caused you to receive the Overdraft Fee of $37.50 and an Extended Overdraft Fee of $25.00.

As a courtesy, we have refunded one non-sufficient fee of $37.50. 
This letter is to explain the method we use to determine the balance used to pay items presented against your account and to eliminate the possibility of utilizing the same funds twice.  What this means to you is that we are immediately taking “pending transactions” into consideration when paying items that are actually posting to the account.
A review of your account activity on July 10, 2014, shows a beginning balance of $130.86.
 
The account activity on July 11, 2014, shows a beginning balance of -$474.94.
When you overdraw your checking account, 24-Hour Grace® gives you until the financial cut-off time on the next business day to make a deposit to cover the overdraft amount, plus any current amounts that are pending or are presented for payment that day.
Example: If the account is overdrawn by $100, and a transaction for $100 will post to your account on the same day, a $200 deposit must be made by the cut-off time. Your account must have a balance of zero or higher by end of day.
 A deposit to correct the overdraft (as described above) must be made by the applicable financial cut-off time on the next business day. Financial cut-off times vary based on how/where you make the deposit.
Each banking office has a local cut-off time posted.
ATM - Before 2:00 p.m. (unless a later time is posted on the machine)
Online Banking or Telephone Banking transfer - Before 10:00 p.m.

Please know that when reviewing your account using Online Banking and the mobile application, checks and some electronic withdrawals from your account do not appear in the pending items.  Huntington is only made aware of their items during processing at the end of the day.  The key to avoiding charges for these items is to keep an accurate record of all transactions.

I’m writing in response to
your rebuttal filed with the Revdex.com (“Revdex.com”) regarding Huntington
National Bank (“Huntington”) right to set-off a balance owed on your Personal
Line of Credit (“PCL”) ending in ####. 
Huntington received this matter for review on August 28, 2014.  The position of the Huntington has not
changed.
I have reviewed your concerns
regarding your assertions of a double payment made to your PCL in April
2014.  Huntington received a $100.00 payment
on April 25, 2014.  The $100.00 was
applied as follows, the minimum payment due was $80.46 and was applied to your
March 2014 payment and the remaining $19.54 was applied towards April 2014.  As no other payments were received,
Huntington set-off $143.64 on August 13, 2014. 
The $143.64 was applied as follows, $62.05 was applied towards your
April 2014 payment, to complete the minimum payment due, and $81.59 was applied
towards your May minimum payment.  Your
PCL is still past due for your June 2014 payment.
I do apologize to both of you
for the service issues you described and have addressed your comments with the
management.  Although we regret that you
may remain dissatisfied, we have no further information to provide at this
time.  Per your Personal Line of Credit –
Variable Rate Agreement and Disclosure, Huntington had the right to set-off as
the PCL is in default.

As admitted by Huntington, [redacted] authorized Mr. [redacted] to serve as her representative in this matter.
As
admitted by Huntington,  $19,663.67 payment was received on July 2,
2014. This payment was posted to the account effective July 2, 2014 as a
payoff. 
Huntington has
admitted in conversations that it routinely holds consumer payoffs (even
those made by certified funds or electronic payment as was the case in
this instance) for a period of 5 days.
As
admitted by Huntington, only after threatened litigation against
Huntington and complaints to the Revdex.com and the Office
of the [redacted] Attorney General did Huntington make arrangements
on July 8 (6 days after receipt of payment) to send the required
documentation to release the lien so that the documents would be
received on July 9, 2014 - - -7 days after receipt of payment in
certified funds.
On
July 9, 2014, [redacted] did personally appear at the [redacted]
office of the [redacted] Registry of Motor Vehicles where they
confirmed only receipt of the required paperwork from Huntington
National Bank and that the title had been printed on July 7, 2014, but
could not confirm mailing thereof.  As of the writing of this reply (on
July 14, 2014) Mrs. [redacted] has still not received the title.
It
is undisputed that, as a result of the delay in processing the required
paperwork to release the automobile lien by Huntington, Mrs. [redacted]
has suffered substantial damage and injury, including but not limited to
an interested buyer of the vehicle declining to consummate the
agreement to purchase the subject automobile for $48,000.00 due to the
inability to provide the requisite Certificate of Title caused by Huntington.
Huntington has made no offer of settlement of the claims of Mrs. [redacted] as of the date of this writing as required by [redacted] consumer protection law, M.G.L. c.93A, or otherwise.

April 1, 2014:
When you and your son [redacted] came into our [redacted] to close your money market account, our banking office manager [redacted], discovered that your did not agree with what your son wanted to do with the funds. [redacted] stated that he wanted the funds to be placed in mutual funds.
[redacted] asked that you go into a room to verify that you wanted to close the account and to discuss the risks of mutual funds. Since you stated that you did not want any risk with your funds and your son was demanding that the account was closed, we chose not to close the account at that time.
April 2, 2014:
Your broker contacted our private financial group asking if you could come to their office to close this account. [redacted] assisted you in the closing of your money market account. We verified that you did want to close the account and deposit the funds with a broker. At this time, Huntington waived the $25 early termination fee as a courtesy.
[redacted], we sincerely apologize for any inconvenience this matter may have caused you. I have enclosed a check for $10 as a token of our appreciation for your business, as well as our regret for your unsatisfactory experience.
