I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:The *** *** *** did say that not having a job at the moment would not be an issue, but I could get Insurent, a guarantor, or pay the whole year up frontI used Insurent to get my mother a luxury apartment, not used for me*** was told about that and I said I would refuse to do all three, but she still went along with taking my application fee*** (***) was not presentI am being 100% truthfulThe *** was to call me that weekend and I told her I needed an email for verification, since I explained the whole issue on her voicemailWhen I receive the email, which I have not received and the application fee back in my bank account, I will not accept the offerUntil then, no, I will reject it secondary to the dishonest way my application fee was taken and no offer or refund of the application fee was given in email, as I requestedUntil then again, I will reject this offer until I get an email and full refund back from this apartment buildingAgain, as you can see, I never used Insurent for myself, this is not true, I told *** that I used it for my mother's apartment!

The complainant came to view apartments on May [redacted]. She told the [redacted] that she was receiving severance pay. We said that we would try and get her approved using the severance pay. The...

[redacted] did not say "not having a job at the moment wouldn't be an issue". The [redacted] explained that she may need to get a guarantor or use Insurent. She said that she was familiar with Insurent and had used them before. We were unable to get her approved based on her severance pay. We explained that she would need to get a guarantor or use Insurent. She said that she would not use Insurent and that she was misled. She asked the [redacted] for us to refund the application fee. The [redacted] stated that she would need to speak with me. I called and sent her several emails trying to discuss the situation to come up with a solution. I did not want her to feel as if she had been intentionally mislead in any way. I was mo re than willing to return the fee. She sent me an email stating that she was too busy all week to discuss. The last email correspondence was my reply asking her to call me when she was free over the weekend. I never heard back from her. I will reach out to her by email again to state that we will refund the application fee.

Review: I went to look at an apartment at Parker Tower in Forest Hills. I was attended to by [redacted], rental agent, on May *, 2015. She took me to see a couple of studios that were available for June 2015. I became interested in one, but told [redacted] that I was just laid off from my job as a RN [redacted] and was actively searching for a new job. I also told her that I had enough in my bank account to be safe in paying the rent on time, in addition to receiving severance pay until the [redacted] week of June. She told me to email her my bank statement, which I did the next day. When I was with [redacted] on May [redacted], she called someone in charge who said "not having a job at the moment would not be an issue." She also said I could apply for Insurant or pay one whole year up front, which I refused to do. She then continued to say I would get the apartment without this and to pay the $125.00 application fee for their third party to check my credit. On Friday, May [redacted], I received multiple emails and calls from their thrid party "[redacted]," telling me that they called my former [redacted] who told them to go to The Job Site to verify my employment or to pay [redacted] to do this for me, to get the key to get into The Job Site. I emailed [redacted] who said she would contact them to let them know about my lay off, and never did. I called OnSite.com and requested to stop the harrassment I was receiving from them and to stop the credit and job checking. They agreed. I called [redacted] and emailed her to ask her to keep my bank account information and other personal information safe for me to pick up and because she was not truthful about me not getting the apartment without a present job, I wanted my application fee returned. She told me to speak to her [redacted]. I received multiple voice messages from [redacted] ###-###-####. I left her a message stating the issue and request for my application fee back. She never responded in email, which I requested and as of May **, 2015 I've not heard from her.Desired Settlement: I want my $125 application fee back because [redacted] at Parker Towers was dishonest in renting an apartment and should have been truthful about not being approved without a present job. I was harrassed by their third party both via email and phone calls. [redacted] knew that I was not going to get Insurant or pay a full year up front! I told her I was not desperate and it would be throwing away $125 that I need. Also, [redacted] refused to email me, which I prefered, for proof of what she said.
