We were residents of the Jamison at Brier Creek apartments for 5 months while our house was being built. We moved out on April 29, 2014, and returned the apartment key to Management when we left so that they could attempt to lease the apartment to another tenant prior to the expiration of our lease. Since we had a lease that ran until June 15, 2014 we continued to pay our rent. We were notified that the apartment was leased 3 days prior to the end of our lease and shortly thereafter we received a check from the Jamison refunding our deposit plus a credit for the 3 days that the apartment was rented by others prior to the expiration of our lease. Subtracted from this refund check was a charge for water and sewer for $38.56 covering the last month of our lease. Bear in mind that we were not in the apartment during this time period. The water and sewer bill for the previous month, when we occupied the apartment for two weeks out of the month was $33.25. The highest monthly bill we got when the apartment was fully occupied was $47.35. We paid our monthly water and sewer bills directly to [redacted] except for the last month when the Jamison deducted the $38.56 from our refund. We never saw the bill from [redacted] for the last month as opposed to the bills for the previous months when the monthly water and sewer bill was sent to us. Upon receipt of the refund check I wrote to [redacted], Assistant Manager at the Jamison at Brier Creek, asking for an explanation of how the water and sewer bill could be so high when we weren't in the apartment for the entire period, and why it was higher than the previous month when we were there for two out of the four weeks. I asked if there was an error in reading the water meter. I requested a refund when they found the error. Thus far, almost 3 weeks later, I have not even had the courtesy of a response to my request.Desired SettlementI would like to receive a check refunding the $38.56 charge for water and sewer for the month that we were not in the apartment. If there is a minimum charge for water and sewer even when none is used, I would like to receive proof that the charge is in line with regulations, and if so, the minimum amount should be subtracted from the full refund.Thank you.Business Response #XXXXXXXX I have spoken with the consumer. I haven't received the refund yet.Final Business Response The paperwork for the refund is being sent today 8/4/14 to our corporate office so a check can be mailed to you. You should have the check by 8/14/2014.
