On 10/23/2020, I moved into the Landing At Cross Creek Apartments. The apartment complex has a 35 pound limit for dogs. In January of 2020, a 110 Lb Black lab moved into the apartment above me and shakes my walls and prevents me from sleeping. I went to speak with my apartment manager, ***, the first week of February 2020, about the issue. *** advised that the dog was not on the lease and was not authorized to be at the complex due to the size restrictions. The dog remained on the property after *** advised she issued 2 lease violations. I went to *** again on 2/16/2020 to express my concern and at this time *** advised that the tenant was not responding to her attempts at communication and that the dog was not a service dog so it was not allowed on the property. *** foreshadowed what was about to happen and was very clear that if it were a service dog there was nothing she could do. On this same date, I sent *** video of the dog committing a blatant lease violation. On 3/3/2020, I went to *** again asking about the dog and she became upset while stating that the dog should not be on the property and stated that the dog should not be on the property. *** advised that the situation would be taken care of and she would reach out to me by the close of business that Friday. On 3/9/2020, I went to *** after not hearing from her. On this date, *** advised that the dog was now a service dog and there was nothing she could do. I have now suffered from sleep deprivation and emotional stress due to ***’s negligence in providing another tenant a means to circumvent the lease restrictions for this property. I am hoping this complaint will provide a remedy before legal counsel is sought to remedy the situation through litigation. If the matter were to go to litigation, it would show the dog became a service dog after my complaint through basic discovery.

#***Please see below the events that took place regarding Mr.
***’s complaint regarding the Service Animal. 12/30/2019 – *** had his girlfriend, ***i
Cooper, added to his lease contract and they came in to sign the Roommate
Amendment. While in here signing they mentioned how the animal above them was
loud, but they knew it was an apartment and that there is noise. I did not take
this as a formal complaint of any kind regarding the animal. 3/5/2020 – *** came into the office stating
that animal was off the leash and was extremely loud above him and wasn’t even
an animal that should be on property as it is clearly over 35lbs. I let Mr.
*** know that I would reach out to the resident to gather more information
regarding the animal and immediately address the pet not being on a leash. 3/5/2020 – I left a voicemail for the resident in
#421, Clayton Crawford, to discuss the animal in the unit, as well as the fact
that it wasn’t on a leash.3/6/2020 – I spoke with Mr. regarding the animal,
which he informed us was an assistant animal. I let him know that we were not
aware he had an animal as it wasn’t marked on his application, and that we
would need to provide us with all the corresponding paperwork for the animal.
He apologized, as he wasn’t aware of the regulations associated with his
service animal. He provided us with all the correct documentation. We also had
a conversation regarding the animal being off a leash when taken outside. I let
him know that although it is a service animal, it still must follow the same
rules as the other animals on property. He completely understood and was
apologetic. He explained to me that the animal is trained to not leave his
side, so he didn’t think of it. He said that it would not happen again. 3/9/2020 – Mr. came into the office and
by-passed the Assistant Manager, *** when she greeted him back to my
office. I asked if he would have a seat as he was clearly angry, but he stayed
standing. He stated that the animal was extremely loud and he demanded to know
what was being done in regards to the situation. I let him know that I spoke
with the resident and it was in fact a service animal. He then said, “You mean
a “service animal” that you instructed him on how to make one”. I let him know
that was not the case and tried explaining to him how the laws have changed
regarding service animals. He wanted to know if I was going to “make the
resident move” or if I was going to let him out of his lease with no fees
associated due to the animal. 3/12/2020 – I spoke with Mr. and let him know
that the resident above him would not be moving, as we do not have any first
floors to offer to him at this time. He asked what he would cost him to break
his lease, so I let him know that is a 60 day notice, Reletting Fee and
Concession Payback. He laughed and stated that was not acceptable due to the animal
that “isn’t even a service animal” issue. I let him know that I would waive his
60 day notice, but that they Reletting Fee and Concession Payback would be
required. He wanted me to send everything to him and stated that he would be in
the office on Monday, 3/16/2020 around 4pm after he had the weekend to discuss
with his girlfriend what they wanted to do.3/17/2020 – Mr. did not come into the office
yesterday. I left a voicemail for him seeing if he wanted to re-schedule.3/18/2020 – Called Mr. and he stated that
their work is extremely hectic right now, as they are both State Troopers. He
said that he would get with ***i and let me know a good time for them to call
in and discuss the email regarding the Early Termination Fees.Thank you, ***The Landing at Cross Creek
