[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because:Attorney Somerville is being untruthful in her statements and representation of the events Additionally, the sarcasm within the letter is shameful at best For MsSomerville to make the statement, "So I can only assume that she doesn't want a refund, and she doesn't want the documents." is completely unprofessional, and only lends itself to an emotional response to my right as a consumer standing up for myself Attorney Somerville has provided my request to have my monies returned, and that is still what I am requesting to resolve this complaint Yes, I do want my hard earned money I am an elderly woman, in her retirement years and 1,dollars is a lot to me How can MsSomerville live with herself and even pose such a sarcastic question? As far as the document/release that MsSomerville sent after I requested my funds, which I see she did not provide within her response, it was blackmail Attorney Somerville stipulated that she would return my funds, minus a consultation fee that was never discussed, agreed to, or in contract form, only after I gave up all legal rights to pursue any court action This was another attempt to take advantage of me as a senior citizen I have no desire to purse court action with Attorney Somerville as long as I receive my refund, which was my original request That is the only thing that I want from her, as I would like to get on with getting my affairs in order while I still have life in my body I am once again, requesting that MsSomerville return my monies to me I can make arrangements for a Cashier's Check to be picked up and sign receipt of funds and she and I can end all communications or matters This is not good for my health and peace of mind Kind Regards, [redacted] ***Regards, [redacted] ***
September 15, 2016Dear Revdex.com:I am in receipt of your complaint filed by the complainantShe came to me as a friend of my mother's and church worshiper and asked that help draft a trust for hermet at her home on March 20, agreed to draft the trust and she agreed to make payments until the agreed upon $was paid.Each time a payment was made, I sent the complainant a billing statementAll of which are attachedThe last invoice missed a payment however, her final invoice shows that all $was paidThere is no dispute as to the fact that she and I verbally agreed to have a trust drawn up by me for the sum of $1500.00.The complainant and l attempted to meet to sign off on the documents and she indicated she had some changes (at this point all work was done)Emails will show my multiple attempts to meet to finalize the documentsOn June 24th, it appeared that the complainant became upset because I was unable to talk to her as I was rushing to the hospital due to my mother in law having a massive strokeI called the complainant and emailed the complainant to explain the emergency I had experienced that dayThe next day, my mother in law passed awayThe complainant wrote me an email without any explanation requesting money back.I wrote in an email to the complainant that I had already drafted and completed her documentsI was waiting until she completed paymentI mailed the complainant trust documentsI even sent the complainant a letter agreeing to refund her with her agreement to sign the release so that I can release the funds as I am not obligated to do so given the work was already performedWithout a response to this letter, I again, sent the documents via certified mail and she has apparently refused to accept them also as I have not had a responseSo I can only assume she doesn't want a refund and she doesn't want the trust documents.I was notified by my mother that the complainant wrote a letter to my mother's home indicating that I stole her moneyThis is disparaging and inaccurate and unprofessional as my mother has nothing to do with my law practice.I have been practicing law for over years without one complaintI extended a discounted price to a friend of my mother's given their relationship and that they attend the same churchI completed the work and delivered her documents as promisedThere is no basis whatsoever for this complaintThe complainant has received the documents and cannot now decide she wants her money back.All communication with this complainant is hereby attached.Aretha Somerville, Esq
