I have spoken with MrsR*** about this matter And, I am very sorry that you seem disappointed with our services Your case has been closed with a significant balance owing now for over six months I wish that I had learned of your
dissatisfaction sooner
As for your current outstanding balance, our fee agreement is very clear with regards to retainers And, both MrsR*** and I apologize if there was somehow a miscommunication MrsR*** has handled hundreds of family law matters while working at my offices, and this is honestly the first time that there has ever been any confusion about our fees or our billing process in all of the years that she was worked for me
Indeed, every contested family law case has the exact same language regarding our fees We do not charge flat fees for contested cases Instead, we bill on an hourly basisIn reviewing the fee agreement in this case, again, it is the exact same language that our offices have used in over prior family law cases over the last ten years
Clients pay us an initial retainer, and we bill off of this retainer for work that is performed If the amount of work required goes over the initial retainer, then additional fees are required Again, if there was some confusion here, we apologize We strive to ensure that every client clearly understands our fee structure and our billing procedures from the onset of their case
This case was also not as simple and straight forward as Mr*** indicates or alleges He retained us for a child support modification case here in King County This type of action is not a "simple" hearing It is a trial But, it is different from other "trials" It is a trial by "affidavit" Most of the work on this case was done in collecting and organizing financial documents for the court, researching the legal issues, preparing child support worksheets and in strategically framing the issue of post-secondary support
The opposing party in this case demanding Post-Secondary support for one of their children, which we successfully fought We successfully argued that the mom's request was untimely The Court completely denied her request, thereby potentially saving our client tens of thousands of dollars in college expenses
The opposing party was also trying to modify the child support I can understand the client's frustration with the court incorporating his overtime, but the court set his child support based on the Washington Child Support Guidelines We have no control over these guidelines
We argued that the amount of overtime pay that should be considered in this calculation was less than our client had made in the prior calendar year In these kinds of cases, however, the court has wide latitude and tremendous discretion to review historical earnings and set child support based on their best estimate of future earnings
This case required extensive preparation, legal briefing, and court time. As a result, it went over the retainer Again, we apologize for the confusion.
In speaking with MrsR***, I am also confidant that she had a full a complete knowledge of this case, the relevant facts, and the salient legal issues involved In all the years that she has worked for me, I have never once heard her stammer or stutter in court We firmly stand behind our work this case
In the interest of resolving this matter amicably, however, we are willing to write off the client's remaining balance We never want a client walking away from our firm feeling as if they did not get good value for their money
