Management refuses to refund my Application Deposit because they said I wasn't forthcoming on application regarding a previous eviction.

On April 20, 2020, I applied for an apartment with Lecacy at Cedar Hill. Initially, their online message gave me indication that my application was approved. However, when I called to inquire about further information regarding occupancy, I was told by a representative that identified herself as "Tae" that my application was denied. This occurred on April 22, 2020. She explained that my app was denied because my credit report revealed I had prior evictions. Based on this information, she explained that my application deposit of $431.95 would not be refunded because I wasn't forthcoming about an eviction. During this time, I explained that I wasn't cognizant of the fact that this information was on my report.

I have read their contract in the entirety. Unfortunately, I have NOT located any statements that indicated my application deposit would NOT be refunded based on the information shared with their company's representative. It was my understanding that if not approved that the (application fee) was non refundable but my (application deposit fee) would be returned. According to your "Application Qualification Standards" handout, if a person is "Not Approved" then the application deposit will be refunded or retained for liquidated damages if a person fails to sign or withdraw the application.

No liquidated damages have occurred and I haven't failed to sign nor have I withdrawn the application.

Management contacted me on April 29, 2020 after I submitted a demand letter. They are now telling me that my application deposit is being held for two days they held the unit for me. My question is, if I wasn't approved how am I being charged for this? Also, even if they are holding my deposit for occupying a space "I was never approved for" shouldn't that be at least prorated to a daily amount? I'm certain two days of stay isn't $431.95.

I'm asking for my full refund of $431.95. We are in the midst of a pandemic where most folks aren't paying their rent. I am blessed to be still employed. I am a young man looking for housing and while I may still be employed I don't have $431 to throw away while still seeking housing with less funds now. Where is the compassion? They should feel ashame of themselves. Very lowdown practices.

Applicant fail to make us aware of some issues on the credit, that goes against out leasing criteria that he signed. Per the TAA applications we use, we have the right to hold a deposit for falsifying documents or withholding information that would cause application denial.

on 03/15/20 gave $75 x 2 for appl & admin fee, $ 350 deposit, requesting refund for deposit
on 03/14/20 I was inquiring on a 1bdrm x 1bth, due to 1week into a separation after nine yrs of marriage, liked the model is was shown, 03/15/20 return to legacy gave $500 for fees. On 03/16/20 after getting to work I was told there cutting hours due to coronavirus, it ended where they closed the department I was working in, as soon as I knew the office was opening I called to say what happened and I had to cancel and then is when Chelsea told me I was approved, this was all done less than 24hrs, Chelsea the representive told me I was able to pick up the deposit fee, less than an hour later I received email that the manager states I couldn't get the $350 deposit back, I understood the application & administration fee was not refundable, with everything going on I feel that was very very unfair, no kind of consideration what crisis people are having to deal with, there was no leasing contract sign. And was given excuse that this was fair housing rule, I called FHA that's not there rules and recommended legal action. I spoke Nelley the assistant mgr, I asked to speak with the manager and was told she's not changing and was not given a name or able to speak to her. NEED HELP

There was never a lease involved which means there was no move in date established. I notified them on 3-16-2020 that I could not go through the process due to lay off at my job, during the Coronavirus pandemic. Yes, my credit was approved but I was not aware until I called to notify them that I no longer wanted to pursue the process. The specifications of the application deposit were inaccurate. The representative (Chelsea) told me that the application deposit would be the same as the security deposit, and it is not. I have provided a copy of the document, proving the false information. My understanding of the Application Deposit was never clarified. Please do further investigation of when the application fee was actually submitted and show documentation of the approval process. I feel as if the approval process had never taken place. I called Monday 16th of March at the opening of the office (10am)so I'm just not fully confident it was ever done. Please provide date and time on the documentation where everything had been approved. Thank You.

Correct, this is exactly what I have provided. Yet, there is still no evidence of a solidified move in date. I did APPLY for the apartment, but no LEASE CONTRACT was ever brought up. If you have proof of a CONTRACT, with a move in date, then please provide it, but you most certainly wont because I, MYSELF never signed a LEASE with a move in date. I will just go ahead and provide this information to the corporate office.

Apartment flooded on 11/23/19 from neighbor's area. Unresolved repair issues, use of personal toilet by staff without flushing, faulty repair survey.
Apartment flooded caused from neighbor's washing machine on 11/23/19 while they were moving. Wet carpet was not removed until 11/25/19 after conflicts with Ashley and Vanessa ( Managers at Legacy Apts ). Ashley told me that she has Floor replaced to areas except bedrooms and closets x2. Vanessa reported on 11/25/19 that carpet had to be ordered. No calls have been received regarding carpet replacement as of 12/18/19. On Wednesday ( 12/11/19 ), guest bathroom was found with urine and tissue in toilet that had not been flushed, staining to toilet top and bottom, frame in guest bathroom knocked over with stains on medicine cabinet. Maintenance requested for 3 repairs in my apartment which included malfunction to switch related to garbage disposal, broken toilet seat, and laundry door not closing or opening properly. Received email via residential portal system that repairs had been completed when in reality no repairs had been completed. On top of that, survey sent to rate repairs. Of course, I rated an frowning face as displayed with comments. Either happy or sad face to rate satisfaction. Office visit at Legacy on 12/12/19. Spoke with Uche regarding above matters. He resubmitted all 3 repairs and apologized. Reported that Vanessa was out that particular day but he will leave information regarding carpet replacement on her desk for her to address. I have made several calls and left messages since last week and this week to Element National Management ( Corporate Office ) at XXX XXX XXXX but thus far no one has returned my call. Spoke with Tae at Legacy on 12/17/19 at 1148 am regarding secondary number for corporate office. Tae informed me that she will call me back with information. Of course, she did not. Spoke with Tae again this morning at 1015 am and reported that I needed to speak with a manager. When asked to speak with one, I was told that all managers are out on the property and to call back in an hour or manager will call me. I will not be expecting a call though. Just another lie!!!! My lease is up on January 31, 2019. I am attempting to contact corporate office to terminate my lease at the end of this month due to unresolved issues. I will definitely be moving that's for sure!!!!! My master bedroom and closet has partial carpet and partial concrete extending to the closet which has been this way since 11/25/19. No incentives were given or offered. When asked, I was told " No " and that I should make a claim with my renter's insurance. I was not offered to move to another apartment or sent to Hotel. By that Monday ( 11/25/19 ) the apartment smell from the wet carpet was ferocious!!! Mangers did not want it removed. Stated that Maintenance would be there on Tuesday ( 11/26/19 ) to change flooring. Explained to Ashley ( Manager ) that was a health hazard and she said that she has stayed at a home with wet carpet. Who tells a tenant something such foolishness!!! As of today ( 12/18/19 no repairs have been made and no one as ever attempted to follow up with me. And these women are supposed to be managers!!! I have been a resident at this complex since January of 2015 and has never experienced anything like this. My rent has been paid on time during my entire time at this complex. Enough is Enough!!!!!

I would like to terminate my lease this month instead of waiting until January 31, 2020 because I have become very uncomfortable due to staff entering my apartment without authorization and unresolved issues with repairs!!!!!

There was flood that happen in her apartment, in which we took the necessary action to repair all damages in a timely fashion. She was unhappy with the process of completion and requested to be released for her lease contract one month early. We granted her request with no penalties.

I have spoken to Ms. and she is in the process of suing the towing company. As a company, we are also investigating the integrity of the tow company to determine if we need to change companies. We have already changed the access in which they have as a precautionary measure until we get back all of our information. Her claim is against the towing company, not Legacy of Cedar Hill Apartments.

I do not accept the response from The Legacy Of Cedar Hill. They never cooperated with me on this matter . I have reiceve rudiness from them , bad coustomer service . I filed law suit , against them , just wait hear from court . I have had nothing but bad experience with this apartment complex .

To whom this may concern,
I am writing to you because there has been very poor management and performance through the Legacy of Cedar Hill office staff located at *** TX XXXXX. First and for most, I want to take a moment to thank you for having a wonderful place to live. The maintenance and grounds keepers are very welcoming and professional. They ensure that everything is taken care of immediately. I enjoy residing at this location, but as of late, the office staff has been lacking in professionalism and responsiveness to various inquires, which I will explain in detail below.
First, I have received information that would allow me to renew my lease in September. I have contact the office numerous times to let them know I was not given the link through my email, as indicated in the renewal letter. Finally, days before the renewal of the lease was due, I walked to the office and requested additional information. They indicated I would need to supply them with the AN email to have the lease given, which was the opposite of what was in the renewal letter. A day after, I signed the lease renewal. Then on October 1st, I noticed that the amount being charged was not what was agreed upon in the lease. So, I emailed them asking what the difference in the charges were, and received no response. I called 3 times, again with no response. I finally was able to get ahold of the office and they indicated that my husband had to sign the lease, as well. This would NOT have been an issue if the weeks before when I had to physically walk to the office (with my husband) to have the information emailed to me. Please note, I was stated to only give one email, not two. For October I paid $1,426.21, which is $366.00 over my actual rental charge.
Rent: $989.00 (per amount quoted on the rental agreement)
Total Rent Paid $1,426.21
$150.00 MTM fee
$107.00 overpayment of rent ($1,096.00-$989)
$109.00 late fee (due to unresponsiveness of office)
If you thought the situation ended there, you would be incorrect. I was still trying to get ahold of the office. I called numerous times, then finally resorted to email, because I want to track the ridiculous amount of times I had to contact the office to resolve and issue that THEY caused. I emailed starting in October 31st, then again on 11/6, 11/7, 11/8, 11/12. All without receiving a response. Finally, after my husband physically walked to the office asking for a reply. We finally received the information we needed. As the time passed, I paid the October rent, since I didn't want to be evicted for something that the office caused and wanted to continually ignore. Although, I had to pay for the late fee, $107.00 which I find is ridiculous, since the only reason I was late was because NO ONE was answering me and then I HAD to pay the amount because there was an eviction notice given. I find it 100% unprofessional that they have the time to give me a notice, but not the time to answer an email'
Now, this is where this office becomes very unprofessional. After various attempts of communication, and myself and my husband signing the actual rental lease, they decided to try to insist I owe them money. I was outraged. It was stated that the office knows I have two cats and I will need to pay the $300.00 charge, plus a $15.00 monthly fee for the pet. I am unsure where they think they are obtaining there information of HOW they think this is something new, but I always had 2 cats, stated to the rental office I had 2 cats, paid the $300.00 fee for the two cats when I signed the lease the year before (September 2017). Is this a yearly fee that I was unaware of? Also, since when was there a $15.00 charge? Never heard of this before. After various attempts to have this resolved, I again had to pay the rent with a $150.00 late fee with the additional $300.00 pet fee? Are they doing this on purpose? Sure seems like it.
Onto December. At this point, I am on the verge of contacting a lawyer and the local paper. This is by far the most unprofessional office I ever came in contact with. I work in retail as an Assistant Controller and never had spoken to or ignored a client like this. I was charged the extra $300.00 that I already paid for when I signed the lease the previous year, and with the same amount of cats. Ironic? I tried calling the office numerous times, no reply or answer. I was given the option to come in and speak to them after 5th phone call, but at what time? Holidays are here and there is a quick way to have this concern addressed: email and phone. Now, I was forced to pay $1,502.54. Rent: $989.00 (per amount quoted on the rental agreement). My average rental charge is $1,025.00. This is $477 overage charge? This is ridiculous.
Here is what I need to happen immediately, my patience is no longer available considering I have been 'working? with the office since September. I need to have a refund check or ACH completed to me ASAP. I can still be nice and just have this amount credited to my account. Either option above is satisfying to me. I honestly just want what is due to me since this has been a very unprofessional, unresponsive, disrespectful interaction with the Legacy of Cedar Hill Office.

I am writing to you because there has been very poor management and performance through the Legacy of Cedar Hill office staff located at *** TX XXXXX. First and for most, I want to take a moment to thank you for having a wonderful place to live. The maintenance and grounds keepers are very welcoming and professional. They ensure that everything is taken care of immediately. I enjoy residing at this location, but as of late, the office staff has been lacking in professionalism and responsiveness to various inquires, which I will explain in detail below.
First, I have received information that would allow me to renew my lease in September. I have contact the office numerous times to let them know I was not given the link through my email, as indicated in the renewal letter. Finally, days before the renewal of the lease was due, I walked to the office and requested additional information. They indicated I would need to supply them with the AN email to have the lease given, which was the opposite of what was in the renewal letter. A day after, I signed the lease renewal. Then on October 1st, I noticed that the amount being charged was not what was agreed upon in the lease. So, I emailed them asking what the difference in the charges were, and received no response. I called 3 times, again with no response. I finally was able to get ahold of the office and they indicated that my husband had to sign the lease, as well. This would NOT have been an issue if the weeks before when I had to physically walk to the office (with my husband) to have the information emailed to me. Please note, I was stated to only give one email, not two. For October I paid $1,426.21, which is $366.00 over my actual rental charge.
Rent: $989.00 (per amount quoted on the rental agreement)
Total Rent Paid $1,426.21
$150.00 MTM fee
$107.00 overpayment of rent ($1,096.00-$989)
$109.00 late fee (due to unresponsiveness of office)
If you thought the situation ended there, you would be incorrect. I was still trying to get ahold of the office. I called numerous times, then finally resorted to email, because I want to track the ridiculous amount of times I had to contact the office to resolve and issue that THEY caused. I emailed starting in October 31st, then again on 11/6, 11/7, 11/8, 11/12. All without receiving a response. Finally, after my husband physically walked to the office asking for a reply. We finally received the information we needed. As the time passed, I paid the October rent, since I didn't want to be evicted for something that the office caused and wanted to continually ignore. Although, I had to pay for the late fee, $107.00 which I find is ridiculous, since the only reason I was late was because NO ONE was answering me and then I HAD to pay the amount because there was an eviction notice given. I find it 100% unprofessional that they have the time to give me a notice, but not the time to answer an email'
Now, this is where this office becomes very unprofessional. After various attempts of communication, and myself and my husband signing the actual rental lease, they decided to try to insist I owe them money. I was outraged. It was stated that the office knows I have two cats and I will need to pay the $300.00 charge, plus a $15.00 monthly fee for the pet. I am unsure where they think they are obtaining there information of HOW they think this is something new, but I always had 2 cats, stated to the rental office I had 2 cats, paid the $300.00 fee for the two cats when I signed the lease the year before (September 2017). Is this a yearly fee that I was unaware of? Also, since when was there a $15.00 charge? Never heard of this before. After various attempts to have this resolved, I again had to pay the rent with a $150.00 late fee with the additional $300.00 pet fee? Are they doing this on purpose? Sure seems like it.
Onto December. At this point, I am on the verge of contacting a lawyer and the local paper. This is by far the most unprofessional office I ever came in contact with. I work in retail as an Assistant Controller and never had spoken to or ignored a client like this. I was charged the extra $300.00 that I already paid for when I signed the lease the previous year, and with the same amount of cats. Ironic? I tried calling the office numerous times, no reply or answer. I was given the option to come in and speak to them after 5th phone call, but at what time? Holidays are here and there is a quick way to have this concern addressed: email and phone. Now, I was forced to pay $1,502.54. Rent: $989.00 (per amount quoted on the rental agreement). My average rental charge is $1,025.00. This is $477 overage charge? This is ridiculous.
Here is what I need to happen immediately, my patience is no longer available considering I have been 'working? with the office since September. I need to have a refund check or ACH completed to me ASAP. I can still be nice and just have this amount credited to my account. Either option above is satisfying to me. I honestly just want what is due to me since this has been a very unprofessional, unresponsive, disrespectful interaction with the Legacy of Cedar Hill Office.
This check/ACH (or even credit) should be for the following:

November $107.00 overage
December $477.0 overage
Total owed: $950.00 overage
I am a very reasonable and respectful person, which can be shown by the amount of time and numerous emails and phone calls that I have placed to try and get this resolved. Although, enough is simply enough. Please have this resolved immediately. In addition, it was recommended to me to let you know that a copy of this has been given to my family lawyer. I appreciate your time and kind consideration.

A call was made to Ms. earlier this morning, December XX XXXX, to discuss the items she referred to in her complaint. As soon as I am able to speak to her, I will be able to reply with a more detailed response. Call back info was left on voicemail.

I'm sure an eviction will be filed due to me moving and notifying them that I was moving and breaking the lease due to this unhealthy living condition. I would like this not to affect my rental history due to their lack of communication. I have called and reported the issue, asked for a lateral transfer and also reported the issue through the website portal.

AC in apartment has not been fixed.
On July 11 my AC in my apartment stopped working. We've called and left multiple messages with management and visited the front office to try to get someone to fix it. Maintenance has been out to look at it and get parts but still no one has been able to get it working. This is the 4th day that my AC has not been working. No AC in July Texas heat is dangerous and unacceptable. This could easily become a health issue.

Desired Outcome

1) I need my AC fixed today. 2) I would like my rent pro-rated for the days that my AC hasn't been working.

We spoke to this resident. They stated that the complaint has been resolved and they are satisfied. It was a repair / replacement to an A/C unit.
